A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, APPROVING CONDITIONAL USE
PERMIT 2015-05 FOR A 69'.6" WIRELESS TELECOMMUNICATIONS
FACILITY DESIGNED AS A LIGHT POLE AND RELATED EQUIPMENT
LOCATED AT 28200 LAKE STREET
WHEREAS, Cortel on behalf Verizon Wireless ("Applicant"), has filed an
application with the City of Lake Elsinore requesting approval of Conditional Use Permit,
which is referred to herein as the "Project"; and
WHEREAS, Pacific Clay Products, lnc., Castle & Cooke Lake Elsinore Outlet
Centers, lnc., Castle & Cooke Corona, lnc., Gateway Business Park, LLC, and Murdock
Alberhill Ranch Limited Partnership, (collectively "Owner") entered into that certain
settlement agreement and memorandum of understanding (the "Settlement
Agreement") with the County of Riverside on February 24, 2004, which exempts and
excludes all of the Owner's properties (including present and future uses and
development of Owner's properties) from the Western Riverside County Multiple
Species Habitat Conservation Plan (MSHCP) for all purposes; and
WHEREAS, the Applicant proposes to construct a proposed wireless
telecommunication facility designed as a 69'-6" high light pole, housing six (6) paddle
antennas, 12 remote radio units, and supplemental equipment and a 20'-0" X 13'-4"
CMU block enclosure to screen various ground mounted equipment. The proposed
project is located in the Alberhill Ranch Specific Plan at 28200 Lake Street, Lake
Elsinore (APN: 389-020-056); and
WHEREAS, in accordance with the California Environmental Quality Act
(California Public Resources Code Section 21000 et seq.: "CEQA"), the State CEQA
Guidelines (Title 14, California Code of Regulations Section 15000 et seq.: "CEQA
Guidelines"), the Project is categorically exempt from CEQA and the CEQA Guidelines
pursuant to a Class 3 categorical exemption for new construction or conversion of small
structuresi and
WHEREAS, Chapter 17.168 of the Lake Elsinore Municipal Code ("LEMC")
provides that certain uses have operational characteristics that, depending on the
location and design of the use, may have the potential to negatively impact adjoining
properties, businesses or residents and therefore are permitted subject to the issuance
of a Conditional Use Permit, which allows the City to comprehensively review and
approve the use; and
WHEREAS, pursuant to LEMC Chapter '17.'168 (Conditional Use Permits) the
Planning Commission of the City of Lake Elsinore has been delegated with the
responsibility of reviewing and approving, conditionally approving, or denying conditional
use permits; and

WHEREAS, on January 5,2016, at a duly noticed public hearing the Planning
Commission has considered evidence presented by the Community Development
Department and other interested parties with respect to this.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER
AS FOLLOWS:
SECTION 1. The Planning Commission has considered Conditional Use Permit
No. 201 5-05 for the proposed project, prior to making a decision and has found it
acceptable.
SECTION 2. The Planning Commission acknowledges the Settlement
Agreement which exempts and excludes the Project from the requirements of the
MSHCP for all purposes. Therefore, the Planning Commission adopts findings that the
project is exempt from the MSHCP and that no further MSHCP actron is required.
SECTION 3. The California Legislature has determined that certain classes of
projects do not have a significant effect on the environment and are therefore exempt
from the California Environmental QualityAct (Cal. Pub. Res. Code SS 21000 etseg,:
"CEOA') and the State Guidelines for lmplementation of CEQA (14 C.C.R. SS 15000 et
seg.: the "CEQA Guidelines"). A Class 3 exemption exists for:
"Construction and location of limited numbers of new, small facilities or
structures; installation of small new equipment and facilities in small
structures; and the conversion of existing small structures from one use to
another where only minor modifications are made in the exterior of the
structure."
The proposed wireless telecommunication facility equipment and associated
improvements qualify for a Class 3 exemption because they involve the construction of
limited numbers of new, small facilities or structures and the installation of small new
equipment and facilities. Therefore, the Planning Commission hereby finds and
determines that the Project is exempt from CEQA and the CEQA Guidelines.
SECTION 4. That in accordance with California Planning and Zoning Law and
LEMC Section 17.168.080 Findings, the Planning Commission makes the following
findings regarding Conditional Use Permit No. 2015-01 :
1. That the proposed use, on its own merits and within the context of its setting,
is in accord with the objectives of the General Plan and the purpose of the
planning district in which the site is located..
The proposed telecommunications facility is located in the Specific Plan Use
designation, the Specific Plan Zoning designation, and Alberhill Ranch
Specific Plan, all of which provide for a number of uses, including
telecom m u n i c ati o n s fa c i I iti e s.
