Two years ago the City Council conducted a similar workshop to determine its Vision Statement, which is to become "the ultimate lake destination where all can live, work, and play, build futures and fulfill dreams." At this time, the City Council also identified seven key initiatives: public safety, recreation, transportation, economic development, image, education, and service. These initiatives were chosen to ensure that staff's efforts and programs are consistent with this vision. During the session, the City Council will review key projects and steps that have been completed in regards to these initiatives and explore long- and short-term strategic priorities associated with each. Public comments will be allowed at the beginning and end of the workshop and the community has been encouraged to join us to share their ideas. Backaround Municipalities implement conditions of approval on discretionary projects to provide consistency with their General Plans, Specific Plans, Zoning Codes, Municipal Codes, Subdivision Map Act and CEQA documents. Staff has been striving to provide improved standard conditions of approval consistent with industry standards and model cities to present to the City Council. Attached for your consideration and comments are draft standard conditions for new residential projects and new commercial / industrial projects. Conditions of approval imposed on new development must be reasonably related to the development's impacts. Consequently, each discretionary project will have customized conditions of approval based upon the type of permit, the unique project setting, project characteristics and project impacts. The attached lists of draft conditions of approval are intended as standard boiler plate conditions generally applicable to all like projects. The General Plan is the State mandated land use road map to guide development in the City for the next 20 to 30 years. The attached General Plan document adopted by the City Council in December 2011 identifies goals and policies set forth in the seven mandatory elements as well as optional elements. Goals and policies in bold specifically identify the conditions of approval and/or mitigation measures that shall be imposed on development projects. Draft Standard Conditions of Approval City Council April 24, 2015 Page 2 of 3 The Lake Elsinore Municipal Code (LEMC) is the tool that implements the City's General Plan and has multiple chapters setting forth regulations that are included in development entitlements as conditions of approval to include but not limited to: .Title 17, Zoning .Chapter 17.184, Design Review *Chapter 17.168, Conditional Use Permits *Chapter 17.172, Variances •Chapter 14.08, Stormwater / Urban Runoff Management -Title 16, Subdivisions .Chapter 16.34.010, Required Improvements *Chapter 16.44.010, Street Improvements .Chapter 16.74, Development Impact Fees *Chapter 16.83, TUMF -Subdivision Map Act •SMP 66473.5, Consistency with General Plan or Specific Plan Discussion The City's standard conditions of approval currently being implemented should be updated to reflect existing laws and regulations, avoid inconsistencies, eliminate redundant or duplicative conditions, and replace ambiguous language with clearly written conditions of approval. Like General Plans and zoning codes, conditions of approval should be living documents subject to regular periodic reviews to ensure quality, fairness, keeping up with state mandates, technology, economic trends and policies set forth by the City Council. Conditions of approval are set forth for each discretionary project by all departments and divisions within the City. City departments/divisions include: *Planning *Building and Safety *Fire .Public Works -Engineering .Community Services *Administrative Services Draft Standard Conditions of Approval City Council April 24, 2015 Page 3 of 3 In addition to conditions prepared by City Departments, conditions of approval are included in Mitigation, Monitoring and Reporting Programs from CEQA documentation. Native American Tribes also request conditions of approval through the SB 18 process. Conditions of approval are also requested by utility companies, as well as regional, state and federal agencies. Due to the ever increasing and stringent regulations set forth by State and Federal regulatory agencies, Public Works/Engineering conditions of approval are the most numerous and complicated. Staff reviewed and evaluated conditions of approval from recently approved projects in the City of Lake Elsinore and also researched standard conditions of approval from what we consider modern and progressive cities in the area including: *Temecula .Murrieta -Rancho Cucamonga *Carlsbad Some conditions of approval from the above -identified four cities have been included in the attachments. Many of the standard conditions of approval imposed by the City of Lake Elsinore are also utilized by the four cities but often the language varies. Standard conditions of approval provide certainty and fairness to the development community, and ensure that the City will be maintained and grows in a positive and aesthetically pleasing manner consistent with applicable laws and regulations while still implementing City Council policy direction. Fiscal Impact The only fiscal impact associated with this staff report was staff time to review, research, prepare and draft this document. Providing appropriate conditions of approval serves to protect the City, ensure developers pay their fair share, and that no financial burden is placed on the City with unnecessary or unforeseen operations and/or maintenance obligations. General Plan Goals and Policies CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL GENERAL The proposed project (Entitlement Case Numbers) consists of the development of (Project Description and Amenities) located at (Address or Cross Streets) (APN). 2. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold harmless the City, its Officials, Officers, Employees, and Agents from any claim, action, or proceeding against the City, its Officials, Officers, Employees or Agents to attack, set aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or legislative body concerning the Vesting Tentative Tract No. 36557. 3. Within 30 days of project approval, the applicant shall sign and complete an "Acknowledgment of Conditions" and shall return the executed original to the Community Development Department for inclusion in the case records. 4. The applicant shall submit a check in the amount of $ made payable to the County of Riverside for the filing of a Notice of Determination. The check shall be submitted to the Planning Division for processing within 48 hours of the project's approval. PLANNING DIVISION 5. Project Entitlement (Example: Tentative Tract Map No. ) will expire two years from date of approval unless within that period of time a Final Map has been filed with the County Recorder, or an extension of time is granted by the City of Lake Elsinore City Council in accordance with the State of California Subdivision Map Act and applicable requirements of the Lake Elsinore Municipal Code. 6. Project Entitlement (Example: Tentative Tract Map No. ) shall comply with the State of California Subdivision Map Act and applicable requirements set forth in the Lake Elsinore Municipal Code (LEMC), unless modified by approved Conditions of Approval. 7. The applicant shall provide all project -related on-site and off-site improvements as required by these Conditions of Approval. 8. All future development proposals shall be reviewed by the City on a project by project basis. If determined necessary by the Community Development Director or designee, additional environmental analysis will be required. Any proposed minor revisions to approved plans shall be reviewed and approved by the Community Development Director or designee. Any proposed substantial revisions to the approved plans shall be reviewed according to the provisions of the Municipal Code in a similar manner as a new application. 10. Six-foot decorative block walls shall be constructed along the project perimeter. If a double wall condition would result, the developer shall make a good faith effort work with the adjoining property owners to provide a single wall. Developer shall notify, by mail, all contiguous property owners at least 30 days prior to the removal of any existing walls/fences along the project perimeter. 11. For multiple -family development, laundry facilities shall be provided as required by the LEMC. 12. For multiple -family development, provide exterior lockable storage space as required by the California Green Building Code. 13. If any of the conditions of approval set forth herein fail to occur, or if they are, by their terms, to be implemented and maintained over time, if any of such conditions fail to be so implemented and maintained according to their terms, the City shall have the right to revoke or modify all approvals herein granted, deny or further condition issuance of all future building permits, deny revoke, or further condition all certificates of occupancy issued under the authority of approvals herein granted; record a notice of violation on the property title; institute and prosecute litigation to compel their compliance with said conditions or seek damages for their violation. Prior to Recordation of Final Tract Map(s) 14. All lots shall comply with minimum standards set forth in the LEMC or a Specific Plan. 15. A precise survey with closures for boundaries and all lots shall be provided per the LEMC. 16. Street names within the subdivision shall be reviewed and approved by the Community Development Director or designee. 17. All of the improvements shall be designed by the applicant's Civil Engineer to the specifications of the City of Lake Elsinore. Prior to Design Review Approval Residential Subdivision Projects Page 2 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL 18. All future structural development associated with this map requires separate Design Review approval pursuant to the provisions of LEMC Chapter 17.184. 19. The following architectural details shall be provided: All front fence returns shall be decorative masonry walls. Wood fences will not be allowed along the front elevation. Wood, vinyl or steel (wrought iron or aluminum) gates are allowed in order to allow access to rear yards. • The applicant shall provide four-sided articulation. Architectural enhancements and treatments shall be provided on all residential elevations (front, rear and side) visible from streets and other public views. • All fireplaces shall be natural gas fireplaces only. No wood burning fireplaces shall be allowed. Prior to Issuance of Grading Permits/Building Permits 20. Prior to the issuance of a grading permit, the project applicant shall obtain all necessary State and Federal permits, approvals, or other entitlements, including obtaining the necessary authorizations from the regulatory agencies for proposed impacts to jurisdictional waters. Authorizations may include a Section 404 Permit from the U.S. Army Corps of Engineers, a Section 1602 Streambed Alteration Agreement from the California Department of Fish and Wildlife, and a Section 401 Water Quality Certification/Waste Discharge Requirement from the Regional Water Quality Control Board. 21. Prior to issuance of building permit, the applicant shall prepare a Final Wall and Fence Plan addressing the following: • Show that a masonry or decorative block wall will be constructed along the entire tract boundary. • Show materials, colors, and heights of rear, side and front walls/fences for proposed lots. • Show the location of all wood, vinyl or steel (wrought iron or aluminum) gates placed within the front return walls. Residential Subdivision Projects Page 3 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL Show that side walls for corner lots shall be decorative masonry block walls. Show that those materials provided along the front elevations (i.e. brick, stone, etc.) will wrap around the side elevation and be flush with the front return walls. 22. Signs are not part of this project approval. All signage shall be subject to Planning Division review and approval prior to installation. 23. Prior to recordation of a Final Map, the applicant shall initiate and complete the formation of a Homeowner's Association (HOA) which shall be approved by the City. All Association documents shall be submitted for review and approval by City Planning, Engineering and the City Attorney and upon City approval shall be recorded. Such documents shall include the Articles of Incorporation for the Association and Covenants, Conditions and Restrictions (CC&Rs). a. At a minimum, all recreation and park areas (except public parks), all natural slopes and open space, all graded slopes abutting public street rights-of-way which are not part of residential lots, up slopes from public rights-of-way within private lots and all private streets, and all drainage basins shall be maintained by the Homeowner's Association (HOA). 24. Provisions of the City's Noise Ordinance (LEMC Chapter 17.176) shall be satisfied during all site preparation and construction activity. Site preparation activity and construction shall not commence before 7:00 AM and shall cease no later than 5:00 PM, Monday through Friday. Only finish work and similar interior construction may be conducted on Saturdays and may commence no earlier than 8:00 am and shall cease no later than 4:00 p.m. Construction activity shall not take place on Sunday, or any Legal Holidays. The sign shall identify the name and phone number of the development manager to address any complaints. 25. Prior to issuance of building permit, building plans for the Model Home Complex shall comply with all American Disabilities Act (ADA) requirements, including provision of a handicapped -accessible bathroom. 26. Construction phasing shall be implemented in accordance with the approved Phasing Plan which avoids construction traffic from entering occupied neighborhoods within the tract. Residential Subdivision Projects Page 4 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL 27. A cash bond shall be required for the Model Home Complex. This bond is to guarantee removal of the temporary fencing material, parking lot, etc. that have been placed onsite for the Model Home Complex. The bond will be released after removal of the materials and the site is adequately restored, subject to the approval of the Community Development Director or designee. 28. A cash bond shall be required for any garage conversion of the model(s). Bonds will be released after removal of all temporary materials and the site is adequately restored, subject to the approval of the Community Development Director or designee. 29. A cash bond shall be required for any construction trailers used during construction. Bonds will be released after removal of trailers, subject to the approval of the Community Development Director or designee. 30. The applicant shall pay school fees to the Lake Elsinore Unified School District prior to issuance of each building permit. (Amended by Staff prior to January 6, 2015 Planning Commission hearing.) 31. The project shall connect to water and sewer and meet all requirements of the Elsinore Valley Municipal Water District (EVMWD). The applicant shall submit water and sewer plans to the EVMWD and shall incorporate all district conditions and standards. 32. All mechanical and electrical equipment associated with the residences shall be ground mounted. All outdoor ground or wall mounted utility equipment shall be consolidated in a central location and architecturally screened behind fence returns, subject to the approval of the Community Development Director, prior to issuance of building permit. 