Domen, MMC, City Clerk Jason Simpson, Assistant City Manager Date: March 27, 2018 Subject: Compensation for Members of the City Council and Commissioners Recommendation Introduce by title only and waive further reading AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, AMENDING LAKE ELSINORE MUNICIPAL CODE (LEMC) SECTION 2.08.020 COMPENSATION, FOR THE PURPOSE OF INCREASING CITY COUNCIL COMPENSATION; and, Introduce by title only and waive further reading Adopt AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ADDING LAKE ELSINORE MUNICIPAL CODE (LEMC) SECTION 2.46.075 COMPENSATION, FOR THE PURPOSE OF PROVIDING COMPENSATION TO MEMBERS OF THE PUBLIC SAFETY ADVISORY COMMISSION; and, Adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, SETTING THE COMPENSATION AMOUNTS FOR THE PLANNING COMMISSION AND THE PUBLIC SAFETY ADVISORY COMMISSION Background Government Code Section 36516 et seq. allows for: a City Council (Council) to enact an Ordinance setting a salary for members, based on population as determined by the last preceding Federal census, a subsequent census or estimate validated by the Department of Finance. The Salary may be increased by an amount equal to 5 percent for each calendar year from the operative date of the last adjustment. No Ordinance shall be enacted or amended to provide automatic future increases in salary; and, any amounts paid by a city for retirement, health and welfare, and federal social security benefits shall not be included for purposes of determining salary under this section, provided that the same benefits are available and paid by the city for its employees Council compensation was last amended on January 1, 2007, and per Municipal Code Section 2.08.020 Compensation, it is currently set at $400.00 per month. City Council compensation has been adjusted on four times since 1966. Council Member Manos requested that compensation amounts for the City Council and the Commissions be reviewed and presented to the Council for discussion. The item was heard at the Regular meeting of March 13, 2018. During that discussion, Council requested that the City Manager appoint a subcommittee to review the item and bring back a recommendation at the March 27, 2018 City Council meeting. Discussion Compensation: The City of Lake Elsinore’s latest population numbers validated by the Department of Finance are 62,092 and allow for compensation to be set at $500 per month. If the Council were to increase the compensation at the 5% per year since 2007, allowable by statute, the adjustment would be $220 bringing the total stipend to $620 per month. Any increase to compensation would not occur until after the November 2018 election and would become effective in January 2019. Additionally, Council Members may receive compensation of up to $150 per month for any other Boards, Commissions or Authority meetings that they serve as a whole. Compensation does not extend to committees with other authorities or subcommittees. The Authorities that would qualify for this type of compensation are: Public Facilities Financing Authority, Lake Elsinore Facilities Authority, Lake Elsinore Recreation Authority, Public Financing Authority, Parking Authority. Typically, since these meetings don’t occur on a regular monthly basis, compensation is set per meeting. Currently the Council does not receive any additional compensation for these meetings. Provided in Exhibit C is the compensation amounts for the I-15 Corridor Cities. Commissioners The Lake Elsinore Municipal Code Section 2.24.070 authorizes the City Council to set compensation for Planning Commissioners by Resolution. The last time the compensation was adjusted was in 2007. Resolution No. 2007-03 increased the compensation to $100 per meeting with a maximum of 3 meetings per month; and, included the provision of health benefits to the Members. The proposed Resolution will set the compensation to $150 per meeting with a maximum of 2 meetings per month and remove the health benefits. The Public Safety Advisory Commission does not receive any compensation. The second Ordinance attached providesfor the ability to compensate members on this Commission. The proposed Resolution will set the compensation at $100 per meeting with a maximum of one meeting per month. As shown in Exhibit C, the City of Perris is the only other City that pays Commissioners $100.00 per meeting. All other cities are between $50.00 and $75.00. Per the discussion at the last meeting, the Resolution has been prepared in the amounts noted in the discussion. The Council has the right to adjust these amounts prior to the adoption of the Resolution without the item having to be brought back. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES ORDAIN AS FOLLOWS: Section 1: LEMC Section 2.08.020, Compensation, is hereby amended in its entirety, as follows: 2.08.020 Compensation. Members of the City Council shall each receive compensation for their services in the sum $620.00. Section 2: CEQA.This Ordinance is exempt from the California Environmental Quality Act in accordance with Section 15061(b) (3) there is no possibility that the activity in question may have a significant effect on the environment. Section 3: Severability.If any provision of this Ordinance or its application is held invalid by a court of competent jurisdiction, such invalidity shall not affect other provisions, sections, or applications of the Ordinance which can be given effect without the invalid provision or application, and to this end each phrase, section, sentence, or word is declared to be severable. Section 4: Effective Date.This Ordinance shall become effective at 12:01 a.m. on the thirty- first (31st) day after the date of adoption; and, the compensation increase will become effective on January 1, 2019. Section 5: Certification. The City Clerk shall certify to the passage of this Ordinance and shall cause a synopsis of the same to be published according to law. Domen, MMC City Clerk RESOLUTION NO. 2018-___ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, SETTING THE COMPENSATION AMOUNTS FOR THE PLANNING COMMISSION AND THE PUBLIC SAFETY ADVISORY COMMISSION Whereas, pursuant to Lake Elsinore Municipal Code (LEMC) Section 2.24.070 Compensation, Council shall from time to time, by Resolution, fix the compensation of Planning Commissioners; and, Whereas,compensation was set last by Resolution No. 2007-03 on January 9, 2007, in the amount of $100.00 per meeting; and, Whereas, the City Council determined that the Public Safety Advisory Commission should receive compensation. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1:The compensation of the Planning Commission shall be set at $150.00 per meeting attended, with a maximum of two meetings per month. Section 2: The compensation of the Public Safety Advisory Commission shall be set at $100.00 per meeting, with a maximum of one meeting per month. Section 3: The compensation adjustment shall remove any previously granted health benefit provisions or other benefits for Planning Commission members or Public Safety Advisory Commission members and shall take effect immediately upon its adoption. Section 4: This Resolution shall take effect immediately upon its adoption. Section 5:The City Clerk shall certify to the adoption of this Resolution and enter it into the book of original Resolutions. Passed and Adopted on this day of , 2018.
