� Principal Planner Justin Kirk eumnlerized the project. He said the applicant James Lavin was
requesting approval of a variance to permit a encroachment into a required side yard setback
for a proposed 234 square foot addition to an existing 378 square foot single family residence
located at31191 Illinois Dr.
The applicant began demo on the structure prior to the issuance of a building permit. Upon
being noticed by the code division, the applicant came in to obtain a building permit for the
addition. When plans were submitted to Planning for plan check the 15 ft. setback
requirements were not met. The applicant was notified that he needed a Variance approved
for the unparmitted addition in the rear mf the property.
Kirk stated staff is recommending approval Vf this Variance because of the existing
non-conformity not being exceeded and the special circumstance of the lot. Kirk informed
Commissioner's that Staff did get one piece of correspondence due to concerns related to
xiaue| impacts associated with the property. He concluded and asked if there were any
questions.
There was no further discussion.

3) 1D# 16-014 Municipal Code Amendment 2016-01; An amendment to the City Of
Lake Elsinore Municipal Code, Title 17 Zoninq, by updating
Chapters 17.148 Parking; to add commercial developments to be
able deviate from the specified parking standards provided a
parki ig study has been prepared and approved by the Planning
Commission and 17.200 Temporary Uses, to modify the application
period,the addition of the applicability to publically owned land,
and the addition of a Seasonal Ternpora!y Use.
Adopt Resolution No.2V1§- _;A Resolution of the Planning Commission mfthe
City qf Lake Elsinore,California,recommending ou the City Council nf the City nf
Lake Elsinore Approval wf Municipal Code Amendment 2V1G-U1Amending
Chapters 17.148 and 17.2D0of the City of Lake Elsinore Municipal Code.
Kirk summarized the amendment to the City Of Lake Elsinore Municipal Code, Tbka 17
Zoning, by updating Chapters 17-148 Parking; to add commercial developments bzbe able
deviate from the specified parking standards provided o parking study has been prepared and
approved by the Planning Commission and 17.200 Temporary Uses; to modify the application
period, the addition of the applicability tmpub[icoUy owned land, and the addition ofe
Seasonal Temporary Use.
He informed Commissioner's that the Cit/s Municipal Code does not contain any specific
relief mechanism for the reduction in the required parking in commercially zoned properties.
� leaving any deviation to the required parking requirements to be approved by a variance. The
Municipal Code does provide a specific relief mechanism for the reduction in parking in
industrially zoned properties, provided a parking study has been prepared and approved by
the Planning Commission in conjunction with a design review application, The Municipal Code
also specifies the findings that are required to be made in order to approve the parking study.
The proposed code amendment would extend this relief mechanism to commercially zoned
properties by making a separate section. All the required findings would be retained and the
approval of the parking study would still be made hy Planning Commission.
The next proposed amendment was Temporary Uses. This use is to clean up and allow for a
more robust use of the lake areas. The way the current code reads, it talks about on private
property and not publicly owned property. There are circumstances which are owned under
public ownership but through the uses of licensing agreements or written agreements, there is
permitted use of the property, In order to sign off on the use a Temporary Use Permit is
required. When you take a strict application to the code, the application isn't really there for
publicly owned property.

The second part is the standardization of submittal timelines, Processing these applications
can lead into significant impacts without sufficient time to review the application. By adding
additional time to the standard application process would allow the City adequate time to
circulate the application materials internally for review and apply adequate Conditions of
Approval.
The third would be to further the City Council"s goals and objectives of further using the Lake.
The Municipal Code does not have any uses in the code that are permitted,they are all
subject to a Conditional Use Permit. The City would like flexibility to recreational oriented uses
of the lake.
Johnathan Skinner, Director of Community Services introduced himself to Planning
Commission. He said that he worked with Justin Kirk and Grant Taylor with this project.

Motion by Chairman Jordan, second by Commissioner Fleming to Adopt Resolution No.
2016-10: A Resolution of the Planning Commission of the City of Lake Elsinore, California,
recommending to the City Council of the City of Lake Elsinore .Approval of Municipal Code
Amendment 616-01 Amending Chapters 17.148 and 17.200 of the City of Lake Elsinore
Municipal Code.

STAFF COMMENTS
Community Development Director Grant Taylor informed Commissioner's of new the new
72,000-sq. ft. shopping center coming in on Collier and Central and proposals for new projects
in the City.
Principal Planner Dirk said that the City Council elected to make minor modifications
regarding clarification to indoor cultivation for on first reading of the Medical Marijuana
Cultivation Ord. All other provisions of that Ordiance remained in affect.

COMMISSION ERS' COMMENTS
Commissioner Fleming thanked staff for all their hard work and said good night,
Commissioner Cray said there is a greater efficiency and momentum to what is going on,
2016 is off to roaring start. Way to go!
Chairman Jordan said she was happy to see sidewalk repair in areas around the City. She
requested that color renderings for Commercial, Industrial and Residential Design Review be
required when packages are submitted to the City.