33. All front yards and side yards on corner lots shall be properly landscaped with automatic (manual or electric) irrigation systems to provide 100 percent plant coverage using a combination of drip and conventional irrigation methods. Construction Landscape & Irrigation drawings shall be prepared, reviewed by the City's Landscape Architect Consultant and approved by the Community Development Director or designee. A Cost Estimate for materials and labor shall also be submitted for review and approval. A Landscape Plan Check fee will be charged prior to final landscape approval based on the Consultant's fee, inspection, permits and administration fees. • The applicant shall replace any street trees harmed during construction, in conformance with the City's Street Tree List, at a maximum of 30 feet apart and at least 24 -inch box in size. Residential Subdivision Projects Page 5 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL • Perimeter walls shall be protected by shrubs and other plantings that discourage graffiti. • The applicant shall ensure a clear line of sight at ingress/egress points by providing plantings within 15 feet of ingress/egress points whose height does not exceed three feet and whose canopy does not fall below six feet. • The landscape plan shall provide for California native drought -tolerant ground cover, shrubs, and trees. Special attention shall be given to use of Xeriscape or drought resistant plantings with combination drip irrigation system to prevent excessive watering. • No front -yard grass turf landscaping will be installed. • All landscape improvements shall be bonded with a ten percent (10%) Faithful Performance Bond of the approved estimated labor and materials cost for all planting. The bond shall remain in effect for one year from Certificate of Occupancy. • All landscaping and irrigation shall be installed within an affected portion of any phase at the time a certificate of occupancy is requested for any building. • All Model Homes shall be Xeriscaped and signage provided identifying Xeriscape landscaping. Xeriscape is a method of landscape design that minimizes water use by: 1) Implementing hydrozones; 2) Minimizes high water -use plant material as identified by Water Use Classifications of Landscape Species (WUCOLS2 (such as turf) and incorporates water -efficient ("drought -tolerant' / climate -appropriate) plants; 3) Requires an efficient irrigation system that includes: a. ET -Based ("Smart irrigation") controller(s) with weather -sensing, automatic shut-off and seasonal adjustment capabilities; b. Efficient irrigation water application through use of: Residential Subdivision Projects Page 6 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL i. Low-volume point -source irrigation (such as drip irrigation and bubblers) for all shrub planter areas (maximum of 3:1 slope) with a minimum irrigation efficiency of 0.90 ; and/or ii. Spray or rotor -type nozzles for areas a minimum of eight (8) feet wide, for slopes 3:1 and greater, AND with a minimum irrigation efficiency of 0.71. 4) Improvement of soil structure for better water retention; and 5) Application of mulch to hinder evaporation. • The Final landscape plan shall be consistent with any approved site and/or plot plan. • The Final landscape plan shall include planting and irrigation details. • All exposed slopes in excess of three feet in height within the subject tract and within private lots shall have a permanent irrigation system and erosion control vegetation installed, as approved by the Planning Division, prior to issuance of certificate of occupancy. • All landscaping and irrigation shall comply with the water -efficient landscaping requirements set forth in LEMC Chapter 19.08 (Water Efficient Landscape Requirements), as adopted and any amendments thereto. • A minimum of one (1) model home within each phase of project development shall be landscaped without any grass turf. Front yard landscaping without the use of grass turf shall be offered as an available landscaping option to the initial purchaser(s) of each house. 34. The applicant shall place a weatherproof 3' x 3' sign at the entrance to the project site identifying the approved days and hours of construction activity and a statement that complaints regarding the operation can be lodged with the development manager. The sign shall be installed prior to the issuance of a grading permit. PUBLIC WORKS DEPARTMENT/ ENGINEERING DIVISION General Residential Subdivision Projects Page 7 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL 35. All utilities except electrical over 35 KV shall be placed underground, as approved by the serving utility. All arrangements for relocation of utility company facilities (power poles, vaults; etc.) out of the roadway or alley shall be the responsibility of the property owner or his agent. 36. The applicant shall install permanent bench marks to Riverside County Standards and at a location to be determined by City Engineer. 37. All slopes and landscaping within public right of way shall be maintained by the property owner or property owner's association or another maintenance entity approved by the City Council. 38. All open space and slopes except for public parks and schools and flood control district facilities, outside the public right of way will be owned and maintained by either a home owner's association or private property owner. 39. Any portion of a drainage system that conveys runoff from open space shall be installed within a dedicated drainage easement. 40. Developer shall mitigate to prevent any flooding and/or erosion downstream caused by development of the site and/or diversion of drainage. 41. Any grading that affects "waters of the United States", wetlands or jurisdictional streambeds, shall require approval and necessary permits from respective Federal and/or State Agencies. 42. In accordance with the City's Franchise Agreement for waste disposal and recycling, the developer shall be required to contract with CR&R Inc. for removal and disposal of all waste material, debris, vegetation, and other rubbish generated during cleaning, demolition, clear and grubbing or all other phases of construction. 43. An encroachment permit shall be obtained prior to any work on City, County, and/or State right of way. 44. All required soils, geology, hydrology and hydraulic, and seismic reports shall be prepared by a Registered Civil Engineer. Fees 45. Applicant shall pay all applicable permit application and Engineering assessed fees, Residential Subdivision Projects Page 8 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL including without limitation plan -check and construction inspection fees, at the prevalent rate at time of payment in full. 46. Applicant shall pay all applicable Mitigation and Uevelopment Impact Fees at the prevalent rate at time of payment in full. Mitigation and Development Impact Fees include without limitation, Library Mitigation Fees, Park Capital Improvement Fees, Storm Drain Improvement and Drainage District Fees, TIF, TUMF, City Hall and Public Works Facilities Fees, Community Center Facilities Fees, Lakeside Facilities Fees, Animal Shelter Facilities Fees, Fire Facilities Fees, MSHCP, Stephen's Kangaroo Rat Habitat, Railroad Canyon Benefit District will be assessed. Grading 47. A grading plan signed and stamped by a California Registered Civil Engineer shall be required. 48. Prior to commencement of grading operations, developer is to provide to the City a map of all proposed haul routes to be used for movement of export material. All such routes shall be subject to the review and approval of the City Engineer. Haul route shall be submitted prior to issuance of a grading permit. Hauling in excess of 5,000 CY shall be approved by City Council. (LEMC 15.72.065) 49. All export material shall be discharged into a legal disposal site. No permittee shall process, including, but not limited to, crush, sift, or segregate, excavated earth materials on site for export and commercial sale without first obtaining a permit pursuant to Chapter 14.04 LEMC regarding surface mining and reclamation. (LEMC 15.72.065). 50. All grading shall be done under the supervision of a geotechnical engineer and shall certify all slopes steeper than 2 to 1 for stability and proper erosion control. All manufactured slopes greater than 30 feet in height shall be contoured. 51. All drainage facilities in this tract shall be constructed to Riverside County Flood Control District Standards. Adequate and safe access for maintenance of detention/water quality basins shall be provided. 52. All storm drain plans connecting to Riverside County Flood Control facilities will be approved by RCFC, and an encroachment permit from RCFCD will be required. 53. All compaction reports, grade certifications, monument certifications (with tie notes Residential Subdivision Projects Page 9 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL delineated on 8 '% x 11" Mylar) shall be submitted to the Engineering Division before final inspection of public works improvements will be scheduled and approved. 54. A precise survey with closures for boundaries and all lots shall be provided per the LEMC. 55. In accordance with the City's Franchise Agreement for waste disposal & recycling, the applicant shall be required to contract with CR&R Inc. for removal and disposal of all waste material, debris, vegetation and other rubbish generated during cleaning, demolition, clear and grubbing or all other phases of construction. 56. Drainage from the project site shall be released from the project site in a safe manner as approved by the City Engineer including but not limited to release to natural channels, public facilities and/or drainage easements existing on adjacent properties or new letters of drainage acceptance. 57. All natural (historic, pre -development) drainage traversing the site shall be conveyed through the site, or, shall be collected and conveyed to a safe and appropriate discharge point by a method approved by the City Engineer. 58. Applicant shall obtain all necessary off-site easements for any off-site grading, if needed, from the adjacent property owners prior to final map approval. Stormwater Management / Pollutant Prevention / NPDES 59. The project is responsible for complying with the Santa Ana Region NPDES Permits as warranted based on the nature of development and/or activity. These Permits include: a. General Permit -Construction b. MS4 60. The 2010 SAR MS4 Permit requires implementation of LID Principles and LID Site Design, where feasible, to treat the pollutants of concern identified for the project, in the following manner (from highest to lowest priority) : (Section XII.E.2, XII.E.3,and XII.E.7) 61. Preventative measures (these are mostly non-structural measures, e.g., preservation of natural features to a level consistent with the MEP standard; minimization of Urban Runoff through clustering, reducing impervious areas, etc.) shall be implemented. 62. The Project shall 'Infiltrate, harvest and use, evapotranspire and/or bio -treat the Design Capture Volume (DCV). Residential Subdivision Projects Page 10 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL 63. The Project shall consider a properly engineered and maintained bio -treatment system only if infiltration, harvesting and use and evapotranspiration cannot be feasibly Implemented at the project site. 64. Any portion of the DCV that is not infiltrated, harvested and used, evapotranspired, and/or biotreated shall be treated and discharged in accordance with the requirements set forth in Section XII.G. 65. The project shall implement LID practices that treat the 85th percentile storm. 66. Project hardscape areas shall be designed and constructed to provide for drainage into adjacent landscape. 67. Hydromodification / Hydraulic Conditions of Concern — The project shall identify potential Hydraulic Conditions of Concern (HCOC) and implement measures to limit disturbance of natural water bodies and drainage systems, conserve natural areas; protect slopes, channels and minimize significant impacts from urban runoff. 68. CEQA — If CEQA identifies resources requiring Clean Water Act Section 401 Permitting, the applicant shall obtain certification through the Santa Ana Regional Water Quality Control Board and provide a copy to the Engineering Division. Construction 69. Both a Storm Water Pollution Prevention Plan (SWPPP) and a Water Quality Management Plan (WQMP) for post construction are required for this project. 70. SWPPP - A copy of the current SWPPP shall be kept at the project site, updated as necessary and be available for review upon request. Projects that are not subject to coverage under the General Permit — Construction will prepare and implement an Erosion and Sediment Control Plan in compliance with the California Building Code and Local Ordinances. 71. Prior to grading or building permit the applicant shall demonstrate that compliance with the permit has been obtained by providing a copy of the Notice of Intent (NOI) submitted to the State Water Resources Control Board and a copy of the letter of notification of the issuance of a Waste Discharge Identification (WDID) Number or other proof of filing to the satisfaction of the City Engineer. Residential Subdivision Projects Page 11 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL 72. Erosion & Sediment Control - Prior to the issuance of any grading or building permit, the applicant shall submit for review and approval by the City Engineer, an Erosion and Sediment Control Plan as a separate sheet of the grading plan submittal to demonstrate compliance with the City's NPDES Program and state water quality regulations for grading and construction activities. The Erosion and Sediment Control Plan shall identify how all construction materials, wastes, grading or demolition debris, and stockpiles of soil, aggregates, soil amendments, etc, shall be property covered, stored and secured to prevent transport into local drainages or waters by wind, rain, tracking, or dispersion. The plan shall also describe how the project will ensure that all BMPs will be maintained during construction of any future right of ways. A copy of the plan shall be incorporated into the SWPPP as applicable, kept updated as needed to address changing circumstances of the project site, be kept at the project site and available for review upon request. Post Construction 73. A preliminary WQMP shall be submitted during the project entitlement stage. The level of detail in a preliminary Project -Specific WQMP will depend upon the level of detail known about the overall project design at the time project approval is sought. At a minimum, the preliminary Project -Specific WQMP shall identify the type, size, location, and final ownership of Stormwater BMPs adequate to serve new roadways and any common areas, and to also manage runoff from an expected reasonable estimate of the square footage of future roofs, driveways, and other impervious surfaces on each individual lot. 74. The applicant shall use the Water Quality Management Plan for the Santa Ana Region of Riverside County guidance document and template for preparation of both the preliminary and final WQMP. 75. The project shall complete and submit for review and approval to the Engineering Division a final WQMP, incorporating the LID Principles and Stormwater BMPs committed to in the preliminary Project -Specific WQMP. The final WQMP shall be approved prior to issuance of any grading or building permit. 76. Operation and Maintenance (O&M) Plan and Agreement that (1) describes the long- term operation and maintenance requirements for BMPs identified in the BMP Exhibit; (2) identifies the entity that will be responsible for long-term operation and maintenance of the referenced BMPs; and (3) describes the mechanism for funding the long-term operation and maintenance of the referenced BMPs. The City format shall be used. Residential Subdivision Projects Page 12 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL 77. All storm drain inlet facilities shall be appropriately marked "Only Rain in the Storm Drain" using the City authorized marker to prevent illegal dumping in the drain system. 78. Prlor to the issuance of a certificate of use and/or occupancy, the applicant shall demonstrate compliance with applicable NPDES permits for construction, industrial/commercial, MS4, etc. to include: 1. Demonstrate that all structural Best Management Practices (BMP's) described in the BMP Exhibit from the project's approved WQMP have been implemented, constructed and installed in conformance with approved plans and specifications. 2. Demonstrate that the project has complied with all non-structural BMPs described in the project's WQMP. 3. Provide signed, notarized certification from the engineer of work that the structural BMP's identified in the project's WQMP are installed and operational. 4. Submit a copy of the fully executed, recorded Operations and Maintenance (O&M) Plan for all structural BMPs. 5. Demonstrate that copies of the project's approved WQMP (with recorded O&M Plan attached) are available for each of the initial occupants (commercial/industrial) or HOA as appropriate. 