HomeMy WebLinkAboutCC Reso No 2018-031 Vacating Public Utility EasementsRESOLUTION NO. 2018 -031 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, VACATING PUBLIC UTILITY EASEMENTS ON LOTS 37 AND 58 DEDICATED TO THE CITY OF LAKE ELSINORE ON FINAL TRACT MAP 33486. Whereas, Final Tract Map 33486 dedicated to the City of Lake Elsinore (City) for public utility purposes two easements, one each on Lot 37 and Lot 58 of said map, said easements being more particularly described as follows: LOT 37: THAT PORTION OF LOT 37 OF TRACT 33486 IN THE CITY OF LAKE ELSINORE, COUNTY OF RIVERSIDE, STATE OF CLAIFORNIA AS SHOWN BY MAP RECORDED IN BOOK 456 PAGES 41 -47 MAPS OF SAID COUNTY MORE PRECISELY DESCRIBED AS FOLLOWS: A 2.00 FOOT STRIP OF LAND LYING NORTHWESTERLY AND WESTERLY OF THE FOLLOWING DISCRIBED LINE: BEGINNING AT THE SOUTHEAST CORNER OF SAID LOT 37; THENCE NORTH 73 022'29" EAST ALONG THE EASTERLY LINE OF SAID LOT 37 A DISTANCE OF 138.35 FEET; THENCE CONTINUING ALONG THE EASTERLY LINE OF SAID LOT 37 N13 009'55" EAST A DISTANCE OF 9.37 FEET TO THE POINT OF TERMINATION OF SAID LINE. LOT 58: THAT PORTION OF LOT 58 OF TRACT 33486 IN THE CITY OF LAKE ELSINORE, COUNTY OF RIVERSIDE, STATE OF CALIFORNIA AS SHOWN BY MAP RECORDED IN BOOK 456 PAGES 41 -47 MAPS OF SAID COUNTY MORE PRECISELY DESCRIBED AS FOLLOWS: A 2.00 FOOT STRIP OF LAND LYING NORTHERLY AND EASTERLY OF THE FOLLOWING DESCRIBED LINE: BEGINNING AT THE SOUTHEAST CORNER OF THE SAID LOT 58; THENCE SOUTH 86 026'47" WEST ALONG THE EASTERLY LINE OF SAID LOT 58 A DISTANCE OF 178.99 FEET; THENCE CONTINUING ALONG THE WESTERLY LINE OF SAID LOT 58 NORTH 53 007'27" WEST A DISTANCE 11.62 FEET TO THE POINT OF TERMINATION OF SAID LINE. Whereas, the City Council (Council) of the City has determined that those public utility easements are excess, having no public facilities located or anticipated within, and therefore desires to vacate said easements pursuant to the procedures set forth'in Streets and Highways Code Section 8335, et. Seq.; and, CC Reso. No. 2018 -031 Page 2 of 2 Whereas, the vacation is permitted by law under and pursuant to the conditions set forth in Streets and Highways Code Section 8333; and, Whereas, that from and after the date the Resolution is recorded, the public utilities easements vacated no longer constitute a street, highway or public service easement. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE AS FOLLOWS: Section 1. That based on the evidence submitted, the Council hereby finds that the public utility easements described in this Resolution are unnecessary for present and prospective use. Section 2. That the public utilities easement more particularly described above are hereby ordered to be vacated. Section 3. That the City Clerk is hereby ordered to record the Resolution of Vacation in the Riverside County Recorder's Office. Section 4. This Resolution shall take effect immediately upon its adoption.
