Domen, MMC, City Clerk Date: September 11, 2018 Subject: Civil Ceremonies Recommendation adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, AMENDING THE FEE SCHEDULE TO INCLUDE RENTAL FEES FOR CIVIL CEREMONIES Background California Family Code, Section 400.1, allows marriage to be solemnized by a County Supervisor, City Clerk, or Mayor of a city elected in accordance with Article 3 (commencing with Section 34900) of Chapter 4 of Part 1 of Division 2 of Title 4 of the Government Code, while that person holds office. The County Supervisor, City Clerk, or Mayor shall obtain and review from the County Clerk all available instructions for marriage solemnization before the County Supervisor, City Clerk, or Mayor first solemnizes a marriage. Discussion Council previously requested the City Clerk’s Department to find additional ways to provide services and engage with the community. Providing this service will enhance civic engagement in the process, as well as promote the utilization of community facilities. Persons wishing to utilize this new service, will have to obtain their marriage license through the County and schedule the Ceremony through the City Clerk. Ceremonies will be performed by appointment only. The City and the City Clerk may not charge for the actual performance of the ceremony; however, charges can be assessed for use of facilities and witnesses. The attached Resolution (Exhibit A) outlines set fees for the use of facilities for this purpose and would add them to the adopted Fee Schedule. Exhibit B will be utilized to promote the service and includes the application packet. Page 2 of 2 Fiscal Impact There is no fiscal impact, other than staff time to prepare, associated with this item; however, there is the potential of increasing revenues from facility rentals. Exhibits A – Resolution B – Civil Ceremony Application Packet RESOLUTION NO. 2018-________ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, AMENDING THE FEE SCHEDULE TO INCLUDE FEES FOR CIVIL CEREMONIES Whereas, California Family Code Section 400.1 allows for the City Clerk to perform Civil Ceremonies; and, Whereas,fees for the use of City facilities adopted by Resolution of the City Council will apply to the use of City facilities for Civil Ceremonies; and, Whereas,providing this service will enhance civic engagement. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1.That the adopted Fee Schedule shall be amended to add the following fees for this service: Resident Non-Resident City Hall $25.00 $25.00 (Ceremony Only) Witness $20.00 $20.00 Section 2.This Resolution shall take effect immediately upon its adoption. Section 3. The City Clerk shall certify to the adoption of this Resolution and enter it into the book of original Resolutions. Domen, MMC City Clerk Civil Marriage Ceremonies may be performed by City Clerks throughout the State of California. In Lake Elsinore, you must make an appointment in advance to be married by the City Clerk. Civil ceremonies take place at various locations throughout the City: Cultural Center, City Park Gazebo, Elm Grove Beach, Launch Pointe, City Hall during City Hall hours - Monday through Thursday 8:00 a.m. - 5:00 p.m.; every other Friday 8:00 a.m. - 4:00 p.m. City Hall is closed holidays and weekends. Evening and weekend appointments may be arranged at some facilities by appointment only. In order to be married by the City Clerk, you will need to obtain a marriage license from the County and bring the original marriage license with you on the day of your ceremony. Both parties must present valid photo identification (i.e. driver’s license or passport). The fee for the ceremony is based on location and City services provided. A reservation is required and must be completed online or at the Lake Community Center. No additional requirements beyond the reservation are required. Requirements: General Liability Insurance- $1million/$2million aggregate Security if hosting alcohol or over 200 people (beer and wine only) Must be picked up and out of facility by midnight Senior Activity Center- Reservations are required at least 30 days prior to event. Can host up to 50-100 people. Two septate buildings, Memorial Hall and Main Room. Six rectangle tables (8’), six round tables (60”) and approximately 100 chairs are available at no additional cost.