6. Agree to pay for a Special Investigation from the City of Lake Elsinore for a date twelve (12) months after the issuance of a Certificate of Use and/or Occupancy for the project to verify compliance with the approved WQMP and O&M Plan. A signed/sealed certification from the engineer of work dated 12 months after C of O will be considered in lieu of a Special Investigation by the City. 7. Provide a recorded copy of one of the following: a. CC&R's (they must include the approved WQMP and O&M Plan) for the project's Home Owners Association. b. A water quality implementation agreement has the approved WQMP and O&M Plan attached; or C. The final approved Water Quality Management Plan and Operations and Maintenance Plan. Final Tract or Parcel Map 79. The developer shall submit for plan check review and approval a final map. 80. Phasing plan, if any, shall be approved by the City Engineer prior to issuance of any permits. 81. Prior to City Council approval of the final Tract Map the developer shall, in accordance with the Government Code, have constructed all improvements or have improvement Residential Subdivision Projects Page 13 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL plans submitted and approved, agreements executed and securities posted. 82. Street abandonment shall be processed and approved as part of the final map. 83. Make an offer of dedication for all public streets and easements required by these conditions or shown on the Tentative Map. All land so offered shall be granted to the City, free and clear of all liens and encumbrances and without cost to the city. 84. Applicant shall record C C & R's for funding, operation and maintenance of slopes and drainage facilities within the project. The C C & R's shall be approved by the Planning Director and City Engineer prior to recordation of final map. 85. The Final Tract Map or Parcel Map shall include the phasing boundaries consistent with the parcels of the Tentative Tract or Parcel Map. The phasing boundaries or parcels shall be processed as separate tract maps. 86. Underground water rights shall be dedicated to the City pursuant to: the provisions of Section 16.52.030 (LEMC), and consistent with the City's agreement with the Elsinore Valley Municipal Water District. Prior to Issuance of a Grading Permit 87. Submit grading plans with appropriate security, Hydrology and Hydraulic Reports prepared by a Registered Civil Engineer for approval by the City Engineer. Developer shall mitigate any flooding and/or erosion downstream caused by development of the site and/or diversion of drainage. 88. Provide soils, geology and seismic report including street design recommendations. Provide final soils report showing compliance with recommendations. 89. A seismic study shall be performed on the site to identify any hidden earthquake faults, liquefaction and/or subsidence zones present on-site. A certified letter from a registered geologist or geotechnical engineer shall be submitted confirming the absence of this hazard. 90. The applicant shall obtain all necessary off-site easements for off-site grading and/or drainage acceptance, if needed, from the adjacent property owners prior to grading permit issuance. 91. The developer shall apply for, obtain and submit to the City Engineering Division a letter Residential Subdivision Projects Page 14 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL from Southern California Edison (SCE) indicating that the construction activity will not interfere with existing SCE facilities (aka SCE NIL). 92. Developer shall execute and submit grading and erosion control agreement, post grading security and pay permit fees as a condition of grading permit issuance. 93. A preconstruction meeting with the City Public Works Inspector (Engineering Division) is required prior to commencement of ANY grading activity. 94. A traffic improvement plan which includes the timing of phased improvements shall be submitted to the City Engineer for review and approval prior to issuance of any grading permits for the project. Secondary access shall be provided for each phase. Prior to Issuance of Building Permit: 95. All Public Works requirements shall be complied with as a condition of development as specified in the Lake Elsinore Municipal Code (LEMC) prior to building permit. 96. Submit a "Will Serve" letter to the City Engineering Division from the applicable water agency stating that water and sewer arrangements have been made for this project and specify the technical data for the water service at the location, such as water pressure and volume etc. Submit this letter prior to applying for a building permit. 97. Pay all Capital Improvement Mitigation fees (LEMC 16.34). 98. The Final Tract Map shall be recorded. Prior to Occupancy 99. All compaction reports, grade certifications, monument certifications (with tie notes delineated on 8 1/2" x 11" Mylar) shall be submitted to the Engineering Division before final inspection of off-site improvements will be scheduled and approved. 100. All traffic signing and striping shall be completed in accordance with the approved plans to the satisfaction of the City Traffic Engineer. 101. All required public right-of-way dedications, easements, dedications and vacations and easement agreement(s) for ingress and egress through adjacent property(ies) shall be recorded with a recorded copy provided to the City prior to final project approval. Residential Subdivision Projects Page 15 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL 102. In the event of damage to City roads from hauling or other construction related activity, applicant shall pay full cost of restoring public roads to the baseline condition. 103. As -built plans for all in -field revisions to -approved plan sets shall be submitted for review and approval by the City. The developer/developer/owner is responsible for revising the original mylar plans. 104. All final studies and reports, grade certifications, monument certifications (with tie notes delineated on 8 '/z x 11" mylar) shall be submitted in .tif format on a CD/DVD. Studies and reports include, Soils, Seismic, Hydrology, Hydraulics, Grading, SWPPP, WQMP, etc. 105. All plan sets and recorded maps shall be digitized and provided on CD/DVD as follows: a. Final Map(s) - GIS Shape files* and .tif of recorded map. b. Improvement Plans — GIS Shape files* and .tif of approved as built mylar. C. Grading Plans - .tif of approved as built mylar. *GIS Shape files must be in projected Coordinate System: NAD 83 State Plane California Zone VI U.S. Fleet. COMMUNITY SERVICES DEPARTMENT 106. Identify all park development and maintenance specifics (case by case). 107. Quimby Requirements — Prior to the issuance of building permits, the developer shall satisfy the City's parkland dedication (Quimby) requirement through the payment of in - lieu fees equivalent to _acres of parkland, based upon the City's then current land evaluation. Sad requirement includes a credit for private recreational opportunities provided. 108. Prior to the issuance of building permits the developer shall pay park development impact fees (DIF) at the rates in effect at the time of payment. CITY OF LAKE ELSINORE FIRE MARSHALL General Conditions 109. Lake Elsinore Fire Protection Planning Office Responsibility - It is the responsibility of the recipient of these Fire Department conditions to forward them to all interested parties. The permit number (as it is noted above) is required on all correspondence. Questions should be directed to the Riverside County Fire Department, Lake Elsinore Residential Subdivision Projects Page 16 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL Fire Protection Planning Division at 130 S. Main St., Lake Elsinore, CA 92530. Phone: (951) 671-3124 Ext. 225. The following fire department conditions shall be implemented in accordance with the Lake Elsinore Municipal Code and the adopted codes at the time of project building plan submittal, these conditions are in addition to the adopted code requirements. 110. Blue Dot Reflectors - Blue retro -reflective pavement markers shall be mounted on private streets, public streets and driveways to indicate location of fire hydrants. Prior to installation, placement of markers must be approved by the Riverside County Fire Dept. 111. Minimum Hydrant Fire Flow - Minimum required fire flow shall be GPM for _ hours duration at _ PSI residual operating pressure, which must be available before any combustible material is placed on the job site. Average spacing between hydrants 500' and 250' maximum distance from any point on the street or road frontage to hydrant. Standard Fire hydrants shall be installed (6"x4"x2-1/2"). 112. Standard Fire Hydrants- Super fire hydrants (6" x 4" x 2-2 1/2"), shall be located not less than 25 feet or more than 250 feet from any portion of the building as measures along approved vehicular travel ways. The required fire flow shall be available from any adjacent hydrant(s) in the system. 113. Hazardous Fire Area - The proposed project is located high or very high fire zone as adopted in the Lake Elsinore Municipal Code. The project shall adhere to all high fire requirements as prescribed in the Title 24 Codes, any applicable state and local codes pertaining to high fire. The structures shall comply with Chapter 7A of the Building Code and or Section R327 of the California Residential Code. Roofing Materials shall be classified at not less than class "A". 114. Fuel Modification Plan - Fuel modification plans shall be provided to the Lake Elsinore Fire Protection Planning office. Plans shall include fuels modeling and comprehensive details with regard to the vegetation management plan. The fuels modification zone shall be not less than 100' from all structures and may be required to be increased. 115. Minimum Access Standards - The following access requirements are required to be implemented to ensure fire department and emergency vehicular access. All roadways shall conform to the City of Lake Elsinore approved roadway standards but in no case shall the minimum fire department vehicular access be less the following provisions: Residential Subdivision Projects Page 17 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL 1. Twenty-four feet (24') clear width. Where parking is to be provided, each parking side shall be provided with eight (8') additional feet on each side of the fire department access. 2. Median openings or crossovers between opposing lanes of a divided highway or street shall be located only at approved intersections at intervals of not less than 500 feet. [Ord. 529 § 3.2(F), 1973]. 3. The required all weather vehicular access shall be able to support no less than 70,000 lbs. over 2 axles. 4. Roadway gradient shall not exceed 15% on any access road, driveways, and perimeter roads. 5. Turning Radius shall be 26' inside and 38' outside for all access roads. 116. Secondary Access - In the interest of Public Safety, this project shall provide an Alternate or Secondary Access. Said access shall be constructed in accordance to the City of Lake Elsinore Engineering Department standards to accommodate full fire response and community evacuation. 117. Automatic / Manual Gates- Gate entrances shall be at least two feet wider than the width of the traffic lane(s) serving that gate and no less than 20 feet wide. Any gate providing access from a road to a driveway shall be located at least 35 feet from the roadway and shall open to allow vehicle to stop without obstructing traffic on the road. Where a one-way road with a single traffic lane provides access to a gate entrance, a 40 foot turning radius shall be used. Gate access shall be equipped with a rapid entry system. Plans shall be submitted to the Fire Department for approval prior to installation. Automatic/manual gate pins shall be rated with shear pin force, not to exceed 30 foot pounds. Automatic gates shall be equipped with emergency backup power. Gates activated by the rapid entry system shall remain open until closed by the rapid entry system. Contact the Fire Planning Office for current plan check fees. 118. Separation of Occupancy- A fire barrier wall for the separation of occupancies is required per the California Building Code. Fire walls, fire barriers, fire partitions, smoke barriers, and smoke partitions or any other wall required to have protected openings or penetrations shall be effectively and permanently identified with signs or stenciling. Such identification shall be located in accessible concealed floor, floor ceiling or attic spaces repeated at intervals not exceeding 30 feet along the wall, and include lettering not less than 0.5 inch in height, incorporating the suggested wording "FIRE AND/OR SMOKE BARRIER -PROTECT ALL OPENINGS," or other wording. Prior to Building Permit Issuance Residential Subdivision Projects Page 18 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL 119. Plan Check Fee- Building plan check fees shall be made payable to the "City of Lake Elsinore", and shall be submitted to the Fire Department at the time of plan submittal. 120. Water System Plans - Applicant and/or developer shall separately submit 2 sets of water system plans to the Fire Department for review. Plans must be signed by a registered Civil Engineer and/or water purveyor prior to Fire Department review and approval. Mylars will be signed by the Fire Department after review and approval. Two (2) copies of the signed and approved water plans shall be returned to the Fire Department before release of a building permit. 121. Prior to Building Construction Verification - This project shall be inspected and approved by the Fire Marshal or designee prior to bringing combustible materials on site. During such inspection all permanent road signs shall be in place, all hydrants shall on operating and approved for use by the water purveyor, and all permanent road surfaces shall be completed including primary and secondary access circulation. Prior to Building Final Inspection 122. Residential Fire Sprinkler Systems for Single family and two-family 13D - Install a complete fire sprinkler system designed in accordance with California Residential Code, California Fire Code and adopted standards. A C-16 licensed contractor must submit plans, along with the current fee, to the Fire Department for review and approval prior to installation. 123. Designated Fire Lanes - The applicant shall prepare and submit to the Fire Department for approval, a site plan designating required fire lanes with appropriate lane painting and/ or signs. 124. Display Boards- Display Boards will be as follows: Each complex shall have an illumi9nated diagrammatic representation of the actual layout which shows name of complex, all streets, building designators, unit members, and fire hydrant locations within dimension and located next to roadway access. 125. Multi -family Residential Knox Rapid Entry box- A rapid entry Knox Box shall be installed on the outside of the building. Key(s) shall have durable and legible tags affixed for identification of the correlating common space/electrical rooms. Special forms are available from this office for ordering the Knox box. If the building/facility is protected with a fire alarm or burglar alarm system, it is recommended that the lock box be "tamper" monitored. Residential Subdivision Projects Page 19 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE RESIDENTIAL SUBDIVISION PROJECTS STANDARD CONDITIONS OF APPROVAL 126. Fire Extinguishers (Multi -Family)- Minimum installation of portable fire extinguishers complying with Section 906 of the 2013 California Fire Code with a minimum rating of 2A-10BC and signage. Fire Extinguishers located in public areas shall be in recessed cabinets mounted 48" to center above floor level with maximum 4" projection from the wall. Contact Fire Department for proper placement of equipment prior to installation. DEPARTMENT OF ADMINISTRATIVE SERVICES Annex into CFD 2015-1 (Safety) Law Enforcement, Fire and Paramedic Services CFD 1. Prior to approval of the Final Map, Parcel Map, Residential Design Review, or Conditional Use Permit (as applicable), the applicant shall annex into Community Facilities District No. 2015-1 (Safety) the Law Enforcement, Fire and Paramedic Services Mello -Roos Community Facilities District to offset the annual negative fiscal impacts of the project on public safety operations and maintenance issues in the City. Alternatively, the applicant may propose alternative financing mechanisms to fund the annual negative fiscal impacts of the project with respect to Public Safety services. Applicant shall make a seven thousand five hundred dollar ($7,500) non-refundable deposit to cover the cost of the annexation, formation or other mitigation process, as applicable. Prior to approval of the Final Map, Parcel Map, Residential Design Review, Conditional Use Permit or building permit (as applicable), the applicant shall annex into the Community Facilities District No. 2015-2 (Maintenance Services) to fund the on-going operation and maintenance of the public right-of-way landscaped areas and neighborhood parks to be maintained by the City and for street lights in the public right-of- way for which the City will pay for electricity and a maintenance fee to Southern California Edison, including parkways, open space and public storm drains constructed within the development and federal NPDES requirements to offset the annual negative fiscal impacts of the project. Alternatively, the applicant may propose alternative financing mechanisms to fund the annual negative fiscal impacts of the project with respect to Maintenance Services. Applicant shall make a seven thousand five hundred dollar ($7,500) non-refundable deposit to cover the cost of the annexation, formation or other mitigation process, as applicable. The applicant shall comply with the following mitigation measures, which are set forth in the Mitigation Monitoring & Reporting Program ((MMRP) for (EIR or MND), which was adopted for this project. Residential Subdivision Projects Page 21 of 21 Standard Conditions of Approval City Council April 24, 2015 CITY OF LAKE ELSINORE COMMERCIAL / INDUSTRIAL PROJECTS DRAFT STANDARD CONDITIONS OF APPROVAL GENERAL CONDITIONS 1. The proposed project (Entitlement Case Numbers) consists of the development of (project description and amenities) located at (address or cross streets) (APN). 2. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold harmless the City, its Officials, Officers, Employees, and Agents from any claim, action, or proceeding against the City, its Officials, Officers, Employees or Agents to attack, set aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or legislative body concerning the proposed project attached hereto. 3. Within 30 days of project approval, the applicant shall sign and complete an "Acknowledgment of Conditions" and shall return the executed original to the Community Development Department for inclusion in the case records. 4. The applicant shall submit a check in the amount of $ made payable to the County of Riverside for the filing of a Notice of Determination. The check shall be submitted to the Planning Division for processing within 48 hours of the project's approval. PLANNING DIVISION 5. Project Entitlement (Example: Design Review No. 2015-_) shall lapse and become void two years following the date on which the design review became effective, unless one of the following: (1) prior to the expiration of two years, a building permit related to the design review is issued and construction commenced and diligently pursued toward completion; or (2) prior to the expiration of two years, the applicant has applied for and has been granted an extension of the design review approval pursuant to subsections (B) and (C) of Lake Elsinore Municipal Code (LEMC) Section 17.184.120. Notwithstanding conditions to the contrary, a design review granted pursuant to LEMC Chapter 17.184 shall run with the land for this two-year period, subject to any approved extensions, and shall continue to be valid upon a change of ownership of the site which was the subject of the design review application. 6. Project Entitlement (Example: Conditional Use Permit No. 2015-_) shall lapse and become void two years following the date on which the conditional use permit became effective, unless one of the following: (1) prior to the expiration of two Page 1 of 22 years, a building permit related to the conditional use permit is issued and construction commenced and diligently pursued toward completion; or (2) prior to the expiration of two years, the applicant has applied for and has been granted an extension of the design review approval pursuant to subsections (B) and (C) of Lake Elsinore Municipal Code (LEMC) Section 17.168.080. Subject to the provisions of LEMC Section 17.168.110, a conditional use permit granted pursuant to the provisions of this section shall run with the land and shall continue to be valid upon a change of ownership of the site or structure which was the subject of the conditional use permit application 7. All Conditions of Approval shall be reproduced on page one of building plans prior to their acceptance by the Building and Safety Division, Community Development Department. All Conditions of Approval shall be met prior to the issuance of a Certificate of Occupancy and release of utilities. 8. All site improvements shall be constructed as indicated on the approved building plans, as modified by these conditions of approval. 9. Any proposed minor revisions to approved plans shall be reviewed and approved by the Community Development Director or designee. Any proposed substantial revisions to the approved plans shall be reviewed according to the provisions of the Municipal Code in a similar manner as a new application. 10.All roof mounted or ground support air conditioning units or other mechanical equipment incidental to development shall be architecturally screened or shielded by landscaping so that they are not visible from neighboring property or public streets. Any roof mounted central swamp coolers shall also be screened, and the Community Development Director, prior to issuance of building permit shall approve screening plan. 11.A detailed on-site lighting plan, including a photometric diagram, shall be reviewed to ensure that all exterior on-site lighting shall be shielded and directed on-site so as not to create glare onto neighboring property and streets or allow illumination above the horizontal plane of the fixture. 12.The property address (in numerals at least six inches high) shall be displayed near the entrance and be easily visible from the front of the subject property and public right-of-way. 13.The applicant shall construct trash enclosure(s) with a decorative roof to match the colors, materials and design of the project architecture. 14.A uniform hardscape and street furniture design including seating benches, trash Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 2 of 22 receptacles, free-standing potted plants, bike racks, light bollards, etc., shall be utilized and be compatible with the architectural style. Detailed designs shall be submitted for Planning Division review and approval prior to the issuance of building permits. 15. Three (3) sets of the Final Landscaping / Irrigation Detail Plans shall be submitted to the Community Development Department with appropriate fees, reviewed by the City's Landscape Architect Consultant and approved by the Community Development Director or designee, prior to issuance of a building permit. a) All planting areas shall have permanent and automatic sprinkler system with 100% plant and grass coverage using a combination of drip and conventional irrigation methods. b) All planting areas shall be separated from paved areas with a six inch (6") high and six inch (6") wide concrete curb. c) Planting within fifteen feet (15') of ingress/egress points shall be no higher than thirty-six inches (36"). d) Landscape planters shall be planted with an appropriate parking lot shade tree pursuant to the LEMC and Landscape Design Guidelines. e) No required tree planting bed shall be less than 5 feet wide. f) Root barriers shall be installed for all trees planted within 10 feet of paving. g) Any transformers and mechanical or electrical equipment shall be indicated on landscape plan and screened as part of the landscaping plan. h) The landscape plan shall provide for ground cover, shrubs, and trees and meet all requirements of the City's adopted Landscape Guidelines. i) All landscape improvements shall be bonded 100% for material and labor for two years from installation sign -off by the City. Release of the landscaping bond shall be requested by the applicant at the end of the required two years with approval/acceptance reviewed by the Landscape Consultant and approved by the Community Development Director or Designee. j) All landscaping and irrigation shall be installed within affected portion of any phase at the time a Certificate of Occupancy is requested for any building. k) Final landscape plan must be consistent with approved site plan. 1) Final landscape plans to include planting and irrigation details. Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 3 of 22 m) Final landscape plans shall include drought tolerant planting consistent with Elsinore Valley Municipal Water District standards subject to plan check and approval by the City's landscape plan check consultant. 16. Landscaping installed for the project shall be continuously maintained to the reasonable satisfaction of the Community Development Director. If it is determined that the landscaping is not being maintained, the Director of Community Development shall have the authority to require the property owner to bring the landscaping into conformance with the approved landscape plan. The continued maintenance of all landscaped areas shall be the responsibility of the developer or any successors in interest. 17. No individual signs are approved as part of this approval. The applicant or designee shall submit an application for a sign permit, pay appropriate fees and receive approval from the Community Development Department for any sign(s) installed at the project site. OR The applicant shall submit a sign program for review and approval of the Planning Commission prior to installation. 18. The project shall connect to sewer and meet all requirements of the Elsinore Valley Municipal Water District (EVMWD). The applicant shall submit water and sewer plans to the EVMWD and shall incorporate all district conditions and standards. 19. Provisions of the City's Noise Ordinance shall be satisfied during all site preparation and construction activity. The applicant shall place a weatherproof 3' x 3' sign at the entrance to the project site identifying the approved days and hours of construction activity 7:00 a.m. — 5:00 p.m., Monday through Friday. Only finish work and similar interior construction may be conducted on Saturdays and may commence no earlier than 8:00 a.m. and shall cease no later than 4:00 p.m. with no construction activity to occur on Sundays or legal holidays. The sign shall identify the name and phone number of the development manager to address any complaints. 20.The proposed location of on-site construction trailers shall be approved by the Community Development Director or designee. A cash bond of $1,000 shall be required for any construction trailers placed on the site and used during construction. Bonds will be released after removal of trailers and restoration of the site to an acceptable state, subject to approval of the Community Development Director or designee. Such trailer(s) shall be fully on private property and outside the public right of way. 21. Graffiti shall be removed within 24 hours. Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 4 of 22 22. The entire site shall be kept free from trash and debris at all times and in no event shall trash and debris remain for more than 24 hours. 23. If any of the conditions of approval set forth herein fail to occur, or if they are, by their terms, to be implemented and maintained over time, if any of such conditions fail to be so implemented and maintained according to their terms, the City shall have the right to revoke or modify all approvals herein granted, deny or further condition issuance of all future building permits, deny, revoke, or further condition all certificates of occupancy issued under the authority of approvals herein granted; record a notice of violation on the property title; institute and prosecute litigation to compel their compliance with said conditions or seek damages for their violation. BUILDING AND SAFETY 24.Any and all existing or proposed public areas shall be made accessible in accordance with Americans with Disabilities Act (ADA) requirements. 25.Any and all improvements shall be in compliance with the 2013 editions of the California Building, Plumbing and Mechanical Codes, 2013 California electrical Code, California Administrative Code, 2013 California Energy Codes, 2013 California Green Building Standards, California Title 24 Disabled Access Regulations and the Lake Elsinore Municipal Code. 26.The developer shall comply with all Municipal Code provisions regarding construction debris removal and recycling as set forth in Chapter 14.12 (Construction and Demolition Waste Management) of the Lake Elsinore Municipal Code. 27.All department approvals and fees shall be paid prior to the issuance of building permits. PUBLIC WORKS/ENGINEERING DIVISION GENERAL 28. Developer shall provide a copy of an encroachment permit or any approval documents from the Riverside County Flood Control for encroaching, grading, or discharging into County flood control facilities. 29. Developer shall mitigate to prevent any flooding and/or erosion downstream caused by development of the site and/or diversion of drainage. Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 5 of 22 30.All natural drainage traversing the site (historic flow) shall be conveyed through the site in a manner consistent with the historic flow or to one or a combination of the following: to a public facility; accepted by adjacent property owners by a letter of drainage acceptance; or conveyed to a drainage easement as approved by the City Engineer. 31.A11 required soils, geology, hydrology and hydraulic and seismic reports shall be prepared by a Registered Civil Engineer. 32. All slopes and landscaping within the public right of way shall be maintained by the property owner or owner's association or another maintenance entity approved by the City Council. 33.AII open space and slopes except for public parks and schools and flood control district facilities, outside the public right of way shall be owned and maintained by the property owner or property owner's association. 34. In accordance with the City's Franchise Agreement for waste disposal & recycling, the applicant shall be required to contract with CR&R Inc. for removal and disposal of all waste material, debris, vegetation and other rubbish generated both during cleaning, demolition, clear and grubbing or all other phases of construction and during occupancy. 35.Any grading that affects "Waters of the United States", wetlands or jurisdictional streambeds, shall require approval and necessary permits from respective Federal and/or State Agencies. 36.Applicant shall submit a detailed hydrology and hydraulic study for review for the sufficient containment and conveyance of the storm water to a safe and adequate discharge point. 37.The site will accommodate all construction activity, vehicles, etc. No staging on public streets, or private property belonging to others shall be conducted without the written permission of the property owner. FEES 38. Applicant shall pay all applicable permit application and Engineering assessed fees, including without limitation plan -check and construction inspection fees, at the prevalent rate at time of payment in full. 39.Applicant shall pay all applicable Mitigation and Development Impact Fees at the prevalent rate at time of payment in full. Mitigation and Development Impact Fees Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 6 of 22 include without limitation, Library Mitigation Fees, Park Capital Improvement Fees, Storm Drain Improvement and Drainage District Fees, TIF, TUMF, City Hall and Public Works Facilities Fees, Community Center Facilities Fees, Lakeside Facilities Fees, Animal Shelter Facilities Fees, Fire Facilities Fees, MSHCP, Stephen's Kangaroo Rat Habitat, Railroad Canyon Benefit District will be assessed. FLOOD PLAIN 40. Site development along wetlands shall require special grading and erosion control requirements (LEMC Title 15). 41. Projects that lie within a FEMA mapped special flood hazard zone and within the Floodplain Management area shall comply with LEMC Section 15.68. 42. Meet all requirements of LEMC regarding floodplain management. Finish floor elevation of all buildings shall be a minimum of 1267 feet. Any fill placed in the 100 - year flood plain for the purposes of elevating the building floor out of the flood plain shall require a CLOMR/CLOMR-F and LOMR/LOMR-F to be processed with FEMA. 43. No improvement shall be made upon all lands below the 1265 foot elevation level in the FEMA mapped Lake Elsinore flood plain southeasterly of the Lake levee and no artificial change in the topography in the surface of said lands shall be made (except terracing and soil conservation measures) without first complying with all applicable local, State and Federal laws, rules and regulations and Section 404 Clean Water Act. LEMC 15.68.052. 