Subject:Acceptance of Right of Way Quitclaimed by the County of Riverside
Recommendation
It is recommended that the City Council accept the County of Riverside’s conveyance of rights
of way and approve the City Manager to execute a Certificate of Acceptance pursuant to
authority conferred by Resolution No 99-17 of the City Council adopted on March 23, 1999.
Background
On January 24, 2017, the City Council approved resolutions documenting support and consent
for joint relinquishment of Route 74 in conformance to AP 1915 and AB 218. Specifically,
Resolution 2017-011, accepted portions of Route 74 conveyed by the County of Riverside. The
approximately one mile section, between Cambern Avenue and Rachel Way, will complete the
City’s ownership of the full width of right of way from Mauricio Avenue to Dexter Avenue.
Discussion
On June 20, 2017, the County of Riverside, through Resolution Number 2017−127, conveyed to
the City of Lake Elsinore the portion of Route 74 relinquished to the County by the California
Transportation Commission. The section between Cambern Avenue and Rachel Way (more
particularly described as between a point 664.07 feet northeasterly of the centerline of Cambern
Avenue and a point 479.41 feet southwesterly of the centerline Trellis Lane, as measured along
said centerline of Route 74), to remedy the asymmetrical jurisdictional boundary disparity. This
relinquishment and conveyance to the City of Lake Elsinore of the portion of Route 74 with the
jurisdictional boundary disparity, will improve the City’s responsiveness and coordination in land
use planning, construction, maintenance and operational matters, and provide for a more
streamlined approval for adjacent property improvements that affect State Route 74.

Fiscal Impact
Increased costs to the City of Lake Elsinore for highway maintenance and operational services
are expected to result for those portions of relinquished Route 74 R/W adopted into the city
street system pursuant to Streets and Highways Code Section 1806 (b). The City has received
$2,200,000 from Caltrans to help defray the long-term maintenance costs for the entire roadway
section from Mauricio Avenue to Dexter Avenue.

This is to certify that the interest in real property conveyed by the grant deed or grant of
easement deed dated June 20, 2017 from the County of Riverside, to the City of Lake
Elsinore, a municipal corporation and/or governmental agency is hereby accepted by
order of the City of Lake Elsinore, by the undersigned officer or agent on behalf of the
City of Lake Elsinore pursuant to authority conferred by resolution of the City of Lake
Elsinore, Resolution #99-17, adopted on March 23, 1999, and the grantee consents to

RESOLUTION NO. 2017-127
County of Riverside
WHEREAS, on January 31, 2017, the Board of Supervisors ("Board") for the County of
Riverside adopted Resolution Number 2017-018, Minute Order No. 3.22, whereby the Board provided its
notice of intent to support the joint relinquishment to the County of Riverside ("County") and the City of
Lake Elsinore ("City") of a segment of Route 74 by the California Transportation Commission ("CTC")
from Cambern Avenue to Rachel Way;
WHEREAS, a portion of Route 74 relinquished to the County of Riverside results in an
asymmetrical jurisdictional boundary configuration, between Cambern Avenue and Rachel Way ("Subject
Property"), more particularly legally described in Exhibit "A" and shown on Exhibit "B", attached hereto
and by this reference incorporated herein, that would impact the County and the City and create maintenance
and operational disparities between them;
WHEREAS, due to the aforementioned disparities, the County and City have determined
that it would be in the best interest of both parties for the County to convey the Subject Property to the City
WHEREAS, the Board desires to accept, upon recordation of the CTC's relinquishment
resolution, said portion as it relates to this portion of Route 74 jointly relinquished to the County and the
City and immediately convey the Subject Property to the City of Lake Elsinore by Quitclaim Deed;
NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED by the
Board of Supervisors of the County of Riverside ("Board"), in regular session assembled on
2017, at 9:00 a.m., or soon thereafter, in the meeting room of the Board of Supervisors for the County of
Riverside, located on the I" floor of the County Administrative Center, 4080 Lemon Street, Riverside,
California, that this Board:
1. Hereby finds and declares that the above recitals are true and correct and incorporated as though set
forth herein.

2. Hereby finds that conveyance of the Subject Property to the City is in the best interest of the County
and City to avoid the impacts and the creation of maintenance and operational disparities between
the County and City.
3. Hereby accepts the portion of Route 74 jointly relinquished by the CTC to the County of Riverside
and the City of Lake Elsinore located within the City of Lake Elsinore from Cambern Avenue to
Rachel Way, as depicted as "Segment 1" on State Highway Map Book 12, Pages 51 through 58,
inclusive, on Exhibit "C", attached hereto and by this reference incorporated herein and authorizes
the conveyance of said Segment to the City of Lake Elsinore by Quitclaim Deed.
4. Authorizes the Chairman of the Board of Supervisors for the County of Riverside to execute the
Quitclaim Deed on behalf of the County, of said Segment 1 is in Riverside County, California, and
described as follows:
Shown as "Segment 1" by said State Highway Map Book 12, Pages 51 through 58, inclusive,
being that portion of Route 74 more particularly described as between a point 664.07 feet northeasterly of
the centerline of Cambern Avenue and a point 479.41 feet southwesterly of the centerline of Trellis Lane,
as measured along said centerline of Route 74.
