Present. Council Members Sheridan, Johnson and Magee; Mayor Pro -Tem Tisdale and Mayor Manos Absent: None There were no members of the public appearing to speak. The meeting was called to order at 7:00 p.m. by Mayor Manos. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mayor Manos. Present: Council Members Sheridan, Johnson and Magee; Mayor Pro -Tem Tisdale and Mayor Manos Absent: None PRESENTATIONS / CEREMONIALS 1) Mayor's Recognition of Public Works Staff Mayor Manos thanked Public Works Staff and noted their work and commitment to the City. CLOSED SESSION REPORT Assistant City Attorney Mann provided the Closed Session Report and stated there is no reportable action. PUBLIC COMMENTS — NON -AGENDIZED ITEMS — 1 MIN Appearing to speak were: Paulie Tehrani and Ace Vallejos. CITY COUNCIL CONSENT CALENDA It was moved by Council Member Johnson, seconded by Mayor Pro -Tem Tisdale, and carried, noting the dissent of Council Member Magee on Item Number 14, to approve the City Council Consent Calendar. Item number 11 was pulled for discussion. 2) Minutes of the Regular City Council Meeting of March 12, 2019 Recommendation: Approve the Minutes. 3) CC Investment Report for February 2019 Recommendation: Receive and file. 4) CC Warrant List Dated March 14, 2019 Recommendation: Receive and file. 5) Agreement for Contractor Services with Wood Environment & Infrastructure Solutions Inc. to fulfill Clean Up and Abatement Funding_ Authorization Grant Recommendation: Authorize the City Manager to execute the Contractor Services Agreement to allow for a two (2) year term in a total amount not to exceed $41, 770. 00, in such final form as approved by the City Attorney. Page 2 of 7 6) Addendum No. 3 to Commercial Lease Agreement Recommendation: Authorize the City Manager to execute Addendum No. 3 to Commercial Lease Agreement for premises located at 114 S. Main Street in such final form as approved by the City Attorney. 7) Amendment No. 1 to Professional Services Agreement Between Shawn Nelson Consulting and the City of Labe Elsinore for Consulting Services Recommendation: Authorize the City Manager to execute amendment No. 1 in an amount not to exceed $60, 000. 00, for consulting services, in such final form as approved by the City Attorney. 8) Contract Renewal for the Granicus Agenda Management System Recommendation: Authorize the City Manager to sign and issue an agreement for the amount of $105,256.71 to Granicus Inc., for the period of January 31, 2019 through November 30, 2021 (three years). 9) Disposition, Development and Loan Agreement by and between the City of Lake Elsinore and Mission Cotta_ ges LP (Cottages at Mission Trail Affordable Housing Proiect) Recommendation: adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ACTING AS HOUSING SUCCESSOR, APPROVING A DISPOSITION, DEVELOPMENT AND LOAN AGREEMENT, ADDENDUM TO COMMITMENT LETTER AND RELATED DOCUMENTS BY AND BETWEEN THE CITY OF LAKE ELSINORE AND MISSION COTTAGES LP 10) On -call and Minor Construction Contractor Services Agreement with J & L Constructors Recommendation: 1. Authorize the City Manager to execute an agreement with J & L Constructors in the amount of $60,000.00, in such final form as approved by the City Attorney, and, 2. Authorize the City Manager to execute change orders not to exceed the contingency amount of $12, 000.00. 11) Revised Lake Elsinore City Council Policy No. 300 -3 (City Credit Cards,_ Meals, and Travel Expenses) This item was removed from the Consent Calendar and it was moved by Council Member Tisdale, seconded by Council Member Sheridan, and unanimously carried to continue the item under the review of the Budget Sub - Committee. 12) Change of Street 'Name for a portion of Village Parkway to Scarlet Oak Recommendation: 1. adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, CHANGING THE NAME OF A PORTION OF VILLAGE PARKWAY TO SCARLET OAK; and, Page 3 of 7 2. Direct the City Clerk to notify the County Board of Supervisors of the street name change. 