HomeMy WebLinkAboutPC Reso No 2017-04 ( CDR 2017-01)RESOLUTION NO.2017.04 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING COMMERCIAL DESIGN REVIEW NO. 2017- O,I FOR THE DEVELOPMENT OF A 2,263 SF OUTDOOR DINNING PATIO AT APN: APNS 374-173-006 AND 374-173-011 Whereas, Hansen McCoy lnvestments, LLC for the approval of building design plans for an approximately 2,263 SF outdoor dining patio and the establishment of alcohol sales in the outdoor dining patio. The proposed Project is located at 169 N. Main Street, generaliy located at the 300'- 0" northeast of intersection of North Main Street and West Peck Street and more specifically referred to as APNs 374-1 73-006 and 374-173-01 1 ; and, Whereas, pursuant to the California Envrronmental Quality Act (Cal. Pub. Res. Code SS 21000 el seq.: "CEQA") and the State Guidelines for lmplementation of CEQA (14 C.C.R. $$ 15000 et seq.. "CEQA Guidelines"), public agencies are expressly encouraged to reduce delay and paperwork associated with the implementation of CEQA by using previously prepared environmental documents when those previously prepared documents adequately address the potential impacts of the proposed Project (CEQA Guidelines Section 15006), and, Whereas, the proposed Project is exempt from the California Environmental Quality Act (Cal. Publ. Res Code SS21000 et seq.:"CEQA") and the State CEQA Guidelines (14. Cal. Code Regs SS15000 et seq.), specifically pursuant to Section 15332 (C/ass 32 - lnfill Development), and. Whereas, pursuant to Downtown Master Plan (DMP) Section 1.2.8 (Review of Projects) the Planning Commission (Commission) has been delegated with the responsibility of making reviewing and taking action on Conditional Use Permits (CUP) and Design Review applications; and, Whereas, on January 17,2017, at a duly noticed Public Hearing the Commission has considered evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The Commission has considered the proposed design for Commercial Design Review No. 2017-00001 lor a 2,263 SF Outdoor Patio and related improvements and has found it acceptable. The Commission has reviewed and analyzed the proposed Project pursuant to the California Planning and Zoning Laws (Cal. Gov. Code SS 65000 et seq.), the Lake Elsinore General Plan, the Lake Elsinore Municipal Code (LEMC), and the Downtown Masterplan and finds and determines that the proposed Commercial Design Review No. 2017-00001 is consistent with the requirements of California Planning and Zoning Law and with the goals and policies of the Lake Elsinore General Plan and the LEMC and Downtown Masterplan. Section 2. The Commission finds proposed project is exempt from the California Environmental Quality Act (Cal. Publ. Res. Code SS21000 et seq.:"CEQA") and the State CEQA Guidelines (14. Cal.
