HomeMy WebLinkAboutPC Reso No 2018-17 (TIGE BOATS)RESOLUTION NO.2018-17 A RESOLUTION OF THE PLANNING COMIUISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOi'MENDING THAT THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVE CONDITIONAL USE PERIUIT NO. 2OI7-03 TO ESTABLISH A BOAT SALES, SERVICE, AND ASSEMBLY FACILITY LOCATED AT APN: 378-030-031 Whereas, Chris Mulvania, Tig6 Watersports has filed an application with the City of Lake Elsinore (city) requesting approval of Planning Application No. 2016-1 1 3 (Conditional use Permit No. 2O1i -03 and lndustrial Design Review No. 2016-03) for the development of the Tige Watersports project (Project) to establish a boat sales, service, and assembly facility that involves the construction of a 25,682 sq. ft. building and a 9,800 sq. ft. storage building with 66 parking spaces, 44,142 sq. ft. paved area, and 18,469 sq. ft. landscaped area on an approximately 2.78-acre lot. The Project site is located on a currently vacant site, on the northwesterly side of Riverside Drive and southwesterly of Collier Avenue. (APN: 378-030-031); and, Whereas, Chapter 1 7.168 of the Lake Elsinore Municipal Code (LEMC) provides that certain uses have operational characteristics that, depending on the location and design ofthe use, may have the potential to negatively impact adjoining properties, businesses or residents and therefore are permitted subject to the issuance of a conditional use Permit, which allows the city to comprehensively review and approve the use; and, whereas, pursuant to chapter 17.168 (Conditional Use Permits) of the LEMC, the Planning commission (commission) has been delegated with the responsibility of making recommendations to the Council pertaining to conditional use permits; and, Whereas, on March 6,2018 at a duly noticed Public Hearing the Commission has considered evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE PLANNING CO]YIMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: @jj The Commission has considered the Project prior to making a recommendation to the Council and has found it acceptable. Section 2: On March 6, 2018, after consideration and evaluation of all written reports and comments and oral testimony presented by the Community Development Department and other City departments, property owners, residents and other interested parties and such other matters as are reflected in the record of the noticed Public Hearing on the Project, the Commission adopted Resolution No. 2018-17 finding and determining that the Mitigated Negative Declaration (ER 2017-03) (SCH No. 2018011047) is adequate and is prepared in accordance with the requirements of CEQA. Section 3. That in accordance with LEMC Section 17.168.080 Findings, the Commission makes the following findings regarding Planning Application No. 2016-'113 (Conditional Use Permit No. 2Q17-03): PC Reso. The Conditional Use Permit. has been thoroughty reviewed and conditioned by alt appticabtecity departments thereby etiminating the potintiat for any adverse effects. 6. Adequate conditions and safeguards pursuant to LEMC 17.16g. o5o, including guarantees andevidence of compliance with conditions, have been incorporated into tne-ipprovil ot ttresubiect project to ensure development of the property in accordance with the oblectives of ttrischapter and the planning district in which the site is iocated. No. 2018-17 Page 3 of 3 Pursuant to Section 17.168.040 of the LEMC, the Project was considered by the Planning Commission at a duly noticed Public Hearing on March 6, 2018, appropriate and applicable conditions of approval have been included to protect the public health, safety and general welfare. Section 4: Based upon the evidence presented, the above findings, and the Conditions of Approval imposed upon the Project, the Commission hereby recommends that the Council approve Planning Application No. 2016-1 13 (Conditional Use Permit No. 2017-03). $g!!on 5:.
