HomeMy WebLinkAboutCC Reso No 2018-134 Declaring a Shelter CrisisRESOLUTION NO. 2018 -134 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DECLARING A SHELTER CRISIS IN THE CITY PURSUANT TO SB 850 (CHAPTER 48, STATUTES OF 2018 AND GOVERNMENT CODE § 8698.2) Whereas, California's Governor Edmund J. Brown, Jr. and members of the California Legislature have recognized the urgent and immediate need for funding at the local level to combat homelessness; and, Whereas, the Governor and Legislature have provided funding to local governments under the Homeless Emergency Aid Program as part of SB 850 and the 2018 -2019 Budget Act (Chapter 48, Statutes of 2018); and, Whereas, the Governor and Legislature require jurisdictions seeking an allocation through the Homeless Emergency Aid Program to declare a Shelter Crisis pursuant to Government Code §8698.2; and, Whereas, Southwest Riverside County, where the City is located, has seen a 43 percent increase in homeless individuals from 2016 to 2017 (203 in 2016 to 292 in 2017) and accounts for 18.45% of the County's total homeless population; and, Whereas, according to the Riverside County Point in Time Count, at least 75 of these homeless individuals are within the City of Lake Elsinore living without shelter, which is an increase of 21 percent since 2016; and, Whereas, the City of Lake Elsinore finds that the number of homeless in the City is significant, and their persons are without the ability to obtain shelter; and, Whereas, the City of Lake Elsinore created a Homeless Taskforce in May 2017 and has undertaken significant efforts at the local level to combat homelessness in the City; and, Whereas, given the significant number unsheltered homeless persons in the City, the incidents of unauthorized homeless encampments and loitering are increasing across portions of the City within the public right of way, and such conditions expose homeless persons to traffic hazards, crime, risk of death and injury, exposure to weather, lack of adequate sanitation and debris services, and other conditions detrimental to their health and safety; and, Whereas, such conditions negatively impact the physical environment and public facilities of the City, and the use and enjoyment of such facilities for their intended purpose; and, Whereas, Government Code Section 8698.1 provides that, upon a declaration of a shelter crisis, the provision of any state or local regulatory statue, regulation or resolution prescribing standards of housing, health or safety, as applied to public facilities, shall be suspended to the extent that strict compliance would in any way prevent, hinder, or delay the mitigation of the effects of the shelter crisis; and Whereas, there is a current lack of funding and shelter options available to the City of Lake Elsinore to provide appropriate and necessary aid to those people who are currently homeless; and, CC Reso No. 2018 -134 Page 2 of 3 Whereas, the City of Lake Elsinore affirms its commitment to combatting homelessness and augmenting existing shelter and service options for those living without shelter in our community; and, Whereas, the City Council of the City of Lake Elsinore desires to take immediate action to resolve the high incidents of homelessness and unsheltered individuals residing within the City, and as such seeks to apply for critical funding from the Homeless Emergency Aid Program to address the needs of its homeless population including street outreach, housing options, and social service support. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That a shelter crisis pursuant to Government Code §8698.2 exists in the City of Lake Elsinore and authorizes the City's participation in the Homeless Emergency Aid Program. Section 2. This Resolution shall take effect immediately upon its adoption. Section 3. The City Clerk shall certify to the adoption of this Resolution and enter it into the book of original Resolutions.
