Tuesday, January 17, 2017
CALL TO ORDER
A Regular meeting of the Planning Commission of the City of Lake Elsinore was held in the Cultural
Center, 185 North Main Street, on the above date. The meeting was called to order at 6.05 p.m. by Vice
Chair Gray.
PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Commissioner Carroll.
ROLL CALL
Present: Commissioners Carroll, Gray, Ross and Klaarenbeek.
Absent: Chairman Armit
PUBLIC COMMENTS - NON AGENDIZED ITEMS - 3 MINUTES
There were no members of the public appearing to speak.
CONSENT CALENDAR ITEM(S)
1) Approval of Minutes - November 17th and December 6, 2016
It was moved by Commissioner Ross, seconded by Commissioner Carroll, and carried to approve
meeting minutes.
PUBLIC HEARING ITEM(S)
2) Wvroc Materials. lnc - A Hearinq to Discuss the lssuance of an Order to Complv
The Public Hearing was opened at 6:20 p.m. There were no conflict of lnterest disclosures.
Administrative Clerk Wells affirmed receipt of Proof of Publication and noted that no correspondence
had been received.
Principal Planner Kirk presented the staff report.
Ed Sauls appeared on behalf of Ron Clark, a perspective purchaser for the property. He had a few
question for the Planning Commission and Staff with regards to process and get a better understanding
so he could help the perspective purchaser consider moving forward.
City Attorney David Mann explained the process to Mr. Sauls.

There were no members of the public appearing to comment.
The Public Hearing was declared closed at 6:36pm. There was no further discussion regarding this
project.
It was moved by Commissioner Carroll, seconded by Commissioner Klaarenbeek and unanimously
carried, noting the absence of Chairman Armit, to direct staff to monitor compliance and enforce an
Order to Comply to Wyroc Materials, lnc, ordering the commencement of corrective activities and
completion of all outstanding violations, including the imposition of administrative penalties.
3) Planninq Application No. 2016-91 - A Request for the Construction of a 1.350 Sq. Ft.
Detached RV Garaoe for an Existinq Sinqle-Familv Home Near the lntersection of Wavfarer
Court and Lincoln Street (APN. 389-570-013).
The Public Hearing was opened at 6:37 p.m. Commissioner Carroll disclosed that he is a friend of the
applicant. Carroll stated he walked the applicant into City Hall to meet Principal Planner Kirk.
Administrative Clerk Wells affirmed receipt of Proof of Publication and noted that no correspondence
had been received.
Community Development Technician Justin Poley presented his staff report.
There were no members of the public appearing to comment.
Commissioner Klaarenbeek said that Condition of Approval No. l9b should be cleaned up and
amended to the 2016 Building Code.
Kirk stated that he would do so.
The Applicant did not wish to comment.
There being no further response to Vice-Chair Gray's invitation to speak, the Public Hearing was
declared closed at 6:43 p.m.
It was moved by Commissioner Ross, seconded by Commissioner Klaarenbeek and unanimously
carried, noting the absence of Chairman Armit to, adopt the resolution.
Resolution No. 2017-01 :
ADOPT A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, FINDING THAT PLANNING APPLICATION NO, 2016-91 (RESIDENTIAL DESIGN
REVIEW NO, 2016-19 (MINOR DESIGN REVIEW) IS CONSISTENT WITH THE WESTERN
RIVERSIDE COUNTY MULTIPLE SPECIES HABITAT CONSERVATION PLAN (MSHCP)
It was moved by Commissioner Klaarenbeek, seconded by Commissioner Carroll and unanimously
carried, noting the absence of Chairman Armit, to adopt the resolution .with modified Condition of
Approval No. 19b. to update to the current 2016 Building Code.
Resolution No. 2017-02.
ADOPT A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE,

The Public Hearing was opened at 6:46 p.m. There were no Conflict of lnterest disclosures.

Principal Planner Kirk presented the staff report.
Jorge Perez, a designer working on the project asked the Planning Commission if they had any
questions.
There were no questions from the Commissioner's.
There being no further response to Vice-Chaiis invitation to speak, the Public Hearing was declared

It was moved by Commissioner Ross, seconded by Commissioner Carroll, and unanimously carried
noting the absence of Chairman Armit, to adopt the Resolutions.
Resolution No. 2017-03;

Resolution No. 2017-04:

ESTABLISHMENT OF OUTDOOR DINNING, INCLUDING ALCOHOL SALES LOCATED WITHIN A

Resolution No. 2017-05:
ADOPT A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, APPROVING COMMERCIAL DESIGN REVIEW NO. 2017.01 FOR THE
DEVELOPMENT OF A 2,263 SF OUTDOOR DINNING PATIO AT APN: APNS 374-173-006 AND

5) Planninq Application No. 2016-85 - A Reouest to Construct Two (2) Sinqle Family Residences
(1,664 So. Ft. Each) on Two (2) Lots and to Varv from the Minimum Lot Size Requirement of the
Zone from 6,000 Sq. Ft. To 5.000 Sq. Ft.
The Public Hearing was opened at 6:57 p.m. There were no Conflict of lnterest disclosures.
Administrative Clerk Wells affirmed receipt of Proof of Publication and noted that no correspondence
had been received.

