HomeMy WebLinkAboutPC Reso No 2015-29 (Pardee Homes-ttm36682)RESOLUTION NO. 2015-29 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE APPROVAL OF TENTATIVE TRACT MAP NO. 36682, TO SUBDIVIDE 20.2 ACRES LOCATED ON THE SOUTH SIDE OF HOLLAND ROAD, EAST OF HERMOSA DRIVE AND ON THE NORTH SIDE OF CORSON AVENUE, INTO 74 SINGLE.FAMILY RESIDENTIAL LOTS wlTH AN AVERAGE LOT SIZE OF OVER 8,IOO SQUARE FEET AND A WATER QUALITY/DETENTION BASIN, AND THE RECONFIGURATION OF 8 SINGLE-FAMILY LOTS FROM A PREVIOUSLY APPROVED TENTATTVE TRACT MAP (TTM 36115-1) WHEREAS, Pardee Homes, filed an application for Tentative Tract Map 36682, also referred to as Meadow Ridge ll, (the "project") with the City of Lake Elsinore for a residential subdivision of 20.2+ acres of unimproved property located on the south side of Holland Road, east of Hermosa Drive and on the north side of Corson Avenue (APN 358-130-020); and WHEREAS, pursuant to Lake Elsinore Municipal Code (LEMC) Chapter 16.24 (Tentative Map) the Planning Commission has been delegated with the responsibility of making recommendations to the City Council pertaining to the subdivision of land; and WHEREAS, the Project is subject to the provisions of the California Environmental Quality Act (Publc Resources Code $$ 21000, et seq.: 'CEQA") and the State lmplementation Guidelines for CEQA (14 California Code of Regulations Sections 15OOO, et seq.: "CEQA Guidelines") because the Project involves an activity which may cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and involves the issuance of a lease, permit license, certificate, or other entitlement for use by one or more public agencies (Public Resources Code Section 21065); and wHEREAS, pursuant to CEQA Guidelines Section 15063, the City conducted an lnitial Study to determine if the Project would have a significant effect on the environment. The lnitial Study revealed that the project would have potentially significant environmental impacts but those potentially significant impacts could be mitigated to less than significant levels; and WHEREAS, pursuant to CEQA Guidelines Section 15072, on October 16, 2014 the City duly issued a notice of intent to adopt a Mitigated Negative Declaration; and in accordance with CEQA Guidelines Section 15073, the lnitial Study/Mitigated Negative oeclaration was made available for public review and comment for thirty days beginning on February 26, 2015 and ending on March 30, 2015; and WHEREAS, on April 7, 2015 al a duly noticed public hearing the Planning Commission has considered evidence presented by the Community Development PLANNING COMMISSION RESOLUTION NO. 2015-29 TTM 36682 PAGE 2 of 4 Department and other interested parties with respect to this item. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The Planning Commission has reviewed and analyzed the proposed project pursuant to the California Planning and Zoning Laws (Cal. Gov. Code SS 65000 et seq.), the Lake Elsinore General Plan and the Lake Elsinore Municipal Code and finds and determines that the proposed Tentative Tract No. 36682 is consistent with the requirements of California Planning and Zoning Law and with the goals and policies of the Lake Elsinore General Plan and the Lake Elsinore Municipal Code. SECTION 2. The Planning Commission has considered Mitigated Negative Declaration No. 2015-03 and the Mitigation Measures appertaining thereto. Mitigated Negative Declaration No. 2015-03 was prepared pursuant to Section 15162 of the California Environmental Quality Act (CEQA) Guidelines. Appropriate findings were made, and Mitigated Negative Declaration No. 2015-03 provides the necessary environmenlal clearance for Tentative Tract No. 36682. SECTION 3. That in accordance with the California Planning and Zoning Laws and the City of Lake Elsinore Municipal Code, the Planning Commission makes the following findings for Tentative Tract Map No. 36682: 1. The proposed subdivision, together with the provisions for its design and improvements, is consistent with the City of Lake Elsinore General Plan. The proposed subdivision is compatible with the ob.iectives, policies, general land uses and programs specified in the General Plan (Government Code Section 66473.5). The design ot the proposed map, at a densw of approximately 4.0 dwelling units per acra, is cons,slenl with the apprcved Low Medium Density Residential land use designation, and therefore, consistent with the Genenl Plan. 2. The site of the proposed subdivision of land is physically suitable for the proposed density of development in accordance with the General Plan. The project site is vacanl and is relatively flat, with a several small knolls and the design and denslty is compatible with the adjacent Canyon Hills Specific Plan including the approved Tentative Tract No. 36115 located immediately west of the project site. The effects that this project are likely to have upon the housing needs of the region, the public service requirements of its residents and the available fiscal and environmental resources have been considered and balanced. The Tentative Tract Map is consistenl with the proposed General Plan's land use plan, development and design standards, and programs, and all other appropiate requirements contained in the General Plan. Tentative Tract Map No. 36682 ls conslslent with Housing Element Policy 3.1 to "Use the City's General Plan, Municipal Code, other land use and development plans, and the development process to provide housing sifes fhaf meet the identified local need." 4. The design of the proposed division of land or type of improvements is not likely to cause serious public health problems. The project has been adequately conditioned by all applicable departments and agencies and will not therefore result in any significant environmental impacts. The proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or mateially injuious to propefties or improvements in the vicinity. SECTION 4. Based upon the evidence presented, both written and testimonial, and the above findings, and the attached amended conditions of approval, the Planning Commission hereby recommends that the City Council approve Tentative Tract No. 36682. SECTION 5. This Resolution shall take effect from and after the date of its passage and adoption.
