Item Nos. 13 and 14 were pulled for discussion. 5) Minutes of the Regular City Council Meeting of April 23 2019 Approve the Minutes. g) CC Warrant List Dated April 25,_2019 Receive and file. 7) Edmondson Construction Co. A reement Authorize the City Manager to execute the Agreement with Edmondson Construction Company for Slope Repair in the amount of $52,800. 00, in such final form as approved by the City Attorney. 8) West Coast Thunder Bike Parade -Road Closures Approve temporary road closures on Monday, May 27, 2019. 9) Purchase of Double -Side Load Recyclingri-rash Containers 1. Waive Lake Elsinore Municipal Code Section 3.08.070F - Exception to bid procedures; and, 2. Approve the purchase of 50 double -side load Recycling/Trash containers for Launch Pointe Recreation Destination & RV Park from Treetop Products in the amount of $51,407.90. 10) Wildland Protection Services A reement 1. Adopt a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING THE CALIFORNIA DEPARTMENT OF FORESTRY AND FIRE AGREEMENT FOR WILDLAND PROTECTION SERVICES FOR FISCAL YEAR 201912020; and, 2. Authorize the City Manager to execute the Agreement, in such final form as approved by City Attorney. 11) Proclamation Terminating Local Emergency Adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, TERMINATING THE STATE OF LOCAL EMERGENCY PROCLAIMED BY THE CITY MANAGER IN HIS CAPACITY AS DISASTER DIRECTOR AND RATIFIED AND PROCLAIMED BY THE CITY COUNCIL BY RESOLUTION NO. 2019 -002 ADOPTED JANUARY 22, 2019 AND CONTINUING THEREAFTER 12) Amendment No. 1 to the Professional Services Agreement with Dost City of Lake Elsinore Page 3 City Council I Successor Agency Meeting Minutes May 14, 2019 13) 14) 15) 16) 17) Engineering Authorize the City Manager to execute Amendment No. 1 for Project Management and Civil Engineering Services in the amount of $78, 000, plus a 10 percent contingency, in final form as approved by the City Attorney. Construction Contract Award to Black Rack ConstructionSB 821 Project No_ 710010 City Engineer Habib provided a presentation. It was moved by Council Member Magee, seconded by Council Member Johnson, and unanimously carried to, 1. Award the Public Works Construction Agreement to Black Rock Construction; and, 2. Authorize the City Manager to execute the Agreement in the amount of $249, 000, in such final form as approved by the City Attorney; and, 3. Authorize the City Manager to execute changer orders not to exceed the 10 percent contingency amount of $24,900; and, 4. Authorize the City Engineer to record the Notice of Completion once it is determined the work is complete and the improvements are accepted into the City maintained roadway network. Amendment No. _7 to Agreement for TUMF Regional Arterial Improvements for the 1- 151Railroad Canyon Road Interchange Project City Engineer Habib provided a presentation. It was moved by Mayor Pro -Tem Tisdale, seconded by Council Member Magee, and unanimously carried to authorize the City manager to execute the Professional Services Agreement in the amount of $201,700.00, plus a 10 percent contingency. I;unsaker and Associates, Inc. Agreement Authorize the City Manager to execute the Professional Services Agreement in the amount of $201,700.00, plus a 10 percent contingency. Construction Contract Award to Corner Keystone Construction Corporation for the Lake Elsinore Neighborhood Center Proiect #220015 1. Award a Construction Agreement to Corner Keystone Construction Corporation for the Remodel Construction Work at the Lake Elsinore Neighborhood Center (CIP PROJECT #Z20015); and, 2. Approve and authorize the City Manager to execute the Agreement in the not to exceed amount of $377,095.06, with Corner Keystone Construction Corporation in the form attached and in such final form as approved by the City Attorney; and, 3. Authorize the City Manager to execute change orders not to exceed a 10 percent contingency amount of $37,710. 00, for construction uncertainties and adjustments; and, 4. Rescind award to (Build Spectrum since bid was non - responsive and it did not include all required Federal forms. UPON A PREVIOUSLY APPROVED CONDOMINIUM MAP WITHIN THE VILLAGE AT LAKESHORE SPECIFIC PLAN 18) Joint Community Facilities District No, 2006 -1 Summed adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING A JOINT COMMUNITY FACILITIES DISTRICT AGREEMENT WITH ELSINORE VALLEY MUNICIPAL WATER DISTRICT AND MCMILLIN SUMMERLY, LLC FOR CITY OF LAKE ELSINORE COMMUNITY FACILITIES DISTRICT NO. 2006 -1 (SUMMERLY) SUCCESSOR AGENCY CONSENT CALENDAR 19) Minutes of the Regular Successor Aclency Meeting of April 23 2019 Approve the Minutes. 20) SA Warrant List Dated April 25 2019 Receive and file. 21) Award Contract with Hemet Fence for Perimeter Fencing and- Repairs at Diamond Stadium Award Contract for installation of perimeter fencing and two automated gates at Diamond Stadium in the amount of $59,900. 