HomeMy WebLinkAboutPC Reso No 2016-24 (Annex 84 - GPA 2014-03)RESOLUTION NO. 20,I6-24 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE APPROVAL OF GENERAL PLAN AMENDMENT 2014.03 SUBJECT TO COMPLETION OF THE ANNEXATION NO. 84. WHEREAS, Bruce Vinci, RHW, LLC has filed an application with the City of Lake Elsinore to amend the City's General Plan Land Use designations ("General Plan Amendment") for properties located north of Greenwald Avenue on Dowling Street extension and specifically referred to as Assessor Parcel Numbers 349-250-013, 349- 250-014,349-250-015 and 349-250-016 from to change the land use designation of two parcels from Low Density Residentialto Medium Density Residential and one parcel from Hillside Residential to Low Density Residential as identified in Exhibit "A"; and WHEREAS, Government Code Section 65358 empowers the legislative body to amend all or part of an adopted general plan if to do so would be in the public interest and so long as no mandatory element of the general plan is amended more frequently than four times during any calendar year; and WHEREAS, General Plan Amendment No. 2014-03 (the "project") is part of the City's First ('1st) Cycle amendments to the Lake Elsinore General Plan for the 2016 calendar year. and WHEREAS, public notice of the General Plan Amendment has been given and on March 15,2016, atduly noticed public hearingsthe Planning Commission has considered evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The Planning Commission has revrewed and analyzed the proposed General Plan Amendment pursuant to the California Planning and Zoning Laws (Cal. Gov. Code $$ 65000 et seq.), the Lake Elsinore General Plan and the Lake Elsinore Municipal Code and finds and determines that the proposed General Plan Amendment is consistent with the requirements of California Planning and Zoning Law and with the goals and policies of the Lake Elsinore General Plan and the Lake Elsinore Municipal Code. SECTION 2. The Planning Commission, based upon a thorough review of the proposed Addendum #2 to the General Plan Update Recirculated Program Environmental lmpact Report, the CEQA documents, and the evidence received to date, does determine as follows: '1 . ln accordance with Section 1 5162 of the California Environmental Quality Act (CEOA) Guidelines, the proposed annexation and zone change do not present substantial changes or reveal new information that would require PLANNING COMMISSION RESOLUTION NO. 2016.24 PAGE 2 ot 4 Subsequent or Supplemental EIR analysis. However, some changes or additions to the information contained in the certified EIR is necessary in order to approve the proposed project. For this reason, pursuant to Section 15164 of the CEQA Guidelines, an lnitial Study/Addendum to the General plan Update Recirculated Program Environmental lmpact Report (GPU EIR)(SCH No. 2015'121019) was prepared to provide an evaluation of potential site- specific environmental effects that could result from the proposed project, compared those effects to what was disclosed by the GPU EIR and concluded that the significant effects that would result from the Project have been addressed in the earlier certified GPU ElR. The lnitial Study/Addendum constitutes Addendum # 2 to the General Plan Update Recirculated Program Environmental lmpact Report (SCH No. 2015121019). SECTION 3. That in accordance with the Cailfornia Planning and Zoning Law and the Lake Elsinore Municipal Code, the Planning Commission hereby makes the following findings for the approval of General Plan Amendment No. 2012-03: 1. The proposed General Plan Amendment will not be a) detrimental to the health, safety, comfort or general welfare of the persons residing or working within the neighborhood of the proposed amendment or within the City, or b) injurious to the property or improvements in the neighborhood or within the City. a. The proposed General Plan Amendment has been analyzed relative to its potential to have detrimental effects and conditions have been imposed on the subject project to ensure that the health, safety and welfare of surrounding residents will be protected. b The application to modify the General Plan Land use designations would not be injurious to the propefty or improvements in the neighborhood as the General Amendment would modify the existing residential designation to a different designation. 2. The proposed General Plan Amendment will permit reasonable development of the area consistent with its constraints. The proposed designations will allow for the development of the 160 acre properties in manner that is reflective of the topographical restraints and in a manner consistent with the Meadowbrook Sphere District. 3. The proposed General PIan Amendment would establish a land use density, intensity and usage more in character with the subject property's location, access, and constraints. PLANNING COMMISSION RESOLUTION NO. 2016.24 PAGE 3 of 4 The proposed amendment would permit the transfer of residential densltles amongst the four properlies and would create development that is in more character of the surrounding community. 4. The proposed General Plan Amendment will not have a significant effect on the environment. The effects of the General Plan Amendment has been analyzed in the Addendum #2 of the General Plan Update Recirculated Program Environmental lmpact Report (GPU EIR)(SCH No. 2015121019) and has been found to not create any new impacts. SECTION 4. Based upon the evidence presented, both written and testimonial, and the above findings, the Planning Commission hereby recommends approval of General Plan Amendment No 2014-03. SECTION 5. This Resolution shall take effect from and after the date of its passage and adoption.
