EXTRIA11; City of Lake Elsinore Meeting Minutes City Council Tuesday, July 25, 2017 Call to Order A Regular meeting of the Council of the City of Lake Elsinore was held in the Cultural Center, 183 North Main Street, on the above date. The meeting was called to order at 5:01 p.m. by Mayor Magee, with all Members present. There being no Members of the public appearing to speak, the meeting recessed at 5:02 p.m. to Closed Session. City Council Closed Session 1) CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION Initiation of litigation pursuant to paragraph (4) of subdivision (d) of Section 54956.9: (3 potential cases) 2) CONFERENCE WITH LABOR NEGOTIATOR (Gov't Code Section 54957.6) City negotiator: City Manager Grant Yates Employee organization: Lake Elsinore Chapter of Laborer's International Union of North America, Local 777 Reconvened The meeting reconvened at 7:01 p.m. Pledge of Allegiance The Pledge of Allegiance was led by Mayor Magee. Invocation — Moment of Silence Mayor Magee requested a moment of silence. Roll Call Present: Council Members /Members Hickman, Manos and Tisdale; Mayor Pro TemNice -Chair Jonson and May /Chair Magee Absent: None Presentations / Ceremonials 1) Business of the Quarter - 2nd Quarter 2017 Mayor Magee presented the Business of the Quarter award to CR &R Environmental Services employees, Alex Braicovich and Nicole Moore. Page 1 2) Citizen of the Quarter - 2nd Quarter 2017 Mayor Magee presented the Citizen of the Quarter award to Grace Sandlin. Closed Session Report City Attorney Leibold listed the items discussed by Council and stated there was nothing to report. Public Comments Non- Apendized Items Appearing to speak were: Ace Vallejos, Glen Hodges and Paulie Tehrani. Consent Calendar It was moved by Council Member Manos, seconded Mayor Pro Tern Johnson, and unanimously carried, to approve the Consent Calendar. Item No. 5 was pulled for discussion and is listed below. 1) Warrant Llist Dated July 13, 2017 — received and filed. 2) Investment Report for June 2017 — received and filed. 3) Minutes of the Joint Meeting of July 11, 2017 — approved. 4) City Voting Delegate for the 2017 League of California Cities Annual Conference LOCO — appointed Council Member Manos as the City's Voting Delegate and Mayor Pro Tern Johnson as the Alternate Voting Delegate, for the conference to be held September 13 -15, 2017, in Sacramento. 6) Waived further reading and adopted by title only AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE CALIFORNIA APPROVING OF ZONE CHANGE NO. 2014 -02 TO ZONE ASSESSOR PARCEL NUMBERS 349- 250 -013 AND 349 -250 -015 AS HILLSIDE RESIDENTIAL AND ASSESSOR PA_ RCEL NUMBERS 349 - 250 -014 AND 349 - 250 -016 AS R2 MEDIUM DENSITY RESIDENTIAL Items Removed from the Consent Calendar 5) Transfer of APN 377 -292 -027 as a General Fund Real Property Asset to an Affordable Housing Asset of Fund 106 In Exchange for $26,000.00 Appearing to speak was: Ace Vallejos. It was moved by Council Member Manos, seconded by Council Member Hickman, and unanimously carried to adopt the Resolution. Resolution No. 2017 -091 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING THE TRANSFER OF APN 377 - 292 -027 AS A GENERAL FUND REAL PROPERTY ASSET TO AN AFFORDABLE HOUSING ASSET OF FUND 106 IN EXCHANGE FOR $26,000.00 Page 2 Public Hearin s 7) Extension of Time for Tentative Tract Map No. 33140: Fred Matian: Tripod Investments, LLC The Public Hearing was opened at 7:13 p.m. There were no Conflict of Interest disclosures to report. City Clerk Domen affirmed receipt of Proof of Publication; that the complete file of exhibits, correspondence and other documentation were on file; and, noted that one piece correspondence had been received. Community Development Director Taylor presented a Power Point presentation. Civil Engineer Imad Aboujawdah, Applicant's Representative, noted that they had worked with staff for a year revising the map, they are aware of revised conditions and agree to them. There were no members of the Public appearing to speak. There being no further discussion, the Public Hearing was closed at 7:18 p.m. It was moved by Council Member Tisdale, seconded by Council Member Manos, and unanimously carried, to adopt the Resolution. Resolution No. 2017 -092 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING A SIX YEAR EXTENSION OF TIME TO JULY 14, 2023, FOR TENTATIVE TRACT MAP NO. 33140 8) Public Hearing and Election for Change Proceedings for Community Facilities District (CFD) No. 2007 -4 Makenna Court The Public Hearing was opened at 7:19 p.m. There were no Conflict of Interest disclosures. City Clerk Domen affirmed receipt of Proof of Publication; that the complete file of exhibits, correspondence and other documentation were on file; and, noted that zero pieces of correspondence had been received. Assistant City Manager Simpson introduced Brian Forbath from Stradling Attorneys at Law, who provided the Staff Report. There were no members of the Public appearing to speak. City Clerk Domen affirmed that no written protests from any registered voters or landowners of more than 50 percent of the acreage located within Community Facilities District No. 2007 -4 were received. There being no further discussion, the Public Hearing was closed at 7:23 p.m. It was moved by Council Member Manos, seconded by Mayor Pro Tem Johnson, and unanimously carried, to adopt the Resolution. Resolution No. 2017 -093 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ACTING AS THE LEGISLATIVE BODY OF THE CITY OF LAKE ELSINORE COMMUNITY FACILITES DISTRICT NO. 2007 -4 (MAKENNA COURT), APPROVING A SECOND AMENDMENT TO THE RATE AND METHOD OF APPORTIONMENT, AND CALLING AN ELECTION THEREIN Page 3 City Clerk Domen called the Election; announced all ballots were cast; and the Election closed for the purpose of a Second Amendment to the Rate and Method of Apportionment for Community Facilities District No. 2007 -4 (Makenna Court). Clerk Domen then announced the ballot proposition was approved by more than two - thirds of the votes cast. It was moved by Council Member Manos, seconded by Council Member Hickman, and unanimously carried, to adopt the Resolution. Resolution No. 2017 -094 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ACTING AS THE LEGISLATIVE BODY OF THE CITY OF LAKE ELSINORE COMMUNITY FACILITES DISTRICT NO. 2007 -4 (MAKENNA COURT), CERTIFYING THE RESULTS OF THE JULY 25, 2017 SPECIAL ELECTION It was moved by Mayor Pro Tem Johnson, seconded by Council Member Manos, and carried unanimously, to introduce by title only and waive further reading of the Ordinance. Ordinance AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ACTING AS THE LEGISLATIVE BODY OF THE CITY OF LAKE ELSINORE COMMUNITY FACILITES DISTRICT NO. 2007 -4 (MAKENNA COURT), AUTORIZING THE LEVY OF A SPECIAL TAX WITHIN SUCH DISTRICT 9) Approve Placing Delinquent Nuisance Abatement Charges on the Tax Roll The Public Hearing was opened at 7:25 p.m. There were no Conflict of Interest disclosures. City Clerk Domen affirmed receipt of Proof of Publication; that the complete file of exhibits, correspondence and other documentation were on file; and, noted that zero pieces of correspondence had been received. Assistant City Manager Simpson provided the Staff Report. There were no members of the Public appearing to speak. There being no further discussion, the Public Hearing was closed at 7:28 p.m. It was moved Council Member Manos, seconded by Mayor Pro Tern Johnson, and unanimously carried, to adopt the Resolution. Resolution No. 2017 -095 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ORDERING CONFIRMATION OF THE SPECIAL ASSESSMENTS AGAINST PARCELS OF LAND WITHIN THE PUBLIC NUISANCE ABATEMENT COSTS FOR THE FISCAL YEAR 2017 -18 Business Item 10) Community Facilities District No. 2015 -5 (Trieste), Issuance of Special Tax Bonds, Series 2017 Brian Forbath from Stradling Attorneys at Law, provided the Staff Report. There were no members of the Public appearing to speak. Page 4 It was moved by Council Member Tisdale, seconded Mayor Pro Tern Johnson, and unanimously carried to adopt the Resolution. Resolution No. 2017 -096 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ACTING AS THE LEGISLATIVE BODY OF COMMUNITY FACILITIES DISTRICT NO. 2015 -5 OF THE CITY OF LAKE ELSINORE (TRIESTE) AUTHORIZING THE ISSUANCE OF ITS SPECIAL TAX BONDS, SERIES 2017 IN A PRINCIPAL AMOUNT NOT TO EXCEED TWO MILLION SEVEN HUNDRED THOUSAND DOLLARS ($2,700,000) AND APPROVING CERTAIN DOCUMENTS AND TAKING CERTAIN OTHER ACTIONS IN CONNECTION THEREWITH Public Comments — Non -A endized (Items Appearing to speak was: Kelly Soto. City Council Members Comments Council Member Manos announced the "Get Your Play On" Park and Recreation Month events, the car cruises on Main street to be held on July 29th, August 26th and September 30th and Adult Softball League season starts August 27tH Council Member Hickman reminded everyone that the Riverside Transit Agency buses are 25 cents for students through September 4th; announced National Night Out at Lakepoint Park on August 1St; and, noted his concerns for the homeless situation. Council Member Tisdale announced the Women Veterans Networking Event to be held on August 15th; provided an update on the Lake Elsinore Homeless Task Force; provided Responsible Compassion Tip #3 "Do treat homeless with respect and dignity." Council Member Manos announced that on July 21St, nine -year old resident, Megan Crum, broke the age world record in track and field. Mayor Pro Tern Johnson provided an additional update on the Homeless Task Force on the business side and signage; announced that Earl Warren Elementary School 5th grader, Chuckie McDonald is going to the Junior Olympics; thanked everyone for reaching out to the Council and encouraged everyone to keep communicating; and, wished Assistant City Manager Simpson a happy birthday. Mayor Magee reported he attended the Lake Elsinore Senior Center Grand Re- Opening and Family Day; announced that KTLA will be featuring Lake Elsinore in their New Roads to Destinations segments and the Chevy dealers of Southern California used Lake Elsinore as backdrop for their commercial; commented on the homeless and that the City needs to continue to protect its public space and practice responsible compassion; and, reminded everyone if they see something say something.
