HomeMy WebLinkAboutPC Reso No 2016-39 (Live Entertainment & Banquet Facilities)RESOLUTTON NO. 2016-39 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ALLOWING LIVE ENTERTAINMENT AND BANQUET FACILITIES AS A USE ALLOWED WITHIN THE C-1 (NETGHBORHOOD COMMERCTAL) ZONTNG D|STR|CT SUBJECT TO APPROVAL OF A CONDITIONAL USE PERMIT WHEREAS, Hermilla Soto has requested a determination as to whether a "Live Entertainment and Banquet Facilities" is an allowable use in the C-1 Neighborhood Commercial District subject to approval of a conditional use permit; WHEREAS, Live Entertainment and Banquet Facilities are not listed as either a permitted use or a use subject to a conditional use permit in the C-1 Neighborhood Commercial District, and, WHEREAS, Section 17 .120.030, Paragraph I of the Lake Elsinore Municipal Code states that the uses subject to a conditional use permit ln the C-l Neighborhood Commercial District include other uses that the Planning Commission finds to be in accord with the purpose of the C-1 Neighborhood Commercial District and have characteristics that are similar to listed uses; and, WHEREAS, on May 3, 2016, at a duly noticed public meeting, the Planning Commission considered evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That in accordance with the Lake Elsinore Municipal Code, the Planning Commission makes the following findings: 1. Live Entertainment and Banquet Facrlities uses are in accord with the purpose and objectives of the C-1 Neighborhood Commercial District in which the proposed use would be allowed. a. The intent of the C-1 districi ls to reseNe appropriate locations consisfent with the General Plan to accommodate a full range of retail sfores, offlces, personal and busrness service establishments offering commodities and serylces scaled to meet the needs of the resldenls of the entire City. 2. The proposed use will not be detrimental to the general health, safety, comfort, or general welfare of persons residing or working within the General of the proposed use or the City, or injurious to property or improvements in the General or the City. a. All applicable City deparlments and agencies will be afforded an oppoftunity to review any conditional use permit application for a "Live Enteftainment PLANNING COMMISSION RESOLUTION NO. 2016-39 PAGE 2 OF 3 and Banquet Facilities" in the C-1 General Commercial District and will recommend conditions of approval relating to the proposed use, so as lo eliminate any negative impacts to the general health, safety, comfoft, or general welfare of persons residing or working within the general area of the proposed use. SECTION 2. Based upon the evidence presented and the above findings, the Planning Commission hereby finds that "Live Entertainment and Banquet Facilities located no less than 300'-0" from residential uses or zone districts" are allowable uses within the C-1 Neighborhood Commercial District subject to approval of a Conditional Use Permit. SECTION 3. This Resolution shall take effect from and after the date of its passage and adoptron.