13) Planning Application No. 2018 -55 (Viscaya) - Design Review for the Construction of Eight (8)_ Sin le-Family Residential Units Recommendation: adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, FINDING THAT PLANNING APPLICATION NO. 2018 -55 (RESIDENTIAL DESIGN REVIEW NO. 2018 -18) IS CONSISTENT WITH THE WESTERN RIVERSIDE COUNTY MULTIPLE SPECIES HABITAT CONSERVATION PLAN (MSHCP); and, adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING PLANNING APPLICATION NO. 2018- 55 (RESIDENTIAL DESIGN REVIEW NO. 2018 -18) PROVIDING BUILDING DESIGNS AND RELATED IMPROVEMENTS FOR EIGHT SINGLE- FAMILY DWELLING UNITS LOCATED WITHIN LOTS 7, 8, 9, 12, 13, 21, 22, AND 23 OF TRACT NO. 32008 OF THE LAKESHORE VILLAGE SPECIFIC PLAN (APNs: 379 - 480 -001 THROUGH 003, 006, 007, AND 015 THROUGH 017) 14) Second Reading of an Ordinance Amending the Lake Elsinore Municipal Code Regarding the Duties of the City Mana er Director of Finance City Clerk and Purchasing Officer Recommendation: Adopt by title only and waive further reading of an ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, AMENDING CHAPTERS 2.04, 2.12, 2.38, 3.08, 5.16, 5.60 and 5.88 OF THE LAKE ELSINORE MUNICIPAL CODE (LEMC) REGARDING THE DUTIES OF THE CITY MANAGER, DIRECTOR OF FINANCE, CITY CLERK, AND PURCHASING OFFICER 15) Second Reading- of an Amendment to Lake Elsinore Municipal Code Regarding Animals and Animal Control Officers, and an Ordinance Regarding Mandatory Spaying,_ Neutering, and Microchipping Recommendation: Adopt by title only and waive further reading of an ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, AMENDING CHAPTER 6.04 OF THE LAKE ELSINORE MUNICIPAL CODE (LEMC) REGARDING ANIMALS AND ANIMAL CONTROL OFFICERS; and, Adopt by title only and waive further reading of an ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ADOPTING TITLE 6, CHAPTER 6.06 OF THE LAKE ELSINORE MUNICIPAL CODE (LEMC) REGARDING MANDATORY SPAYING, NEUTERING AND MICROCHIPPING 16) Establish One New Ad Hoc Committee Recommendation: Establish one new Ad Hoc Committee: Cannabis; and, appoint Mayor Pro -Tem Tisdale and Council Member Magee to serve on the Ad Hoc Cannabis Committee. Page 4 of 7 17) A Resolution Proclaiming the Existence of a Local Emergency Recommendation: That the City Council finds the need to continue the local emergency consistent with Resolution No. 2019 -002 adopted by the City Council on January 22, 2019 ratifying the Proclamation of Local Emergency and proclaiming the existence of a local emergency. SUCCESSOR AGENCY CONSENT CALENDAR It was moved by Member Magee, seconded by Member Johnson, and unanimously carried to approve the Successor Agency Consent Calendar. 18) Minutes of the Regular Successor Agency Meeting of March 12, 2019 Recommendation: Approve the Minutes. 19) SA Investment Report for February 2019 Recommendation: Receive and file. 20) SA Warrant List Dated March 14, 2019 Recommendation: Receive and file. PUBLIC HEARINGS 21) Public Hearing and Election for Annexation Proceedings for Annexation No. 6 Into Community Facilities District No. 2015 -2 Maintenance Services) for Westlake The Public Hearing was opened at 7:31 p.m. the Deputy City Clerk confirmed proof of publication and that no items of correspondence had been received. There were no members of the public appearing to speak. It was moved by Mayor Manos, seconded by Mayor Pro -Tem Tisdale, and unanimously carried to continue the item to the Regular meeting of May 14'x'. 22) Public Hearing and Election for Annexation Proceedings for Annexation No. 5 Into Community Facilities District No. 2015 -1 (Safety Services) The Public Hearing was opened at 7:33 p.m. There were no members of the public appearing to speak. It was moved by Mayor Manos, seconded by Mayor Pro -Tem Tisdale, and unanimously carried to continue the item to the Regular meeting of May 14 "'. 