A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE, CALIFORNIA APPROVING PLANNING APPLICATION NO. 2018-28
(RESTDENTTAL DESTGN REVTEW NO. 2018-04) TO RELOCATE THE H|STOR|C
JEAN HAYMAN HOUSE FROM PRIVATELY OWNED PROPERTY LOCATED AT 307
N. MA|N STREET (APN 374-073-009) TO A C|TY OWNED VACANT PARCEL
LOCATED AT 310 E. POTTERY STREET (APN 377-292-0271
Whereas, Habitat for Humanity and the City of Lake Elsinore (City) have filed an application for
Planning Application No. 2018-28 (Residential Design Review No. 2018-04) (Poect) to relocate
the Historic Jean Hayman House from a privately owned parcel to a City owned parcel; and,
Whereas, the relocation of the existing single-family residence located at 307 N. Main Street is
a mandatory Condition of Approvat prior to the construction of a new 4,009 square-foot
convenience store and 4,365 square-foot fueling station; and,
Whereas, pursuant to Lake Elsinore Municipal Code (LEMC) Chapter 17.18a.110(AX2), the
Planning Commission (Commission) has been delegated with the responsibility of making final
decisions on Minor Design Reviews; and,
Whereas, on July 21 , 2015 the Commission recommended approval to the City Council
(Councif) of Commercial Design Review No. 2014-12 by adopting Commission Resolution No.
2015-61 to authorize development of a new gas station and convenience store on the subject
properties located at 301 and 307 N. Main Street; and,
Whereas, on August 11, 2015 the Council approved Commercial Design Review No. 2014-12
pursuant to Resolution No. 2015-075 approving development of the new gas station and
convenience store; and,
Whereas, prior to the development of the gas station and convenience store the Historic Jean
Hayman House shall be relocated to a property located within the Historic Downtown area; and,
Whereas, the City and Habitat for Humanity have partnered to relocate the house and diligently
pursued all required steps to process such relocation; and,
Whereas, on March 8, 2017, property owners Raj and Amit Kumar provided written
documentation that they would donate the Historic Jean Hayman House to the City and Habitat
for Humanity; and,
Whereas, on March 16,2017 the City provided written documentation to Habitat for Humanity
verifying support of the Project and providing funding and in-kind services in an estimated
amount of $59,000; and,
Whereas, on July 25, 2018 the Council approved transfer of funding to an affordable housing
account to provide a City owned vacant lot to Habitat for Humanity to relocate the Historic Jean
Hayman House; and,
Whereas, on February 27 , 2018 the Riverside County Board of Supervisors approved an
Environmental Assessment, Finding of No Significant lmpact on the Environment, and Request
for Release of Funds for the Hayman House project; and,

Whereas, on April 24,2018 the Riverside County Board of Supervisors are scheduled to
approve funding in an amount of $291,000 for the Hayman House p0ect; and,
Whereas, at a future Council meeting staff will present a Memorandum of Understanding
(MOU) to approve and from which to draft a Disposition Development and Loan Agreement
(DDLA) with Habitat for Humanity; and,
Whereas, on April 17, 2018 at a duly noticed Public Hearing the Commission considered
Planning Application No. 2018-28 (Residential Design Review No. 2018-04), accepted all public
oral and written testimony, and acted upon the application.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE
DOES HEREBY RESOLVE, DETERi'INE AND ORDER AS FOLLOWS:
Section 1: The Commission has reviewed and analyzed the proposed project pursuant to the
California Planning and Zoning Laws (Cal. Gov. Code SS 65000 et seq.), the Lake Elsinore
General Plan and the Lake Elsinore Municipal Code and finds and determines that the proposed
Planning Application No. 2018-28 (Residential Design Review No. 2018-04 is consistent with
the requirements of California Planning and Zoning Law and with the goals and policies of the
Lake Elsinore General Plan and the LEMC..
Section 2: The Commission hereby finds and determines that the Project is categorically
exempt from California Environmental Quality Act (Cal. Publ. Res. Code SS21000 et
seq.:"CEQA") and the State CEQA Guidelines (14. Cal. Code Regs SS15000 et seq.),
specifically pursuant to Section 15332 (C/ass 32 - ln-Fill Development Projects) because the
Project is consistent with the applicable General Plan designation and policies, as well as
zoning designation and regulations, the Project is within the City's boundaries and on a site less
than five acres surrounded by urban uses, the Property has no value as habitat, and approval of
the Project will not result in any significant effects relating to traffic, noise, air quality, or water
quality and the Project is adequately served by all required utilities and public services.
Section 3: That in accordance with California Planning and Zoning Law and the LEMC Section
17.184.080 Findings, the Commission makes the following findings regarding Planning
Application No. 2018-28 (Residential Design Review No. 2018-04:
1. The project, as approved, will comply with the goals and objectives of the General Plan and
the zoning district in which the project is located.
The residential use is appropriate to the site and sunounding developments. The Project
complies with the goals and objectives of the General Plan because it will assist in achieving
the development of a well-balanced and functional mix of residential, commercial, industrial,
open space, recreational, and institutional land uses. The Project will serve to greater
diversify and expand Lake Elsinore's economic base.
2. The poect complies with the design directives contained in LEMC 17.184.060and all other
applicable provisions of the Municipal Code. n
The Project is appropriate to the site and sunounding developments in that the Historic Jean
Hayman House has been relocated in consideration of the size and shape of the prqefty.
Sufficient setbacks and enhanced onsite landscaping will be provided thereby creatingr.

interest as a person moves along abutting streets and within the center. ln addition, safe
and efficient circulation has been achieved onsite.
The Project will complement the quality of existing development and will create a visually
pleasing, non-detractive relationship between the proposed relocation and existing
residential neighborhood that is similar to histoic downtown Lake Elsinore. Mateials, colors
and architectural accents will blend with sunounding residences.
3. Subject to the attached conditions of approval, the Project is not anticipated to result in any
significant adverse environmental impacts.
Notwithstanding the fact that the Project is exempt from CEQA provisions pursuant to a
C/ass 32 exemption, the Project was reviewed and conditioned by all applicable City
depaftments to ensure that the project blends into existing development, creates the least
amount of disturbance, and does not negatively impact the resldents or busrnesses of Lake
Elsinore. The Project will not have a significant effect on the environment. The project is
subject to conditions of approval set fotth in City Council Resolution No. 201i075.
4. Conditions and safeguards pursuant to Chapter 17.184.070 of the LEMC, including
guarantees and evidence of compliance with conditions, have been incorporated into the
approval of the Project to ensure development of the property in accordance with the
objectives of Chapter 17.184.
Pursuant to Section 17.184.070 of the LEMC, the Project was considered by the
Commission at a duly noticed Public meeting on Apil 17, 2018, appropriate and applicable
Conditions of Approval have been included to protect the public health, safety and general
welfare, and the project is a permifted use on the subject property in the Residential Mixed
Use land use designation as described in the City's Downtown Master Plan. The Project is
subject to Conditions of Approval set forth in Council Resolution No. 201*075.
Section 4: Based upon all of the evidence presented, the above findings, and the Conditions of
Approval imposed upon the Project, the Commission hereby approves Planning Application No.
2018-28 (Residential Design Review No. 2018-04 subject to Conditions of Approval set forth in
Council Resolution No. 2015-075.