Commissioner Carroll questioned if a six ft. vinyl fence across the front of both yards is normal in a
single family dwelling in the City.
Kirk stated that the fence would have to be set back from the property line, if it was going to be in the
front yard, it would have to be a maximum of a threejoot solid construction, if it is in outside of the
setback area. Kirk stated he would make that a Condition of Approval and he will also meet with the
applicant and clarify the fencing materials are consistent with our Municipal Code.
John Rodgers a Civil Engineer with CLE Engineering in Murrieta was representing the Applicants Raul
Cobian. Rodgers addressed the Commissioner's about the Project and all concerns they had regarding
Fence on the property. He had questions regarding Conditions of Approval.
Commissioner Klaarenbeek provided suggestions for the applicant with regards to the Conditions of
Approval.
Principal Planner Kirk advised the applicant that Planning Staff will work with them to find an equitable
solution to their concerns.
Bruce Robinson spoke on behalf of Bertha Calderon, a resident of Lake Elsinore. Robinson stated that
Calderon had basic concerns and questions about setbacks.
Commissioner's and Staff provided answers for Robinson.
There being no further response to the Vice-Chair's invitation to speak, the Public Hearing was
declared closed at 7:24 p.m.
The Commissioner's discussed the project further.
It was moved by Commissioner Klaarenbeek, seconded by Commissioner Carroll, and unanimously
carried noting the absence of Chairman Armit, to adopt the Resolutions.
Resolution No. 2017-06:

REVIEW) FOR THE CONSTRUCTION OF TWO SINGLE FAMILY RESIDENCES (1,664 SQUARE

Resolution No. 2017-08:
ADOPT RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE,

The Commissioner's discussed the project and all agreed that they liked the Project.
The Applicant did not wish to comment.
There were no members of the public appearing to comment.
There being no further response to the Vice-Charls invitation to speak, the Public Hearing was
declared closed at 7:33 p.m.
It was moved by Commissioner Ross, seconded by Commissioner Carroll, and unanimously carried
noting the absence of Chairman Armit, to adopt the Resolutions. .with modified Condition of Approval
No. 33 & 34 to the current Building Code.
Resolution No. 2017-09.
ADOPT RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE,

CALIFORNIA. ADOPT FINDINGS THAT PLANNING APPLICATION 2016-93 IS CONSISTENT WITH

Resolution No. 2017- 10:

Principal Planner Kirk presented the Staff Report. Kirk stated there was a concern with Condition of
Approval No. 7. He explained that all improvements are to be met prior to the issuance of the first
Certificate of Occupancy to be deleted. Add New Condition No. 32 that states. Prior to the issuance of
the 20th Certificate of Occupancy plans shall be submitted for the private park and construction to
commence prior to the issuance of the 31't Certificate of Occupancy.

8) Review of Commercial Desiqn Review No. 2014-02 - Pursuantto Condition of Approval #1 1a.
Staff Review of the Existrno 4,018 Souare Foot Tent at the Links at Summerlv Golf Course
Located at 29381 Villaqe Parkwav. (APN. 37'l-030-038)
Principal Planner Kirk presented the staff Report. He provided a brief overview of the prolect. He
explained that the 12 issues that were identified on November 16, 2016 jnspection were resolved (with
the exception of one) by the next inspection on January 10,2017. Staff's recommendation is approval
of Commercial Design Review, consistent with original Condition of Approval No. 1 1a, notang the
modified Condition of Approval No. 11a requiring re-inspection at the twelve-month and twenty-four-
month period of time to allow for a total of thirty-six-months.
Applicant Larry Werner spoke regarding repairs on the tent. He explained that the last outstanding

issue on the list will be resolved by the end of next week. The owners are in concurrence with the
twelve-month period. He asked Commissioners if they had concerns or questions.
The Commissioners discussed the Project further.
It was moved by Commissioner Ross, seconded by Commissioner Carroll and unanimously carried,
noting the absence of Chairman Armit, to adopt the resolution.
Resolution No. 2017-1 3:

Principal Planner Kirk stated it is busy, there are a lot of new Projects in the future.

Commissioner's thanked the staff, Community and developers for taking part in the City.