44. Meet all requirements of LEMC 15.64 regarding flood hazard regulations to include elevation of the lowest floor a minimum of 2 feet above the base flood elevation in FEMA mapped special flood hazard areas (100 -year). STORM WATER MANAGEMENT / POLLUTION PREVENTION / NPDES Design 45.The project is responsible for complying with the Santa Ana Region NPDES Permits as warranted based on the nature of development and/or activity. These Permits include: • General Permit—Construction • GeneralPermit— Industrial • Scrap Metal • Deminimus Discharges • MS4 Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 7 of 22 46.The 2010 SAR MS4 Permit requires implementation of LID Principles and LID Site Design, where feasible, to treat the pollutants of concern identified for the project, in the following manner (from highest to lowest priority): (Section XII.E.2, XII.E3, and XII.E.7). • Preventatives measures (these are mostly non-structural measures, e.g., preservation of natural features to a level consistent with the MEP standard; minimization of Urban Runoff through clustering, reducing impervious areas, etc.) • The Project shall infiltrate, harvest and use, evapotranspire and/or bio -treat the Design Capture Volume (DCV). • The Project shall consider a properly engineered and maintained bio- treatment system only if infiltration, harvesting and use and evapotranspiration cannot be feasibly implemented at the project site. • Any portion of the DCV that is not infiltrated, harvested and used, evapo- transpired, and/or bio -treated shall be treated and discharged in accordance with the requirements set forth in Section XII.G. 47. Parking lot landscaping areas shall be designed to provide for treatment, retention or infiltration of runoff. 48. Project hardscape areas shall be designed and constructed to provide for drainage into adjacent landscape. 49. Hydromodification / Hydraulic Conditions of Concern — The project shall identify potential Hydraulic Conditions of Concern (HCOC) and implement measures to limit disturbance of natural water bodies and drainage systems, conserve natural areas; protect slopes, channels and minimize significant impacts from urban runoff. 50. If CEQA identifies resources requiring Clean Water Act Section 401 Permitting, the applicant shall obtain certification through the Santa Ana Regional Water Quality Control Board and provide a copy to the Engineering Division. 51.All storm drain inlet facilities shall be appropriately marked "Only Rain in the Storm Drain" using the City authorized marker to prevent illegal dumping in the drain system. 52.The project shall use either volume -based and/or flow -based criteria for sizing BMPs in accordance with NPDES Permit Provision XII.D.4. Construction 53. Both a Storm Water Pollution Prevention Plan (SWPPP) and a Water Quality Management Plan (WQMP) for post construction are required for this project. The Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 8 of 22 WQMP must be approved prior to grading or building permit issuance. 54. Prior to grading or building permit the applicant shall demonstrate that compliance with the permit has been obtained by providing a copy of the Notice of Intent (NOI) submitted to the State Water Resources Control Board and a copy of the notification of the issuance of a Waste Discharge Identification (WDID) Number or other proof of filing to the satisfaction of the City Engineer. 55. SWPPP — Prior to the issuance of any grading or building permits, the applicant shall demonstrate compliance with California's General permit for Stormwater Discharges Associated with Construction Activity by providing a copy of the Notice of Intent (NOI) submitted to the State Water Resources Control Board and a copy of the subsequent notification of the issuance of a Waste Discharge Identification (WDID) Number. Projects subject to filing an NOI shall prepare and implement a Stormwater Pollution Prevention Plan (SWPPP). A copy of the current SWPPP shall be kept at the project site and be available for review upon request. Projects that are not subject to coverage under the General Permit — Construction will prepare and implement an Erosion and Sediment Control Plan in compliance with the California Building Code and Local Ordinances. 56. Erosion & Sediment Control — Prior to the issuance of any grading or building permit, the applicant shall submit for review and approval by the City Engineer, an Erosion and Sediment Control Plan as a separate sheet of the grading plan submittal to demonstrate compliance with the City's NPDES Program and state water quality regulations for grading and construction activities. The Erosion and Sediment Control Plan shall identify how all construction materials, wastes, grading or demolition debris, and stockpiles of soil, aggregates, soil amendments, etc. shall be property covered, stored and secured to prevent transport into local drainages or waters by wind, rain, tracking, or dispersion. The plan shall also describe how the project will ensure that all BMPs will be maintained during construction of any future right of ways. A copy of the plan shall be incorporated into the SWPPP as applicable, kept updated as needed to address changing circumstances of the project site, be kept at the project site and available for review upon request. 57.The project shall implement LID practices that treat the 85th percentile storm in the priority order as follows: • Infiltrate • Harvest and use • Evapotranspire and/or biotreat • Treat ALL pollutants of concern and discharge (applicable to projects discharging to Lake Elsinore for recharge) Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 9 of 22 Post -Construction 58.A preliminary WQMP shall be submitted during the project entitlement stage. The level of detail in a preliminary Project -Specific WQMP will depend upon the level of detail know about the overall project design at the time project approval is sought. At a minimum, the preliminary Project -Specific WQMP shall identify the type, size, location, and final ownership of Stormwater BMPs adequate to serve new roadways and any common areas, and to also manage runoff from an expected reasonable estimate of the square footage of future roofs, driveways, and other impervious surfaces on each individual lot. 59.The applicant shall use the Water Quality Management Plan for the Santa Ana Region of Riverside County guidance Document and template for preparation of both the preliminary and final WQMP. 60. The project shall complete and submit for review and approval to the Engineering Division a final WQMP, incorporating the LID Principles and Stormwater BMPs committed to in the preliminary Project -Specific WQMP. The final WQMP shall be approved prior to issuance of any grading or building permit. 61. WQMP — A Preliminary and Final WQMP are required. Prior to the issuance of any grading or building permits, the applicant shall submit for review and approval by the City Engineer, a Water Quality Management Plan (WQMP) specifically identifying Best Management Practices (BMPs) that will be used onsite to control identified pollutants of concern. The applicant shall utilize the MS4 Permittee Drainage Area Management Plan (DAMP), LID Guidance Manual for reference, and the MS4 Permittee's WQMP Guidance Document and Template for submittal. This WQMP shall include the following: • Detailed site and project description • Potential stormwater pollutants • Post -development drainage characteristics • Low Impact Development (LID) BMP selection and analysis • Structural and Non -Structural source control BMPs • Site design and drainage plan (BMP Exhibit) • Vector issues are addressed in the BMP design, operation and maintenance. • GIS coordinates for all LID and Treatment Control BMPs • HCOC — demonstrate that discharge flow rates, velocities, duration and volume for the post construction condition from a 2 year and 10 year 24 hour rainfall event will not cause significant adverse impacts on downstream erosion and receiving waters, or measures are implemented to mitigate significant adverse impacts to downstream public facilities and water bodies. Design goal to replicate pre -development hydrologic regime. Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 10 of 22 62. Operation and Maintenance (O&M) Plan & Agreement (using City format) that (1) describes the long-term operation and maintenance requirements for BMPs identified in the BMP Exhibit; (2) identifies the entity that will be responsible for long-term operation and maintenance of the referenced BMPs; and (3) describes the mechanism for funding the long-term operation and maintenance of the referenced BMPs. 63. Prior to the issuance of a certificate of use and/or occupancy, the applicant shall demonstrate compliance with applicable NPDES permits for construction, industrial/commercial, MS4, etc. to include: • Demonstrate that all structural Best Management Practices (BMP's) described in the BMP Exhibit from the project's approved WQMP have been implemented, constructed and installed in conformance with approved plans and specifications. • Demonstrate that the project has complied with all non-structural BMPs described in the project's WQMP. • Provide signed, notarized certification from the engineer of work that the structural BMP's identified in the project's WQMP are installed and operational. • Submit a copy of the fully executed, recorded Operations and Maintenance (O&M) Plan for all structural BMPs. • Demonstrate that copies of the project's approved WQMP (with recorded O&M Plan attached) are available for each of the initial occupants (commercial/industrial) or HOA as appropriate. • Agree to pay for a Special Investigation from the City of Lake Elsinore for a date twelve (12) months after the issuance of a Certificate of Use and/or Occupancy for the project to verify compliance with the approved WQMP and O&M Plan. A signed/sealed certification from the engineer of work dated 12 months after CofO will be considered in lieu of a Special Investigation by the City. • Provide a recorded copy of one of the following: 1. A water quality implementation agreement that has the approved WQMP and O&M Plan attached; or 2. The final approved Water Quality Management Plan and Operations and Maintenance Plan. 3. CC&R's (they must include the approved WQMP and O&M Plan) for the project's Home Owner's Association. 64.Chemical Management — Prior to the issuance of building permits for any tank or pipeline, the uses of said tank or pipeline shall be identified and the applicant shall submit a Chemical Management Plan in addition to a WQMP with all appropriate measures for chemical management (including, but not limited to, storage, emergency response, employee training, spill contingencies and disposal) in a Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 11 of 22 manner meeting the satisfaction of the Manager, Permit Intake, in consultation with the Riverside County Fire Department and wastewater agencies, as appropriate, to ensure implementation of each agency's respective requirements. A copy of the approved "Chemical Management Plans" shall be furnished to the Fire Marshall, prior to the issuance of any Certificates of Use and Occupancy. 65. Industrial Facilities — For industrial facilities subject to California's General Permit for Stormwater Discharges Associated with Industrial Activity as defined by Standard Industrial Classification (SIC) Code. • Prior to grading or building permit close-out and/or the issuance of a certificate of use and occupancy, the applicant shall demonstrate that compliance with the permit has been obtained by providing a copy of the Notice of Intent (NOI) submitted to the State Water Resources Control Board and a copy of the notification of the issuance of a Waste Discharge Identification (WDID) Number or other proof of filing to the satisfaction of the City Engineer. UTILITIES 66.AII arrangements for relocation of utility company facilities (power poles, vaults, etc.) out of the roadway shall be the responsibility of the property owner or his agent. 67.All overhead utilities shall be undergrounded in accordance with Chapter 12.16 of the Lake Elsinore Municipal Code (LEMC). 68. Underground water rights shall be dedicated to the City pursuant to the provisions of Section 16.52.030 (LEMC), and consistent with the City's agreement with the Elsinore Valley Municipal Water District. 69. The developer shall apply for, obtain and submit to the City Engineering Division a letter from Southern California Edison (SCE) indicating that the construction activity will not interfere with existing SCE facilities. 70.The developer shall submit a copy of the "Will Serve" letter to the Engineering Division from the applicable water agency stating that water and sewer arrangement have been made for this project and specify the technical data for the water service at the location such as water pressure and volume etc Commercial /Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 12 of 22 IMPROVEMENTS: Desiqn 71.The development of each Planning Area or Phase shall be subject to specific review and conditions of approval. 72.Sight distance into and out of the project location shall comply with CALTRANS standards. 73.The developer shall install permanent bench marks per City of Lake Elsinore Standards and at locations to be determined by the City Engineer. 74.The developer shall coordinate with Riverside Transit Authority for location and installation of bus transit facilities. 75.10 -year storm runoff shall be contained within the curb and the 100 -year storm runoff shall be contained within the street right-of-way. When either of these criteria are exceeded, drainage facilities shall be provided. 76.All drainage facilities in this project shall be constructed to Riverside County Flood Control District Standards. 77.A drainage study shall be provided. The study shall identify the following: identify storm water runoff from and upstream of the site; show existing and proposed off- site and on-site drainage facilities; and include a capacity analysis verifying the adequacy of the facilities. The drainage system shall be designed to ensure that runoff from a 10 year storm of 6 hours or 24 hours duration under developed condition is equal or less than the runoff under existing conditions of the same storm frequency. Both 6 hour and 24 hour storm duration shall be analyzed to determine the detention basin capacities necessary to accomplish the desired results. 78.All natural drainage traversing the site shall be conveyed through the site, or shall be collected and conveyed by a method approved by the City Engineer. All off-site drainage, if different from historic flow, shall be conveyed to a public facility. 79. Roof drains shall not be allowed to outlet directly through coring in the street curb. Roofs should drain to a landscaped area. 80.The site shall be planned and developed to keep surface water from entering buildings (California Green Building Standards Code 4.106.3). Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 13 of 22 81.All existing storm drain inlet facilities adjacent to the subject properties shall be retrofitted with a storm drain filter; all new storm drain inlet facilities constructed by this project shall include a storm drain filter. 82.A California Registered Civil Engineer shall prepare the improvement plans required for this project. Improvements shall be designed and constructed to Riverside County Road Department Standards latest edition, and City Codes (LEMC 12.04 and 16.34). Improvement plans will be reviewed and approved by both the City of Lake Elsinore and Caltrans. 83. If existing improvements are to be modified, the existing improvement plans on file shall be modified accordingly and approved by the City engineer prior to issuance of a building permit. PERMITTING/CONSTRUCTION 84.An Encroachment Permit shall be obtained prior to any work on City and/or State right of way. The developer shall submit the permit application, required fees and executed agreements, security and other required documentation prior to issuance. 85.All compaction reports, grade certification, monument certification (with tie notes delineated on 8 1/2 X 11" Mylar) shall be submitted to the Engineering Division before final inspection of public works improvements will be scheduled and approved. 