00 to Hemet Fence Corp in compliance with LEMC Section 3.12.040. and authorize the Executive Director to execute the Contract in such final form as approved by Agency Counsel. PUBLIC HEARINGS 22) Second Reading of Amendments to Title 5 and Title 17 of the Lake Elsinore Municipal Code Regarding Business Licenses and Regulating_, Sidewalk Vendors The Public Hearing was opened at 7:40 p.m.,Deputy City Clerk Mahan confirmed Proof of Publication and confirmed no items of correspondence were received. Principal Planner MacHott provided a presentation. Appearing to speak was Kim Cousins. Council Member Magee spoke of the enforcement of sidewalk vendors and use of code enforcement. Mayor Manos noted the League of California Cities role in this new law; and, spoke of the impact that sidewalk vendors will have on the health and business of the City. City of Lake Elsinore Page 5 City Council I Successor Agency Meeting Minutes May 14, 2019 It was moved by Council Member Johnson, seconded by Mayor Pro- Tem Tisdale, and unanimously carried to introduce by title only and waive further reading of AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, AMENDING TITLE 5 AND TITLE 17 OF THE LAKE ELSINORE MUNICIPAL CODE REGARDING BUSINESS LICENSES AND REGULATING SIDEWALK VENDORS 23) Public Hearing and Election for Annexation Proceedings for Annexation No. 6 Into Community Facilities District No. 2015 -2 (Maintenance Services) for Westlake The Public Hearing was opened at 7:47 p.m. Deputy City Clerk Mahan confirmed Proof of Publication and confirmed no items of correspondence were received. Assistant City Manager Simpson provided the Staff Recommendation. The Public Hearing was closed at 7:50 p.m. It was moved by Council Member Magee, seconded by Mayor Pro -Tem Tisdale, and unanimously carried to continue the item off calendar. 24) Establishment of Community Facilities District No. 2019 -1 of the Cit roof Lake Elsinore „&estlake) The Public Hearing was opened at 7:51 p.m. Deputy City Clerk Mahan confirmed Proof of Publication and confirmed no items of correspondence were received. Assistant City Manager Simpson provided the Staff Recommendation. The Public Hearing was closed at 7:52 p.m. It was moved by Council Member Magee, seconded by Mayor Pro -Tem Tisdale, and unanimously carried to continue the item off calendar. PUBLIC COMMENTS — NON - AGENDIZED ITEMS — 3 MINUTES There were no members of the public appearing to speak. CITY MANAGER COMMENTS City Manager Yates thanked Office Specialist Saavedra for her presentation and City of Lake Elsinore Page 6 City Council I Successor Agency Meeting Minutes welcomed Management Analyst Ramirez as a new staff member. CITY ATTORNEY COMMENTS City Attorney Leibold had no comments. CITY COUNCIL COMMENTS May 14, 2019 Council Member Sheridan thanked LE Community Services Coordinator Priscilla Perez for inviting him to speak at the Lake Elsinore Senior Center as part of its Coffee with a Council Member program on Wednesday, May 8; he also thanked Lake Elsinore Police Chief Michael Lujan and his constituents for participating in the Vista Del Lago Community Meeting on Saturday, May 11, he noted that about 25 people attended and he also specifically recognized two individuals, Carl Suiter and Laura Drake, who were instrumental in organizing the meeting; he made note that night work had started on the Railroad Canyon Widening project and that it was expected to continue for the rest of this week; he also said that he played in the Cops for Kids Celebrity Golf Tournament on May 3, and the UFCW Locals 1428 & 1167 Leukemia- Lymphoma Charity Golf Tournament on May 7, noting that both tournaments raised money for worthwhile charities, additionally, he thanked Allison Dale for inviting him to golf with her team in the UFCW Tournament, he also made note that Michelle's Place 18th Annual Celebration of Life Golf Tournament is scheduled for August 23; and he wished his Mom, who lives in Casselberry, Florida, his wife and all moms a Happy Mother's Day! Council Member Johnson noted the success of Clean Extreme event; announced the Lake Elsinore Summer Day Camp registration is open and the Park Rubber Resurfacing and Restoration project is underway; and, provided the Homeless Task Force update, and the Public Safety Sub - Committee update. Council Member Magee acknowledged the efforts of the Homeless Taskforce, Code Enforcement, SWAG, Public Works, law enforcement and thanked other partners involved in homeless outreach; announced the Annual Kids Fishing Derby on June 1st, Nitro Circus at Diamond Stadium May 17th, and the Dream Extreme Fishing Derby. Mayor Pro -Tem Tisdale noted the success of Lake Elsinore at the Temecula Reality Rally; announced the Honor a Hero, Hire a Vet job and resource fair on May 15, the third annual wellness fair on may 18th, Memorial Day Service and West Coast Thunder bike Run on May 27th, the Public Safety Advisory Commission is accepting applications; and, noted the City of Lake Elsinore was the recipient of the Community Service Public Agency Award. Mayor Manos attended a Southern California Association of Governments general meeting on May 2nd, a League of California Cities meeting of mayors, and a second League of California Cities meeting in Palm Desert; noted California State legislation that may affect the City; announced the Riverside Transit Agency 25 cent bus rides are June 1st through September 2nd, and, the Lambs Fellowship Car and Bike show May 18; and, Jim Hyatt passed away.
