RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA APPROVING A SECOND AMENDMENT TO CITY MANAGER
EMPLOYMENT AGREEMENT
Whereas, Chapter 2.04 of the Lake Elsinore Municipal Code provides that the City Manager shall
be appointed by the City Council and shall hold office for and during the pleasure of the City
Council; and,
Whereas, the City Council appointed Grant Yates as City Manager effective November 17, 2012
and, by Resolution No. 2012-050 adopted on November 13, 2012, approved the Employment
Agreement by and between the City of Lake Elsinore and Grant Yates (Employment Agreement);
and,
Whereas, by Resolution No. 2015-074, the City Council approved that certain First Amendment
to the Employment Agreement dated as of July 28, 2015 (First Amendment); and,
Whereas, in accordance with Section 10 of the Employment Agreement and First Amendment
and pursuant to Government Code Sections 54957(b) and 54957.6, the City Manager's
performance review and labor negotiations were conducted by the City Council at the February
27 and March 13, 2018 Closed Session meetings, and
Whereas, the City Council desires to further amend the Employment Agreement to extend the
Term and adjust and/or clarify certain other provisions.
THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY
RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. The City Council hereby approves the attached Second Amendment to City Manager
Employment Agreement in substantially the form presented.
Section 2. The Mayor is hereby authorized to execute the Second Amendment to the City
Manager's Employment Agreement in such final form as approved by the City Council and with
such minor revisions as may be approved by the City Attorney.
Section 3. This Resolution shall take effect from and after the date of its passage and adoption.
Passed and Adopted by the City Council of the City of Lake Elsinore at a regular meeting held
on this 27th day of March 2018.