86.All streets shall be constructed per Lake Elsinore City Standards and/or applicable specific plan. Any deviation from City standards shall be approved by the City Engineer. PRIOR TO GRADING PERMIT Design 87.A grading plan signed and stamped by a California Registered Civil Engineer shall be submitted for City review and approval for all addition and/or movement of soil (grading) on the site. The plan shall include separate sheets for erosion control, haul route and traffic control. The grading submittal shall include all supporting documentation and be prepared using City standard title block, standard drawings and design manual (available at www.lake-elsinore.org). 88.All grading plan contours shall extend to minimum of 50 feet beyond property lines to indicate existing drainage pattern. Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 14 of 22 89.The grading plan shall show that no structures, landscaping, or equipment are located near the project entrances that could reduce sight distance. 90. If the grading plan identifies alterations in the existing drainage patterns as they exit the site, a Hydrology and Hydraulic Report for review and approval by City Engineer shall be required prior to issuance of grading permits. All grading that modifies the existing flow patterns and/or topography shall be in compliance with federal, state and local law and be approved by the City Engineer. 91.A seismic study shall be performed on the site to identify any hidden earthquake faults, liquefaction and/or subsidence zones present on-site. A certified letter from a registered geologist or geotechnical engineer shall be submitted confirming the absence of this hazard prior to grading permit. 92. The developer shall obtain all necessary off-site easement and/or permits for off- site grading and the applicant shall accept drainage from the adjacent property owners. Permit/Construction 93. Developer shall execute and submit grading and erosion control agreement, post grading security and pay permit fees as a condition of grading permit issuance. 94.A preconstruction meeting with the City Public Works Inspector (Engineering Division) is required prior to commencement of ANY grading activity. 95.All grading activities shall minimize dust through compliance with AQMD Rule 403 which requires watering during earth moving operations. 96. Developer shall provide the city with a copy of the Notice of Intent (NOI) and Waste Discharge Identification (WDID) letter issued by the Regional Water Quality Control Board for the National Pollutant Discharge Elimination System (NPDES) program prior to issuance of grading permit(s). 97. Prior to commencement of grading operations, developer is to provide to the City a map of all proposed haul routes to be used for movement of export material. All such routes shall be subject to the review and approval of the City Engineer. Haul route shall be submitted prior to issuance of a grading permit. Hauling in excess of 5,000 cubic yards shall be approved by the City Council (LEMC 15.72.065). 98. Export sites located within the Lake Elsinore City limits must have an active grading permit. Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 15 of 22 99.Applicant to provide to the City a video record of the condition of all proposed public City haul roads. In the event of damage to such roads, the applicant shall pay full cost of restoring public roads to the baseline condition. A bond may be required to ensure payment of damages to the public right of way, subject to approval of the City Engineer. 100. All grading shall be done under the supervision of a geotechnical engineer. Slopes steeper than 2 to 1 shall be evaluated for stability and proper erosion control and approved by the City. 101. Review of the project Storm Water Pollution Prevention Plan (SWPPP) and sediment and erosion control plan shall be completed. A copy of the current SWPPP shall be kept at the project site and be available for review upon request. 102. Approval of the project Water Quality Management Plan (WQMP) for post construction shall be received prior to issuance of a grading permit. 103. Submit an approved environmental Division. This approval shall identify anticipated for this project. PRIOR TO BUILDING PERMIT clearance document to the Engineering and clear all proposed grading activity 104. Provide soils, geology and seismic report, including recommendations for parameters for seismic design of buildings, and walls prior to building permit. 105. Prior to issuance of certificates of use and occupancy or building permits for individual tenant improvements or construction permits for a tank or pipeline, uses shall be identified and, for specified uses (where the proposed improvements will store, generate or handle hazardous materials in quantities that will require permitting and inspection once operational), the applicant shall propose plans and measures for chemical management (including, but not limited to, storage, emergency response, employee training, spill contingencies and disposal) to the satisfaction of the City Building Official(s). 106. All street improvement plans, traffic signal plans, signing and striping plans shall be completed and approved by the City Engineer per the Traffic Impact Analysis dated as specified. Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 16 of 22 PRIOR TO OCCUPANCY/FINAL APPROVAL: 107. All signing and striping and traffic control devices onsite and on Enterprise Way and Collier Avenue shall be installed. 108. All public improvements shall be completed in accordance with the approved plans or as condition of this development to the satisfaction of the City Engineer. 109. All water and sewer improvements shall be completed in accordance with Water District requirements. 110. Proof of acceptance of maintenance responsibility of slopes, open spaces, landscape areas, and drainage facilities shall be provided. 111. TUMF fees shall be paid. The TUMF fees shall be the effective rate at the time of payment in full in accordance with the LEMC. 112. As -built plans for all approved plan sets shall be submitted for review and approval by the City. The developer / developer owner is responsible for revising the original mylar plans. 113. In the event of damage to City roads from hauling or other construction related activity, applicant shall pay full cost of restoring public roads to the baseline condition. 114. All final studies and reports, grade certifications, monument certifications (with tie notes delineated on 8 1/z X 11" mylar) shall be submitted in Jif format on a CD/DVD as follows: • Final Map(s) — GIS Shape files* and .tif of recorded map. • Improvement Plans — GIS Shape files* and .tif of approved as built mylar. • Grading Plans - .tif of approved built mylar. *GIS Shape files must be in projected Coordinate System: NAD 83 State Plane California Zone VI U.S. Fleet. 115. Developer shall provide FEMA elevation certificates for all buildings (includes trailers and storage facilities) prior to final approvals. If a LOMR-F has been processed and approved by FEMA, the letter of determination and certification may be in the form of a letter signed and sealed by a licensed civil engineer. 116. Final soil report showing compliance with recommendations, compaction reports, grade certifications, monument certification (with tie notes delineated on 8 '/ X 11" mylar) shall be submitted in .tif format on CD to the Engineering Division before Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 17 of 22 final inspection will be scheduled. 117. All required public right of way dedications, easements, dedications and vacations and easement agreement(s) not processed on the final map for ingress and egress through adjacent property(ies) shall be recorded with a recorded copy provided to the City prior to building permit issuance. 118. Water and sewer improvements shall be completed in accordance with Water District Requirements. 119. In the event of damage to City roads from hauling or other construction related activity, applicant shall pay full cost of restoring public roads to the baseline condition. 120. Prior to grading or building permit close-out and/or the issuance of a certificate of use or a certificate of occupancy, developer shall: • Demonstrate that all structural BMPs have been constructed, installed and are functioning in conformance with approved plans and specifications and the WQMP; • Demonstrate that they are prepared to implement all non-structural BMPs included in the conditions of approval or building/grading permit conditions; • Demonstrate that an adequate number of copies of the approved project specific WQMP are available for the future owners/occupants; and • The developer shall provide all education guidelines for Water Quality Management Practices to the tenants, operators and owners of the businesses of the development, regarding the environmental awareness on good housekeeping practices that contribute to protection of storm water quality and meet the goals of the approved WQMP in the Riverside County NPDES Drainage Area Management Plan. Contact the City NPDES Coordinator for handout/guideline information. 121. Chemical management plans shall be approved by the City and other appropriate agencies such as Riverside County Fire Department, the Health Services Agency's Department of Environmental Health, and sewering and/or water agencies to ensure implementation of each agency's respective requirements. Approval by the appropriate agencies shall be furnished to the Engineering Division, prior to the issuance of any certificates of use and/or occupancy. 122. Certificates or permits may be withheld if features needed to properly manage chemicals cannot be incorporated into a previously completed building, center, or complex. Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 18 of 22 123. The property owner or legally responsible party shall execute and cause to be recorded a "Covenant and Agreement" in the form provided by the City to inform future property owners of the requirement to implement the approved final project - specific WQMP. 124. Developer shall pay all outstanding applicable processing and development fees including but not all inclusive: TUMF, MSHCP, TIF, Stephens Kangaroo Rat Habitat and area drainage prior to occupancy/final approval. CITY OF LAKE ELSINORE FIRE MARSHAL General Conditions 125. Lake Elsinore Fire Protection Planning Office Responsibility - It is the responsibility of the recipient of these Fire Department conditions to forward them to all interested parties. The permit number (CDR 2014-01) is required on all correspondence. Questions should be directed to the Riverside County Fire Department, Lake Elsinore Fire Protection Planning Division at 130 S. Main Street, Lake Elsinore, CA 92530. Phone: (951) 671-3124 Ext. 225. The following fire department conditions shall be implemented in accordance with the Lake Elsinore Municipal Code and the adopted codes at the time of project building plan submittal, these conditions are in addition to the adopted code requirements. 126. Blue Dot Reflectors - Blue retro -reflective pavement markers shall be mounted on private streets, public streets and driveways to indicate location of fire hydrants. Prior to installation, placement of markers must be approved by the Riverside County Fire Department, 127. Minimum Hydrant Fire Flow - Minimum required fire flow shall be GPM for_ hours duration at --PSI residual operating pressure, which must be available before any combustible material is placed on the job site. Average spacing between hydrants 500' and 250' maximum distance from any point on the street or road frontage to hydrant. 128. Super Fire Hydrants - Super fire hydrants (6" x 4" x 2-2'/z'), shall be located not less than 25 feet or more than 250 feet from any portion of the building as measured along approved vehicular travel ways. 129. Secondary Access — In the interest of Public Safety, this project shall provide an Alternate or Secondary Access. Said access shall be constructed in accordance to the City of Lake Elsinore Engineering Department standards to accommodate full fire response and development evacuation. Commercial/ Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 19 of 22 130. Automatic / Manual Gates — Gate entrances shall be at least two feet wider than the width of the traffic lane(s) serving that gate and no less than 20 feet wide. Any gate providing access from a road to a driveway shall be located at least 35 feet from the roadway and shall open to allow vehicle to stop without obstructing traffic on the road. Where a one-way road with a single traffic lane provides access to a gate entrance, a 40 -foot turning radius shall be used. Gate access shall be equipped with a rapid entry system. Plans shall be submitted to the Fire Department for approval prior to installation. Automatic/manual gate pins shall be rated with shear pin force, not to exceed 30 foot pounds. Automatic gates shall be equipped with emergency backup power. Gates activated by the rapid entry system shall remain open until closed by the rapid entry system. Contact the Fire Planning office for current plan check fees. 131. Separation of Occupancy — A fire barrier wall for the separation of occupancies is required per the California Building Code. Fire walls, fire barriers, fire partitions, smoke barriers, and smoke partitions or any other wall required to have protected openings or penetrations shall be effectively and permanently identified with signs or stenciling. Such identification shall be located in accessible concealed floor, floor ceiling or attic spaces repeated at intervals not exceeding 30 feet along the wall, and include lettering not less than 0.5 inch in height, incorporating the suggested wording "FIRE AND/OR SMOKE BARRIER — PROTECT ALL OPENINGS," or other wording. 132. Operating Permit Required — This project has been reviewed and may require an operating permit in addition to the construction permit that has been conditioned for this project in accordance with Section 105.6 of The California Fire Code. Prior to Building Permit Issuance 133. Plan Check Fee - Building plan check fee made payable to the City of Lake Elsinore, and shall be submitted to the Fire Department at time plans are submitted to our office(s). 134. Water System Plans - Applicant and/or developer shall separately submit 2 sets of water system plans to the Fire Department for review. Plans must be signed by a registered Civil Engineer and/or water purveyor prior to Fire Department review and approval. Mylars will be signed by the Fire Department after review and approval. Two (2) copies of the signed and approved water plans shall be returned to the Fire Department before release of a building permit. 135. Prior to Building Construction Verification — This project shall be inspected and approved by the Fire Marshal or designee prior to bringing combustible materials on site. During such inspection all permanent road signs shall be in Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 20 of 22 place, all hydrants shall be operating and approved for use by the water purveyor, and all permanent road surfaces shall be completed including primary and secondary access circulation. Prior to Building Final Inspection 136, Fire Sprinkler System 13 — Install a complete fire sprinkler system designed in accordance with California Building Code, California Fire Code and adopted standards. Sprinkler systems with pipe sizes larger than 4 inches in diameter will require the Engineer or Architect of Record certification with details and calculations with "wet signature" that the building structural system is designed to support the seismic and gravity loads for the support of the additional weight of the sprinkler system. The PIV and FDC shall be located to the front of the building in an approved location, unobstructed and within 50 feet of an approved road or driveway, within 200 feet of a hydrant. A C-16 licensed contractor must submit plans, along with the current fee, to the Fire Department for review and approval prior to installation. 