Subject:Execute Purchase Agreement with Miracle Playground Sales for the
purchase of a Vortex Watermark Model-S5 for the Campground
Rehabilitation Project (CIP PROJECT #Z40007)
Recommendations
Approve and Authorize the City Manager to Execute a Purchase Order in the Amount of
$126,965.00 for the purchase of a Vortex Watermark Model S-5 for the RV Resort Rehabilitation
Project (CIP PROJECT #Z40007).
Background
As an additional water feature in the swimming pool area the purchase of the Watermark will
further distinguish the campground project as a destination resort. The Watermark feature will
be installed by the swimming pool contractor in conjunction with the swimming pool build. This
feature will enhance the swimming pool amenity and will also serve as an illuminated sign for all
entering the facility.
Discussion
Vortex U.S.A., headquartered in Texas, was founded in 1995 with the introduction of the first
splash pad. Vortex's provides the splash pad and swimming pool products on a consumer buy
board (National Purchasing Program, NPP)which satisfies the State of California award
contract and procurement requirements. Vortex U.S.A. maintains a regional office in Corona,
California. Miracle Playground Sales represents Vortex for all NPP sales in Southern California
These products have been specifically designed and engineered to pass the highest standards
and facilitate rapid installation and minimize the construction impacts to the surrounding park
areas. It is also, noted the Watermark S-5 in easily incorporated into swimming pool designs
and water park configurations.
Fiscal Impact
The Purchase of the Watermark Model S-5 for the Campground Rehabilitation Project is
included in the Fiscal Year 17/18 –21/22 Capital Improvement Plan (CIP) budget.

equipment be required ahead of scheduled delivery date, additional

applicable. In the event of non-payment, Vortex Aquatic Structures
International reserves the right to cease manufacturing or shipping
until such payments with penalties, if any, is made by the purchaser
with no liability on the part of Vortex Aquatic Structures International.
Should said purchaser fail to make subsequent payments as
required, Vortex Aquatic Structures International shall be entitled to
retain payments previously made as liquidated damages. Storage
fees may apply for orders ready for delivery but the purchaser has
requested a delay in shipment.
Lead Time: Standard lead time of 6-8 weeks for Play Products, 10
weeks for Water Recirculation Equipment and 16 weeks for
Elevations. These times are contingent upon receipt of purchase
order, approved drawings and all applicable color selections
Unloading, storage, installation, fees and permits, taxes,Excludes:
Health Department approval, electrical, site work, surfacing, stamped
drawings, OHSA paper work, anything not specifically included
above.
