HomeMy WebLinkAboutCC Reso No 2017-133 ELSP Approving General Plan Amendment No. 2016-01RESOLUTION NO. 2017-133 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT (GPA) NO. 2016-01 Whereas, the City of Lake Elsinore (City) initiated GPA No. 2016-01 to amend the General Plan Land Use (GPLU) designation of properties identified as Assessor's Parcel Nos. 370-080-013 and -021 from Specific Plan to Limited Industrial; and to amend the GPLU designation of properties or portions of properties identified as Assessor's Parcel Nos. 363-130-078, -080, -085 and -087; 373-210-018, -030, -032, and -045; 373-300-008, -012 thru -014, -017, and -033 thru - 036; 373-310-001, and -009 thru -012; 373-320-002 thru -007, -014 and -015 from Floodway to Specific Plan; and, Whereas, GPA No. 2016-01 also amends the General Plan's Circulation Element to designate Cereal Street, Lucerne Street and portions of Malaga Road/Sylvester Street as Collector Streets, Stoneman Street as a Collector Street and two additional road segments within the Summerly development as Collector Streets; and, Whereas, Government Code Section 65358 empowers the legislative body to amend all or part of an adopted General Plan (GP) if to do so would be in the public interest and so long as no mandatory element of the GP is amended more frequently than four times during any calendar year; and, Whereas, GPA 2016-01 is part of the City's Second Cycle amendments to the Lake Elsinore GPLU Map and Circulation Element Map for the 2017 calendar year; and, Whereas, pursuant to Government Code Section 65354 the Planning Commission (Commission) of the City has been delegated with the responsibility of reviewing and making recommendations to the City Council (Council) regarding general plan amendments; and, Whereas, on November 7, 2017, at a duly noticed Public Hearing the Commission considered the evidence presented by the Community Development Department and other interested parties with respect to this item, and adopted Commission Resolution No. 2017-95 recommending Council approval of GPA No. 2016-01; and, Whereas, on November 28, 2017, at a duly noticed Public Hearing, the Council has considered the recommendation of the Commission as well as evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The Council has reviewed and analyzed proposed GPA No. 2016-01 pursuant to the California Planning and Zoning Laws (Cal. Gov. Code Sec 65000 et. seq.), the GP and the LEMC and finds that the proposed GPA is consistent with the requirements of California Planning and Zoning Law and with the goals and policies of the LEGP and the LEMC. Section 2. The Council has certified the Final Environmental Impact Report (FEIR) (SCH No. 2016111029) and adopted the Mitigation Measures appertaining thereto. The FEIR was prepared pursuant to Section 15162 of the California Environmental Quality Act (CEQA) Guidelines. Reso No. 2017-133 Page 2 of 7 Appropriate findings were made, and the FEIR provides the necessary environmental clearance for GPA No. 2016-01. Section 3. That in accordance with California Planning and Zoning Law, and the LEMC, the Council makes the following findings for the approval of GPA No. 2016-01: 1. The proposed GPA will not be a) detrimental to the health, safety, comfort or general welfare of the persons residing or working within the neighborhood of the proposed amendment or within the City, or b) injurious to the property or improvements in the neighborhood or within the City. a. The proposed GPA has been analyzed relative to its potential to have detrimental effects; and land uses, designations and regulations have been imposed to ensure that the health, safety and welfare of affected residents will be protected. b. The removal of existing industrial buildings along Corydon Avenue from the boundaries of the East Lake Specific Plan (ELSP) will ensure that all Limited Industrial uses along Corydon Avenue will be treated fairly and equitably. c. The addition of Cereal Street, Lucerne Street and a portion of Malaga Road/Sylvester Street as Collector Streets, Stoneman Street as a Collector Street and two additional road segments within the Summerly development as Collector Streets to the General Plan Circulation Element will ensure that efficient traffic movements occur in the Specific Plan which avoids residential neighborhoods while serving projected land uses. d. The Inlet Channel is currently included in the ELSP and this change in land use designation corrects a mapping error. 2. The proposed GPA would establish a land use density, intensity and usage more in character with the subject property's location, access and constraints. a. Properties adjacent to Assessor's Parcel Nos. 370-080-013 and -021 along Corydon Avenue were developed under the Light Industrial designation of the GP. The proposed GPA will make the two parcels more compatible with adjacent properties. b. The GPA will not affect the flood storage capacity in East Lake, and will not adversely affect natural habitat. c. The change of the Inlet Channel's land use designation from Floodway to Specific Plan will correct a mapping error that was created when the GP was adopted in 2011. 3. In accordance with the requirements of the CEQA, impacts have been reduced to a less than significant level, or in the case where impacts remain, a statement of overriding considerations were adopted to justify the merits of project implementation. a. The effects of the proposed GPA have been analyzed in EIR (SCH 201611029) prepared for ELSP Amendment No. 11 and its related cases, and adequate mitigation measures have been prepared where necessary, and a Statement of Overriding Considerations has been recommended where required. Based upon the evidence presented, both written and testimonial, and the above findings, the Council hereby approves GPA No. 2016-01 and incorporates the following amendments into the GP as shown on the attached Exhibits 1, 2, and 3. a. In accordance with Figure 1; change the General Plan Land Use (GPLU) Map designation from Floodway to Specific Plan for Assessor's Parcel Nos. 363-130-078, -080, -085 and - 087; 373-210-018, -030, -032, and -045; 373-300-008, -012 thru -014, -017, and -033 thru -036; 373-310-001, and -009 thru -012; 373-320-002 thru -007, -014 and -015. b. In accordance with Figure 2; change the GPLU Map designation from Specific Plan to Limited Industrial for Assessor's Parcel Nos. 370-080-013 and -021. c. In accordance with Figure 3; amend the General Plan's Circulation Element to designate Cereal Street, Lucerne Street and portions of Malaga Road/Sylvester Street as Collector Streets, Stoneman Street as a Collector Street and two additional road segments within the Summerly development as Collector Streets. Section 5. This Resolution shall take effect immediately upon its adoption. Section 6. The City Clerk shall certify to the adoption of this Resolution and enter it into the original book of Resolutions. Passed and Adopted on this 28th day of November 2017, by the following vote.