137. Sprinkler System Monitoring — Install an alarm monitoring system for fire sprinkler system(s) with 20 or more heads. Valve monitoring, water -flow alarm and trouble signals shall be automatically transmitted to an approved central station, remote station or proprietary monitoring station in accordance with California Building Code, California Fire Code and adopted standards. An approved audible sprinkler flow alarm shall be provided on the exterior in an approved location. The location of the Fire Alarm Control Unit shall be located in an environmentally - controlled location in accordance with 10.14 (NFPA 72, 2010). A C-10 licensed contractor must submit plans designed in accordance with adopted standards, along with the current fee, to the Fire Department for review and approval prior to installation. 138. Designated Fire Lanes - The applicant shall prepare and submit to the Fire Department for approval, a site plan designating required fire lanes with appropriate lane painting and/or signs. 139. Knox Rapid Entry Box — A rapid entry Knox Box shall be installed on the outside of the building. Key(s) shall have durable and legible tags affixed for identification of the correlating tenant space. Special forms are available from this office for ordering the Knox Box. If the building/facility is protected with a fire alarm or burglar alarm system, it is recommended that the lock box be "tamper" monitoring. 140. Fire Extinguishers- Minimum install portable fire extinguishers complying with Section 906 of the 2013 California Fire Code with a minimum rating of 2A-20BC Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 21 of 22 and signage. Fire extinguishers located in public areas shall be in recessed cabinets mounted 48" (inches) to center above floor level with maximum 4" projection from wall. Contact Fire Department for proper placement of equipment prior to installation. DEPARTMENT OF ADMINISTRATIVE SERVICES 141. Prior to the issuance of the first building permit, the applicant shall consent to the formation of Community Facilities District or annex into the proposed Community Facilities District No. 2015-2 (Maintenance Services) to fund the on-going operation and maintenance of the public right of way landscaped areas and neighborhood parks to be maintained by the City and for street lights in the public right of way for which the City will pay for electricity and a maintenance fee to Southern California Edison, including parkways, open space and public storm drains constructed within the development and federal NPDES requirements to offset the annual negative fiscal impacts of the project. Applicant shall, make a seven thousand five hundred dollar ($7,500) non-refundable deposit to cover the cost of the formation or annexation process, as applicable. The applicant may propose alternative financing mechanisms to fund the on-going operation and maintenance of the public right of way landscaped areas and neighborhood parks to be maintained by the City and for street lights in the public right of way for which the City will pay for electricity and a maintenance fee to Southern California Edison, including parkways, open space and public storm drains constructed within the development and federal NPDES requirements to offset the annual negative fiscal impacts of the project in lieu of creating/annexing into a district. The applicant shall comply with the following mitigation measures, which are set forth in the Mitigation Monitoring & Reporting Program (MMRP) for the (EIR, MND), which was adopted for this project. Commercial / Industrial Projects Standard Conditions of Approval City Council April 24, 2015 Page 22 of 22 GENERAL PLAN GOALS AND POLICIES CONDITIONS OF APPROVAL CONSISTENCY WITH THE LAKE ELSINORE GENERAL PLAN The Lake Elsinore General Plan update was approved by the City Council on December 13, 2011. The City's General Plan contains the mandatory seven elements including land use, circulation, housing, open space, conservation, noise and safety. The Municipal Code and California Environmental Quality Act (CEQA) authorize staff, the Planning Commission and City Council to implement appropriate conditions of approval consistent with the General Plan. In addition, CEQA review identifies potential project impacts and mitigation measures to reduce impacts to insignificant levels. Following are the General Plan Goals and Policies: CHAPTER 2.0 — COMMUNITY FORM (Land Use, Circulation, Housing) 2.3.4 Land Use Goal 1: Create a diverse and integrated balance of residential, commercial, industrial, recreational, public and open space land uses. Policies 1.1 Promote innovative site design, and encourage the preservation of unique natural features, such as steep slopes, watercourses, canyons, ridgelines, rock formations, and open space with recreational opportunities. 1.2 Encourage development of unified or clustered community -level and neighborhood -level commercial centers and discourage development of strip commercial uses. 1.3 Encourage the development of sit-down restaurant establishments where appropriate and discourage the proliferation of drive-through fast food establishments. 1.4 Encourage development of a mix of industrial uses including light industrial, clean manufacturing, technology, research and development, medium industrial, and extractive uses. 1.5 Encourage the development of large planned industrial and / or professional office parks on large parcels. Goal 2: Establish and maintain the City as a year-round recreation destination. Policies 2.1 Encourage recreational uses including parks, beaches, marinas, motocross, soaring, skydiving, and a multipurpose trail within the City's rights of way. 2.2 Consider the feasibility and encourage if feasible the development of a new pier near the end of Main Street to connect the lake with the Downtown area. 2.3 Consider the feasibility of development of geothermal resources such as a spa or bathhouse establishment in the Downtown area. 2.4 Continue to evaluate the provision of public access to the lake and open space areas when making land use decisions. 2.5 Encourage a pedestrian circulation route around the lake to improve public access to this amenity. Goal 3: Establish a development pattern that preserves aesthetics and enhances the environmental resources of the City. Policies 3.1 Upon availability of appropriate funding the City shall establish hillside grading standards that address unique natural features and encourage the sensitive treatment of hillsides in the site design and architecture of new construction. 3.2 Encourage new commercial and/or industrial developments incorporate buffers which minimize the impacts of noise, light, visibility, or activity and vehicular traffic on residential uses and MSHCP conservation areas. Policies: 4.1 Encourage the historic registration of potentially significant historic buildings as identifies in Section 4.7 of the General Plan. 4.2 Encourage the preservation, innovative reconstruction, and reuse of historic buildings in and around the Historic District. 4.3 Consider locating additional civic, public, and cultural facilities and encourage both residential and commercial mixed uses, in and around the Main Street Overlay area. 4.4. Encourage the revitalization of the Historic District through the revisions of the Historic Elsinore Architectural Design Guidelines and implementation of the Downtown Master Plan. Goal 5: Promote land use strategies that decrease reliance on automobile use, increase the use of alternative modes of transportation, maximize efficiency of urban services provision and reduce emissions of greenhouse gas emissions, as detailed in the Climate Action Plan. 2.4.4 Circulation Goal 6: Optimize the efficiency and safety of the transportation system within the City of Lake Elsinore. Policies 6.1 The interconnection and coordination of traffic signals shall be achieved through two processes, namely the requirements in the conditions of approval on development projects and/or through the implementation of Capital Improvement Projects. 6.2 Enforce and comply with property intersection "sight distance" requirements as described by the Engineering Division. 6.3 Maximize the use of shared driveways and on-site circulation to minimize conflicts at access points to the roadway network. 6.4 Maintain the system of bike lanes and multi use trails throughout the City. Encourage the implementation of the network of Class I, II, and Items in bold directly relate to Conditions of Approval. GENERAL PLAN GOALS AND POLICIES CONDITIONS OF APPROVAL CONSISTENCY WITH THE LAKE ELSINORE GENERAL PLAN Page 4 of 18 III bike lanes on all development projects through construction of the facility as described in the Bike Lane Master Plan and/or the Trails Master Plan. 6.5 The City will monitor traffic and congestion on Grand Avenue and Corydon Street through the review of project specific traffic studies, and applying mitigation measures to ensure that projected traffic does not exceed daily capacities as new development occurs in the area. 6.6 As appropriate, coordinate City improvements with the efforts of the County and adjacent cities that provides a circulation network which moves people and good efficiently to and from the City. 2.5.2 Growth Management Goal 7: Maintain orderly, efficient patterns of growth that enhance the quality of life for the residents of Lake Elsinore. Policy 7.1 Encourage mixed-use developments to reduce public service costs and environmental impacts through compatible land use relationships, and efficient circulation and open space systems. 2.7.3 Parks and Recreation Goal 8: Maintain an adequate quantity, quality, type and distribution of parks and recreation facilities throughout the City that serve the current and future needs of residents and visitors. Policies 8.1 Continue to utilize the City of Lake Elsinore Parks and Recreation Master Plan as a guide for decision-making and implementation of the Parks and Recreation Program. 8.2 Ensure parkland and recreation facilities support new development through acquisition and / or dedication. Meet the requirement of the Park Capital Improvement Fund, Resolution No. 91-42 and the Quimby Act by acquiring five (5) acres of useable park land per 1,000 population. 8.3 Explore the use of public-private partnerships, corporate sponsorships, and leasing agreements that provide for additional parks and recreational facilities, and other programs including cooperation with applicable school districts to allow joint use of facilities. GENERAL PLAN GOALS AND POLICIES CONDITIONS OF APPROVAL CONSISTENCY WITH THE LAKE ELSINORE GENERAL PLAN Page 5 of 18 8.4 Consider the addition of a centralize forum for community activities such as a convention center, amphitheater, cultural arts center, or waterfront promenade. 8.5 Continue to develop public beach lands and recreational facilities such as campgrounds, boat launch areas, and water access to the Diamond Stadium, to complement the state and county recreation system. 8.6 Encourage the development of private recreational facilities within residential and mixed-use developments. 8.7 Ensure that recreation facilities are accessible to the elderly, children, and persons with disabilities as set forth in the Americans with Disabilities Act including increased wheelchair access, height variations on drinking fountains, and any other requirements necessary to serve these individuals. CHAPTER 3.0 — SAFETY AND WELFARE (Public Safety, Noise) 3.2.3 Air Quality Goal 1: Continue to coordinate with the Air Quality Management District and the City's Building Department to reduce the amount of fugitive dust that is emitted into the atmosphere from unpaved areas, parking lots, and construction sites. Policy 1.1 Continue to implement requirements identified in the National Pollutant Discharge Elimination System (NPDES). Goal 2: Work with regional and state governments to develop effective mitigation measures to improve air quality. Policies 2.1 Support the SCAQMD in its development of improved ambient air quality monitoring capabilities and establishment of standards, thresholds, and rules to address, and where necessary to mitigat4e, the air quality impacts of new development. 2.2 Support programs that educate the public about regional air quality issues, opportunities and solutions. 2.3 Evaluate the purchase of alternative fuel vehicles for official City vehicles. 3.3.3 Hazards and Hazardous Materials Items in bold directly relate to Conditions of Approval. Policies 3.1 Continue to require hazardous waste generators to implement a waste reduction program per the Riverside County Hazardous Waste Management Plan with necessary inspections per the Riverside County Hazardous Materials Handlers Program. 3.2 Require any proposed development within close proximity to an active and / or inactive landfill to complete a technical analysis that focuses on public safety and hazard issues. The analysis shall be prepared by a professional consultant. 3.3 Encourage the safe disposal of hazardous materials with County agencies to protect the City against a hazardous materials incident. 3.4 Continue operating household hazardous waste education and collection programs in collaboration with the Riverside County Department of Environmental health. 3.5 Evaluate new development on or adjacent to the Santa Ana Regional Interceptor (SARI) line requiring extensive subsurface components or containing sensitive land uses such as schools on a project -by -project basis to determine impacts if an accident occurs. 3.4.1 Wildfire Hazards Goal 4: Adhere to an integrated approach to minimizing the threat of wildland fires to protect life and property using pre -fire management, suppression, and post -fire management. Policies 4.1 Require on-going brush clearance and establish low fuel landscaping policies to reduce combustible vegetation along the urban / wildland interface boundary. 4.2 Create fuel modification zones around development within high hazard areas by thinning or clearing combustible vegetation within 100 feet of buildings and structures. GENERAL PLAN GOALS AND POLICIES CONDITIONS OF APPROVAL CONSISTENCY WITH THE LAKE ELSINORE GENERAL PLAN Page 7 of 18 The fuel modification zone may be replanted with fire-resistant material for aesthetics and erosion control. 4.3 Establish fire resistant building techniques for new development such as non-combustible wall surfacing materials, fire -retardant treated wood, heavy timber construction, glazing, enclosed materials and features, insulation without paper -facing, and automatic fire sprinklers. 4.4 Encourage programs that educate citizens about the threat of human wildfire origination from residential practices such as outdoor barbeques and from highway use such as cigarette littering. 3.5.1 Flooding and Floodplains Goal 5: Minimize risk of injury to residents and visitors, and property damage due to flooding. Policies 5.1 Continue to ensure that new construction in floodways and floodplains conforms to all applicable provisions of the National Flood Insurance Program in order to protect buildings and property from flooding. 5.2 Utilize the Capital Improvement Program for storm drainage projects and maintenance and improvement of location storm drain systems including channels, pipes, and inlets to ensure capacity for maximum runoff flows. 3.6.3 Seismic Activity Goal 6: Minimize the rise of loss of life, injury, property damage, and economic and social displacement due to seismic and geological hazards resulting from earthquakes and geological constraints. Policies: 6.1 Encourage the pursuit of federal and state programs that assist in the seismic upgrading of buildings to meet building and safety codes. 6.2 Continue to require Alquist-Priolo and other seismic analyses be conducted for new development to identify the potential for ground shaking, liquefaction, slope failure, seismically induced landslides, expansion and settlement of soils, and other related geologic hazards for areas of new development in accordance with the Fault Rupture Hazard Overlay District adopted by the City of Lake Elsinore Zoning Code. Policies 7.1 Apply the noise standards set forth in the Lake Elsinore Noise and Land Use Compatibility Matrix (see Table 3-1) and Interior and Exterior Noise Standards (see Table 3-2) when considering all new development and redevelopment proposed within the City. 7.2 Require that mixed-use structures and areas be designed to prevent transfer of noise and vibration from commercial areas to residential areas. 7.3 Strive to reduce the effect of transportation noise on the 1-15. 7.4 Consider estimated roadway noise contours based upon Figure 3.6, Noise Contours, when making land use design decisions along busy roadways throughout the City. 3.8.2 Fire and Police / Law Enforcement Goal 8: Provide efficient and effective public safety services for the community. Policies 8.1 Continue to follow Riverside County Fire Department most current guidelines to achieve standard response times and staffing levels. 