HomeMy WebLinkAboutPC Reso No 2018-03 (TTM 37280)RESOLUTTON NO.2018-03 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING THAT THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVE TENTATIVE TRACT MAP NO. 37280 FOR CONDOMINIUM PURPOSES LOCATED AT APN: 379-230{01 Whereas, Peng Jiang, ANG Designs has filed an application with the City of Lake Elsinore (City) requesting approval of Planning Application No.2016-58 (Tentative Tract Map No. 37280 and Residential Design Review No. 2017-01) for the development of the Lakeview Manor Condominium project (Project). The Project consists of eleven, two-story condominium buildings with 104 units (164,347 sq. ft. total), 242 covered and open parking, landscaped common areas, and a 15,909 sq. ft. outdoor recreation complex that includes a large playground, swimming pool and spa, tennis court, and a 6,918 sq. ft. private community clubhouse on an approximately 7.5- acre site. The Project also includes a tentative tract map application to consolidate existing parcels into one-7 .28 acre lot for condominium purposes. The remaining 0.22-acre of the site will be dedicated for road right-of-way purposes. The Project site is located on a currently vacant site southeasterly of Machado Street, on the southwesterly side of the intersection of Lakeshore Drive and Gunnerson Street within the Lakeshore Village Specific Plan (LVSP) (APN: 379-230-001); and, Whereas, pursuant to Lake Elsinore Municipal Code (LEMC) Chapter 16.24 (Tentative Map) the Planning Commission (Commission) has been delegated with the responsibility of making recommendations to the City Council (Council) pertaining to tentative maps; and, Whereas, on December 5,2017 and January 16, 2018, at a duly noticed Public Hearing, the Commission considered evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, OETERTUINE AND ORDER AS FOLLOWS: Section 1: Prior to making a recommendation to the Council, the Commission has reviewed and analyzed the proposed Project pursuant to the appropriate Planning and Zoning Laws, and Chapter 16 (Subdivisions) of the LEMC. Section 2: On January 16,2018, after consideration and evaluation of all written reports and comments and oral testimony presented by the Community Development Department and other City departments, property owners, residents and other interested parties and such other matters as are reflected in the record of the noticed Public Hearing on the Project, the Commission adopted Resolution No. 2018-03 finding and determining that the Mitigated Negative Declaration (ER 2017-04) (SCH No. 2017111013) is adequate and is prepared in accordance with the requirements of CEQA. Section 3: That in accordance with State Planning and Zoning Law and the LEMC, the Commission makes the following findings for approval of Tentative Tract Map (TTM) No. 37280: 1. The proposed subdivision, together with the provisions for its design and improvement, is consistent with the General Plan (GP). The proposed subdivision is compatible with the objectives, policies, general land uses and programs specified in the GP (Government Code Section 66473.5). PC Reso. No. 2018-03 Page 2 of 3 a. The proposed tentative map is located within the Lakeshore Village Specific Plan (LVSP) and is designated as Attached Residential (AR) and Commercial Residential (CRF). The AR designation is intended to accommodate attached residential products such as apartments and/or condominiums at a maximum density of 18 Dwelling Units per Acre (D.U./A,.). The CRF designation is intended to provide for two alternative types of development dependent upon market condition s: neighborhood commercial development consistent with the Neighborhood Commercial (CN) designation or with a higher density residential development consistent with the AR designation. The Project is proposing to develop a condominium complex with a density of 13.9 D.U./Ac. on both the AR and CRF designations. The proposed Project is consistent with the provisions of the LVSP. The LVSP was subject to a consistency finding with the GP prior to adoption. Therefore, the Project is found to be consistent with the GP. b. All offsite mitigation measures have been identified in a manner consistent with the GP. c. All recreational amenities have been provided in a manner consistent with the GP. 2. ihe site of the proposed subdivision of land is physically suitable for the proposbd density of development in accordance with the GP. a. The overall density and design is consr.sfent and compatible with the adjacent communities. The effects that this project are likely to have upon the housing needs of the region, the public service requirements of its residents and the available fiscal and environmental resources have been considered and balanced. a. The Project is consistent with the Ct$'sGP. Duing the approval of theGP, housing needs, public sevices and fiscal resources were scrutinized to achieve a balance within the City. The proposed divislon of land or type of improvements is not likely to result in any significant environmental impacts. a. The Project has been adequately conditioned by all applicable depaftments and agencies and will not therefore result in any significant environmental impacts. The proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. The design of the proposed division of land or type of improvements is not likely to cause serious public health problems. a. TTM37280 has been designed in a manner consistent with the GP and does not divide previously establ i shed comm u n itie s. The design of the proposed division of land or type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed division of land. a. All known easements or request for access have been incorporated into the design of TTM 37280. J. 4. 5. b. PC Reso. No. 2018-03 Page 3 of 3 b. The map has been circulated to City depaftments and outside agencies, and appropriate Conditions of Approval have been applied to the Project. Section 4: Based upon all ofthe evidence presented, the above findings, and the conditions of approval imposed upon the Project, the Commission hereby recommends that the Council approve Tentative Tract Map No. 37280. Section 5: This Resolution shall take effect immediately upon its adoption.
