A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, APPROVING CONDITIONAL USE
PERMIT NO. 2015-11 FOR THE ESTABLISHMENT AND OPERATION OF
THE "HOPE" FOOD DISTRIBUTION FACILITY WITH OUTSIDE
STORAGE WITHIN AN EXISTING 7,850 SQUARE FOOT BUILDING ON
PROPERTY LOCATED AT 506 W. MINTHORN STREET, ASSESSOR
PARCEL NUMBER (APN) 377-180-026
WHEREAS, Steve Falk on behalf of HOPE (Helping Our People in Elsinore) has
requested approval of Conditional Use Permit No. 2015-1 1, to establish and operate the
"HOPE" Food Distribution Facility with outside storage at 506 W. Minthorn Street which
is referred to herein as the "Project", and
WHEREAS, the Project is for the establishment and operation of the "HOPE" Food
Distribution Facility, distributes food to low income individuals and families within an
existing 7,850 square foot building, one-story in height, to provide dry storage,
refrigeration storage, food pantry, clothing, food storage, office, reception, waiting,
conference room, check-in and restrooms areas for the Food Distribution Facility. No
food or meals will be served or prepared on site or distributed. The subject property is
located at 506 W. Minthorn Street (APN 377-180-026) and has a General Plan Land Use
Designation of Limited lndustrial Use and is Zoned M-1 (Limited Manufacturing); and,
WHEREAS, the application for Conditional Use Permit No. 2015-11 proposes the
establishment and operation of the HOPE Food Distribution Facility with outside storage.
The Community Development Director has determined that with the benefit of a
conditional use permit, public hearing process, and applicable conditions of approval such
use can provide community benefits and have potential impacts mitigated to insignificant
levels; and,
WHEREAS, Chapter 17.168 of the Lake Elsinore Municipal Code ("LEMC")
provides that certain uses have operational characteristics that, depending on the location
and design of the use, may have the potential to negatively impact ad.ioining properties,
businesses or residents and therefore are permitted subject to the issuance of a
Conditional Use Permit, which allows the City to comprehensively review and approve
the use; and
WHEREAS, on February 16. 2016 at a duly noticed public hearing the Planning
Commission has considered evidence presented by the Community Development
Department and other interested parties with respect to this item.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS
FOLLOWS:

SECTION 1. The Planning Commission has considered Conditional Use Permit
No. 2015-1 1 for the proposed HOPE Food Distribution Facility and has found it
acceptable subject to mandatory conditions of approval.
SECTION 2. The Project is categorically exempt from California Environmental
Quality Act (Cal. Publ. Res. Code SS21000 et seq. 'CE-QA") and the^State CEQA
Guideiines (14. Cal. Code Regs SS15000 et seq.), specifically pursuant to Section 15301
(Class '1 - Existing Facilities); because the proposed Project consists of the
establishment of a community-oriented program within an existing building which involves
negligible or no expansion of use.
SECTION 3. That in accordance with California Planning and Zoning Law and
Lake Elsinore Municipal Code Section 1 7.168.060 Findings, the Planning Commission
makes the following findings regarding Conditional Use Permit No. 2015-11:
1. That the proposed use, on its own merits and within the context of its setting,
is in accord with the objectives of the General Plan and the purpose of the
planning district in which the site is located.
The HOPE Food Distribution Facility conforms with the goals and obiectives of
the General Plan, because it will facilitate the creation of a well-balanced and
functional mix of residential, commercial, industrial, open space, recreational
and institutional land uses. The proiect will provide servlces and activities that
will benefit the City and lower income persons and families in the area.
2. The proposed use will not be detrimental to the general health, safety, comfort
or general welfare of persons residing or working within the neighborhood of
the proposed use or the City, or injurious to property or improvements in the
neighborhood or the City.
All applicable City depaftments and agencies have been afforded the
opportunity to review the Conditional Use Permit and their comments have
been addressed in the conditions of approval attached to the staff report for this
Project. Conditions have been applied relating to the proposed use so as fo
eliminate or reduce to the extent practicable any negative impacts to the health,
safety, comforT, or general welfare of the surrounding industrial development,
buslness owners and operators, resldenfs, and the City of Lake Elsinore.
3. The Site for the intended use is adequate in size and shape to accommodate
the use, and for all the yards, setbacks, walls or fences, landscaping, buffers
and other features required by Title '17 (Zoning) of the Lake Elsinore Municipal
Code.

The proposed Conditional Use Permit for the HOPE Food Distribution Facility
provides services to low income individuals and families. No food or meals are
served or prepared onsite or distributed. The proposed use will be conducted
within an existing building except for accessory outside storage and will not
require any significant interior or exterior alterations. The proposed use has
been analyzed and staff has determined that the proposed use meets all
applicable sectlons of the Lake Elsinore Municipal Code, M-1 Limited
Manufacturing zone district, and will complement the existing uses in the area,
based on the submitted plans and conditions of approval attached to the staff
repoft for this Project.
4. The Site for the proposed use relates to streets and highways with proper
design both as to width and type of pavement to carry the type and quantity of
traffic generated by the subject use.
The proposed establishment and operation of the HOPE Food Distribution
Facility within an existing 7,850 square-foot building includes dry storage,
refrigeration storage, food pantry, clothing, food storage, office, reception,
waiting, conference room, check in, and restroom areas for the purpose of
distribution food to low income individuals and families, The facility and related
activities has been reviewed in relation to the existing street widths on Minthorn
Street and the expected quantity of traffic to be generated. The serving of 10
to 30 clients three days a week will limit vehicle traffic and parking demand in
the area and existing sfreets can accommodate the use.
5. ln approving the subject use at the specific location, there will be no adverse
effect on abutting properties or the permitted and normal use thereof.
The Conditional Use Permit has been thoroughly reviewed and conditioned by
all applicable City depaftments including Planning, Building and Safety, Fire,
and Public Works/Engineering thereby reducing potential impacts to
insignificant levels.
6. Adequate conditions and safeguards pursuant to LEMC 17.68.050, have been
incorporated into the approval of the conditional use permit to ensure that the
use continues in a manner envisioned by these findings for the term of the use.
Pursuant to Section 17.168.040 of the Lake Elsinore Municipal Code, the
Project was considered by the Planning Commission at a duly noticed public
hearing on February 16, 2016 and appropriate and applicable conditions of
approval have been included to protect the public health, safety and general
welfare.

SECTION 4. Based upon all written reports, comments and oral testimony
presented by the Community Development Department, other City departments, property
owners, business owners and operators, residents, and other interested parties and such
other matters as are reflected in the record, the Planning Commission hereby approves
Conditional Use Permit No. 2015-1 '1 subject to the attached conditions of approval.
SECTION 5. This Resolution shall take effect from and after the date of its
passage and adoption.