8.2 Coordinate with the County of Riverside to provide adequate police service and staffing levels. 8.3 Continue to provide Lake Patrol personnel who enforce boating rules and regulations, and perform rescue tactics. 3.8.4 Schools Goal 9: Encourage all school districts serving Lake Elsinore to provide school facilities that are adequate to serve all students. Policies 11.1 Continue to foster and participate in the operation of a regional animal control facility through participation in the South Western Communities Financing Authority. 11.2 Continue to develop an educational program in conjunction with Animal Friends of the Valley regarding animal control services, including spay and neuter programs. 3.8.10 Utilities Goal 12: Ensure that adequate electrical, natural gas and telecommunications systems are provided to meet the demand of new and existing development. Policies 12.1 Coordinate with the utility agencies to provide for the continued maintenance, development and expansion of electricity, natural gas, and telecommunications systems to serve residents and businesses. 12.2 Encourage developers to contact Southern California Edison early in their planning process, especially for large-scale residential and non- residential development or specific plans, to ensure the projected electric loads for these projects are factored into SCE's load forecasts for the community. Policies 13.1 Request the City's franchise trash hauler(s) to establish long-term solid waste management plans that include goals for recycling and source reduction programs. 13.2 Request that the City's franchise trash hauler(s) provide a public education program in recycling and source reduction techniques for homes, businesses, and construction. 3.8.14 Telecommunications Goal 14: Encourage the pursuit of state of the art Information Technology Policies 14.1 Encourage the use of information technology as a communication tool to improve personal convenience, reduce dependency on nonrenewable resources, take advantage of ecological and financial efficiencies of new technologies. 14.2 Maintain and update the City's website with information about current events and issues, key leadership figures, community involvement opportunities, and educational tools such as solid waste management techniques and emergency preparedness programs. RESOURCE PROTECTION & PRESERVATION (Conservation, Open Space) 4.2.1 Biological Resources Goal 1: Identify and conserve important biological habitats where feasible while balancing the economic growth and private property right interests of the City, its residents, and landowners. GENERAL PLAN GOALS AND POLICIES CONDITIONS OF APPROVAL CONSISTENCY WITH THE LAKE ELSINORE GENERAL PLAN Page 11 of 18 Policies 1.1 The City shall continue to participate in the Western Riverside County Multiple Species Conservation Plan, the LEAPS program, and the Implementing Agreement; with a strategy that focuses on quality assemblage of conservation acreage. The City shall work toward the lower end of the conservation acreage range as promised by the County during the adoption of the MSHCP by City. 1.2 Evaluate the installation of barrier fencing or other buffers between MSHCP Conservation Areas and proposed public and private land uses that may be incompatible with the Conservation Areas in order to minimize illegal / unauthorized public access, domestic animal predation, or dumping in the Conservation Areas while not impeding wildlife movement. 1.3 The City's Conceptual Reserve Design shall be developed in accordance with Section 3.2.3 of the MSHCP as amended, and may rely upon the flexibility permitted by the MSHCP where appropriate in conducting the Reserve Assembly Accounting set forth in Section 6.7 of the MSHCP. 1.4 Encourage revegetation with native plants compatible with natural surrounding habitat where soils have been disturbed during construction, and discourage plants identify in the MSHCP as unsuitable for conservation areas. 1.5 The City shall coordinate with the Regional Conservation Authority to have that agency acquire native habitat areas as permanent open space and allow public trail access where appropriate. 1.6 The City shall establish a plan for a trail network intended for active or passive use within public open space areas and traversing around and through MSHCP Conservation areas where compatible with guidelines set forth in the MSHCP and City Council MSHCP policies. 1.7 The City shall require all new trails, trailheads, conservation signage, interpretive centers, and maintenance facilities established within MSHCP Conservation areas to follow the Guidelines for the Siting and Design of Trails and Facilities, as set forth in Section 7.4.2 of the MSHCP. 1.8 The City shall consult with the Regional Conservation Authority (RCA) and adjacent jurisdictions to ensure proper adherence to MSHCP guidelines and to allow for a maximum level of regional interconnection of trails systems. The City shall reduce modify or add to the regional interconnections and linkages based on new biological analysis brought forward during the CEQA and LEAP processes. GENERAL PLAN GOALS AND POLICIES CONDITIONS OF APPROVAL CONSISTENCY WITH THE LAKE ELSINORE GENERAL PLAN Page 12 of 18 Goal 2: Protect sensitive plant and wildlife species residing or occurring within the City. Policies 2.1 Biological resources analysis of proposed projects shall include discussion of potential impacts to any plant or wildlife species that is officially listed as threatened or endangered by the United States Fish and Wildlife Service and / or the California Department of Fish and Game but not covered by the MSHCP. 2.2 Development or modification shall be discouraged in areas containing riparian habitat of high functions and values or corridors within 80% or more of natural native habitat that link larger patches of natural native habitat containing 80% or more native plant species. Further, development in areas described for conservation, including areas planned for riparian / riverine restoration included in the MSHCP, shall also be discouraged. 2.3 The City shall encourage the development of a Native Tree Planting and Maintenance Program that presents guidelines, for selecting and locating trees to support wildlife, improve air quality, and reduce energy consumption. 4.3.4 Open Space Goal 3: Provide an open space layout within the City that will enhance the recreational and visual experiences of all City residents and visitors. Policies 3.1 Maximize the MSHCP conservation areas and other open space that is available for public use. 3.2 The City shall ensure that passive and active open space uses are incorporated into development areas. 3.3 Development on steep slopes in public or private property shall require contour grading. 3.4 Preserve the City's visual character, in particular the surrounding hillsides, which topographically define the lake region. 4.4.3 Water Resources Goal 4: Improve water quality and ensure that water supply is not degraded as a result of urbanization of the City. GENERAL PLAN GOALS AND POLICIES CONDITIONS OF APPROVAL CONSISTENCY WITH THE LAKE ELSINORE GENERAL PLAN Page 13 of 18 Policies 4.1 Encourage developers to provide clean water systems that reduce pollutants being discharged into the drainage system to the maximum extent feasible and meet required federal National Pollutant Discharge Elimination System (NPDES) standards. 4.2 Support public education and awareness programs to reduce pollutant discharges into the drainage system. 4.3 Require Best Management Practices through project conditions of approval for development to meet Federal NPDES permit requirements. 4.4 The City shall utilize the 1998 North American Vertical Datum to be consistent with the national standard for mean sea level, which would increase the measure of the mean seal level for Lake Elsinore approximately 2.4 feet. 4.5.3 Mineral Resources Goal 5: Balance the importance of conserving mineral resource areas that have been determined to be significant, the need for extracted materials for local construction, and the potential impacts and conflicts that may result. Policies 5.1 The City shall consider the public benefits in allowing extraction activities of mineral resources when making land use decisions. 5.2 The City shall require mined property to be left in a condition suitable for reuse in conformance with the General Plan land use designations and the California Surface Mining and Reclamation Act (SMARA). 5.3 The City shall encourage the reuse and recycling of existing aggregate construction material for new residential, commercial and industrial development. 4.6.8 Cultural and Paleontological Resources Goal 6: Preserve, protect, and promote the cultural heritage of the City and surrounding region for the education and enjoyment of all City residents and Items in bold directly relate to Conditions of Approval. Policies 6.1 Encourage the preservation of significant archeological, historical, and other cultural resources lucated within the City. 6.2 The City shall consult with the appropriate Native American tribes for projects identified under SB 18 (Traditional Tribal Cultural Places). 6.3 When significant cultural / archeological sites or artifacts are discovered on a site, coordination with professional archeologists, relevant state and, if applicable, federal agencies, and the appropriate Native American tribes regarding preservation of sites or professional retrieval and preservation of artifacts or by other means of protection, prior to development of the site shall be required. Because ceremonial items and items of cultural patrimony reflect traditional religious beliefs and practices, developers shall waive any and all claims to ownership and agree to return all Native American ceremonial items and items of cultural patrimony that may be found on a project site to the appropriate tribe for treatment. It is understood by all parties that unless otherwise required by law, the site of any reburial of Native American human remains or cultural artifacts shall not be disclosed and shall not be governed by public disclosure requirements of the California Public Records Act. 6.4 If archeological excavations are recommended on a project site, the City shall require that all such investigations include Native American consultation, which shall occur prior to project approval. Goal 7: Support state-of-the-art research designs and analytical approaches to archeological and cultural resource investigations while also acknowledging the traditional knowledge and experience of the Native American tribes regarding Native American culture. Policies 7.1 Consult with California Native American tribes prior to decision- making processes for the purpose of preserving cultural places located on land within the City's jurisdiction that may be affected by the proposed plan, in accordance with State or Federal requirements. 7.2 Continue to identify, document, evaluate, designate, and preserve the cultural resources in the City. GENERAL PLAN GOALS AND POLICIES CONDITIONS OF APPROVAL CONSISTENCY WITH THE LAKE ELSINORE GENERAL PLAN Page 15 of 18 7.3 Continue to update a citywide inventory of cultural resources in conformance with state standards and procedures while maintaining the confidentiality of information as required by law. 7.4 Support the permanent curation of archaeological artifact collections by universities or museums or appropriate tribal facilities. 7.5 Increase opportunities for cultural heritage tourism by promoting the history of Lake Elsinore to attract cultural heritage travelers while maintaining the confidentiality of Native American sites, places and other information as required by law. Goal 8: Preserve paleontological resources occurring within the City. Policy 8.1 For development in areas delineated as "High" or "Undetermined" potential sensitivity for paleontological resources, require the project applicant to hire a certified paleontologist, who must perform a literature search and / or survey and apply the relevant treatment for the site as recommended by the Society for Vertebrate Paleontology. 4.7.3 Historical Preservation Goal 9: Assure the recognition of the City's heritage through preservation of the City's significant historical sites and structures. Policies 9.1 Require the developer to obtain a professional, qualified historian to conduct a literature search and / or survey for any project that entails demolition or modification of an existing structure that may be of historical value in relation to the City's cultural heritage. 9.2 Apply the General Plan "Historic Elsinore Design Standards" to the Lake Elsinore historic district, as defined in the City zoning ordinance. 9.3 Work with the Lake Elsinore Historical Society to create and periodically update a historic register of structures and other landmarks valuable to the cultural heritage to the City. 9.4 Where historic structures that do not possess a meaningful association with the immediate surroundings are identified within the City, the City shall consider allowing relocation of the structure to an appropriate site. Policies 10.1 Continue to implement the Historic Preservation Guidelines that guide historic presefvaliun effoils as set forth in the Historic Elsinore Design Guidelines and Downtown Master Plan. 10.2 Integrate historic and cultural resources in land use planning processes where feasible to avoid conflict between the preservation of historic resources and alternative land uses. 10.3 All City -owned sites designated as historical resources should be maintained in a manner that is consistent with the U.S. Secretary of the Interior's Standards for the Treatment of Historic Properties. 10.4 Encourage owners of historic resources to utilize federal incentives includi9ng Federal Rehabilitation Tax Credits, fagade and conservation easements, and to coordinate with the State Historic Preservation Office. 4.8.3 Aesthetics Goal 11: Provide and maintain a natural and built environment that is visually pleasing to City residents and visitors. Policies 11.1 For new developments and redevelopment, encourage the maintenance and incorporation of existing mature trees and other substantial vegetation on the site, whether naturally -occurring or planted, into the landscape design. 11.2 Maintain and improve the quality of existing landscaping in parkways, parks, civic facilities, rights -of -ways, and other public open areas. 11.3 Where appropriate, encourage new planting of native and / or non-invasive ornamental plants to enhance the scenic setting of public and private lands. 11.4 Incorporate the City's identification symbol into street signage, planters, benches, public buildings, City vehicles, streetscape furnishings, and other appropriate applications. 11.5 Support a high level of Code Enforcement to encourage neighborhood beautification and to maintain property values and quality of life. Goal 12: Preserve valued public views throughout the City. Policies 12.1 Encourage development designs and concepts that provide public views of Lake Elsinore and local ridgelines through proper siting, building design, and landscape design. 12.2 Encourage the dedication of open space land in hillside development proposals to preserve and enhance view opportunities from transportation corridors and surrounding development. 12.3 Encourage new development and redevelopment to incorporate views of Lake Elsinore from roadways and other public spaces that provide residents and tourists with scenic vistas to the water, marinas, and lakeshore activities. 12.4 Establish a series of City and community gateways and entry statements to promote the visual character of Districts. 12.5 Consider petitioning Caltrans to take control of portions of the SR -74 corridor, in order to promote signage and landscaping that enhance and preserve the corridor's aesthetic setting. Goal 13: Minimize activities, development, and landform modification that could distract viewers from the City's visual character. Policies 13.1 Discourage extractive activity from being conducted in highly visible areas and require reclamation of these mining areas. If such uses must occur in visible areas, the City shall require extensive visual screening with landscaping and / or fencing. 13.2 Discourage extractive uses or development that entails excessive light and glare visible from private and public viewpoints. 13.3 Require grading plans for any hillside development to include specifications for re -vegetation and new planting to minimize hillside scarring.
