HomeMy WebLinkAboutCC Reso No 2019-032 Terminate State of Local EmergencyRESOLUTION NO. 2019 -032 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, TERMINATING THE STATE OF LOCAL EMERGENCY PROCLAIMED BY THE CITY MANAGER IN HIS CAPACITY AS DISASTER DIRECTOR AND RATIFIED AND PROCLAIMED BY THE CITY COUNCIL BY RESOLUTION NO. 2019 -002 ADOPTED JANUARY 22, 2019 AND CONTINUING THEREAFTER WHEREAS, Lake Elsinore Municipal Code 2.20.080.6. empowers the Disaster Director to proclaim the existence of a Local Emergency when the City Council is not in session; and, WHEREAS, the Disaster Director of the City of Lake Elsinore issued a Proclamation of Local Emergency on December 6, 2018 and subsequently renewed that Proclamation on December 20 and 27, 2018 and on January 3, 10 and 17, 2019 based on the following findings: 1) That at the time of the Proclamation(s) the City Council was not in session; and, 2) that conditions of extreme peril to the safety of persons and property have arisen within the City of Lake Elsinore caused by the December Holy Flood incident which prompted evacuations of residents in Lake Elsinore, affecting approximately 1000 homes in the communities of Rice Canyon, McVicker and Machado; and, 3) this storm system caused severe weather, including damaging winds and heavy rains resulting in significant damage to public and private property, including approximately 17 structures damaged on December 6, 2018; and, 4) winter storm systems continue to threaten additional runoff from the scorched surrounding canyons into Lake Elsinore which cause increased toxins altering the water chemistry of the Lake and resulting in fish die -offs on a scale not seen before which together pose a threat to public health and safety; and, 5) McVicker Canyon, Rice Canyon, Leach Canyon and Dickey Canyon will continue to drain mud and debris during every rain storm, threatening public safety of the citizens of Lake Elsinore, along with the lake's ecosystem, indicating that assistance is necessary to support the response, recovery and remediation efforts: and, 6) the aforesaid conditions of extreme peril are beyond the control of the services, personnel, equipment and facilities of the City of Lake Elsinore's lake management and water quality resources and the County of Riverside that provides fire protection, fire prevention, rescue, and medical emergency services to the City pursuant to a Cooperative Agreement; and, 7) the aforesaid conditions of extreme peril warrant and necessitate the Proclamation of a Local Emergency; and WHEREAS, on January 22, 2019 the City Council found that the aforesaid conditions of extreme peril continued to pose a threat to public health and safety beyond the control of the services, personnel, equipment and facilities of the City of Lake Elsinore and the County of Riverside that provides fire protection, fire prevention, rescue, and medical emergency services to the City pursuant to a Cooperative Agreement and, by Resolution No. 2019 -002, ratified the findings CC Reso No. 2019 -032 Page 2 of 2 contained in the Proclamation of Local Emergency issued January 17, 2019 and proclaimed the continued existence of Local Emergency and thereafter found the need to continue the local emergency consistent with Resolution No. 2019 -002. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS Section 1. The City Council finds that the aforesaid conditions of extreme peril no longer pose a threat to public health and safety beyond the control of the services, personnel, equipment and facilities of the City of Lake Elsinore and the County of Riverside that provides fire protection, fire prevention, rescue, and medical emergency services to the City pursuant to a Cooperative Agreement. Section 2. The Proclamation of Local Emergency original declared on December 6, 2018 and continuing thereafter is terminated. Section 4. This Resolution shall take effect immediately upon its adoption. Section 5. The City Clerk shall certify to the adoption of this Resolution and enter it into the book of original Resolutions.
