Domen, City Clerk Date:May 23, 2017 Subject:Declaring the Results of the Special Municipal Election on Measure A, Held on May 2nd, 2017 Recommendation adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECITING THE FACTS OF THE SPECIAL MUNICIPAL ELECTION ON MEASURE A, HELD ON MAY 2, 2017, AND DECLARING THE RESULTS Background On June 10, 2016 proponent Dana Mark Coon submitted his Notice of Intent to Circulate a petition and submitted the petition to the City Clerk on October 11, 2016. After conducting a Prima Facie review, the petition was delivered to the Riverside County Registrar of Voters for signature verification on October 12, 2016 and was deemed sufficient. On December 13, 2016, the City Council ordered a report on the impacts to the City. On February 1, 2017, the City Council adopted Resolution No. 2017-18 calling for the Special Municipal Election on Measure A on May 2, 2017, with the following ballot title for the proposed Ordinance: Initiative Measure Revising the Alberhill Villages Specific Plan Governing the Future Development of Approximately 1,400 Acres Located in Northwest Lake Elsinore, South of Interstate 15 and West of Lake Street Discussion On May 2, 2017, in compliance with the Election Code of the State of California, the Special Municipal election was held. The canvass of the election was completed and the election certified by the Riverside County Registrar of Voters on May 11, 2017, with the official results posted the same day. The five-day protest period expires on May 16, 2017, at 5:00 p.m., no protests were received. The certified report of the results of the votes cast in each precinct; as well as the final votes cast; and the number of ballots received per precinct, is attached as Exhibit B. Fiscal Impact The conducting of the election has a fiscal impact of an estimated $83,000 to which an agreement was reached with Castle and Cook to provide $100,000 to cover the costs of the election and staff time; however, the declaration of the results has no impact other than staff time. Exhibit Exhibit A – Resolution Exhibit B – Certification and Statement of Vote RESOLUTION NO. 2017-_____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECITING THE FACTS OF THE SPECIAL MUNICIPAL ELECTION ON MEASURE A, HELD ON MAY 2, 2017, AND DECLARING THE RESULTS Whereas, a Special Municipal Election on Measure A, was held and conducted in the City of Lake Elsinore, California, on Tuesday, May 2, 2017, as required by law; and, Whereas, Notice of the Election was given in time, form and manner, voting precincts were properly established, election officers were appointed and in all respects the election was held and conducted as required by the provisions of the Elections Code of the State of California; and, Whereas, the votes were cast, received and canvassed by the Riverside County Registrar of Voters and the returns made and declared in time, form and manner for the holding of elections in general law cities; and, Whereas, pursuant to Resolution 2017-021 adopted on February 1, 2017, the Riverside County Registrar of Voters canvassed the returns of the election and has certified the results which is attached as Exhibit A to this Resolution. Now, Therefore, the City Council of the City of Lake Elsinore, California, Does Hereby Declare, Determine and Resolve: Section 1. The whole number of votes cast in the precincts for the contest of Measure A an Initiative Measure, excluding Vote-by-Mail ballots and provisional ballots, was 469. The whole number of Vote-by-Mail ballots and provisional ballots cast for the contest of Measure A an Initiative Measure, was 3,336, making a grand total of 3,835 ballots cast in the City. Section 2. The number of votes received in favor of and against are listed below: Initiative Measure Revising the Alberhill Villages Specific Plan Governing the Future Development of Approximately 1,400 Acres Located in Northwest Lake Elsinore, South of Interstate 15 and West of Lake Street Yes 425 No 2,936 Section 3. The City Council does declare and determine that: Measure A an Initiative Measure Revising the Alberhill Villages Specific Plan Governing the Future Development of Approximately 1,400 Acres Located in Northwest Lake Elsinore, South of Interstate 15 and West of Lake Street has failed and said Ordinance is not adopted. Section 4. The City Clerk shall enter on the records of the City Council of the City of Lake Elsinore, a statement of the result of the election showing: (1) the whole number of votes cast in the City; (2) the vote on Measure A. Section 5. The City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions.