23) Establishment of Community Facilities District No. 2019 -1 of the City of Lake Elsinore Westlake The Public Hearing was opened at 7.34 p.m. There were no members of the public appearing to speak. Page 5 of 7 It was moved by Mayor Manos, seconded by Mayor Pro -Tem Tisdale, and unanimously carried to continue the item to the Regular meeting of May 10 BUSINESS ITEMS 24) Planning Application No. 2018 -96 Solstice at Summerl - Desi n Review for the Construction of 101 Single- Family Residential Units Community Development Director Taylor provided a presentation. It was moved by Council Member Johnson, seconded by Mayor Pro -Tem Tisdale, and failed to adopt the Resolutions. Recommendation: adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, FINDING THAT PLANNING APPLICATION NO. 2018 -96 (RESIDENTIAL DESIGN REVIEW NO. 2018 -40) IS CONSISTENT WITH THE WESTERN RIVERSIDE COUNTY MULTIPLE SPECIES HABITAT CONSERVATION PLAN (MSHCP); and, adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING PLANNING APPLICATION NO. 2018- 96 (RESIDENTIAL DESIGN REVIEW NO, 2018 -40) PROVIDING BUILDING DESIGNS AND RELATED IMPROVEMENTS FOR 101 SINGLE- FAMILY RESIDENTIAL UNITS LOCATED WITHIN TRACT 31920 -20 OF THE SUMMERLY DEVELOPMENT OF THE EAST LAKE SPECIFIC PLAN (APN: 371- 040 -014) 25) Final Map 31920 -20, KHovnanian Homes, Summerly It was moved by Council Member Magee, seconded by Mayor Manos, and unanimously carried to continue the item. Recommendation: 1. Approve Final Map No. 31920 -20 subject to the City Engineer's acceptance as being true and correct; and, 2. That the City Council authorize the City Clerk to sign the map and arrange for the recordation of Final Map No. 31920 -20. PUBLIC COMMENTS — NON - AGENDIZED ITEMS — 3 MINUTES Appearing to speak were: Paulie Tehrani and Ace Vallejos. CITY MANAGER COMMENTS City Manager Yates had no comments. CITY ATTORNEY COMMENTS Assistant City Attorney Mann had no comments. CITY COUNCIL COMMENTS Council Member Sheridan noted parking issues within the Canyon Hills Community Park; announced a presentation given to Donald Graham Page 6 of 7 Elementary students, and thanked Pamela Gray, Kathleen Harvey, Rita Baydala, Laura Konecni, Kathi Orozco, and Johnathan Skinner; attended Tuscany Hills Landscape and Corporation meeting and noted potential new neighborhood watch signs, the Party in the Park on Main Street on March 23rd, and the Lake Elsinore Storm Sip and Swing on March 24'; provided the Rail Road Canyon Widening Project update; and thanked Captain Lujan for his work with an individual in Canyon Hills. Council Member Johnson attended the Crystal Apple Awards; announced the Community Update Meeting on April 17th, Eggapalooza on April 20th, McVicker Canyon Skate Park expected in April of 2019; and, thanked Public Works Staff and other City Staff. Council Member Magee noted the process to complete ride along form with the Riverside County Sheriffs Department; thanked City Staff for their work with the poppies; announced Fish Stocking on March 29th, the Clean Extreme Event on April 27th, and the Nitro Circus on May 17th. Mayor Pro -Tem Tisdale announced Veterans General Obligation bonds are available, active military banners are available, Teen CERT training is available April 12 -14, the Lake Elsinore Community Run and Walk on April 20th, the 2019 Reality Rally Temecula on May 4th; noted difficulties in comparing different City police services, Temecula contracts with the Riverside County Sheriff's Department, and the new sheriff has pledged to improve statistics. Mayor Manos noted Captain Lujan's successful strategies regarding the poppies, and studying police services; noted new Lake Elsinore Storm Logo, Marshall's grand opening, Classic Car Cruise April 6, May 4, June 1; thanked Pechanga Band of Luiseno Indians for awarding the City a grant of up to $100, 000.00 to assist with Super Bloom costs, and all partnering agencies that assisted with the Super Bloom and City Staff for their efforts; provided the Super Bloom Update: Weekday Plan. ADJOURNMENT The Lake Elsinore City Council will adjourn to the Regular meeting of Tuesday, April 9, 2019, at 7:00 p.m. in the Cultural Center located at 183 N. Main Street, Lake Elsinore.
