The meeting was called to order at 6:00 p.m. by Mayor Magee, with all Members present. There being no members of the public appearing to speak, the meeting recessed at 6:01 p.m. to Closed Session. City Council Closed Session 1) CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION Significant exposure to litigation pursuant to paragraph (2) of subdivision (d) of Gov't Code Section 54956.9: 1 potential case 2) CONFERENCE WITH LEGAL COUNSEL - INITIATION OF LITIGATION pursuant to paragraph (4) of subdivision (d) of Section 54956.9: 1 potential case Reconvene The meeting reconvened at 7:00 p.m. Pledge of Allegiance The Pledge of Allegiance was led by Mayor Magee. Invocation — Moment of Silence Mayor Magee requested a moment of silence. Roll Call Present: Council Members Hickman, Manos and Tisdale; Mayor Pro Tern Johnson and Mayor Magee Absent: None Presentations / Ceremonials 1) Proclamation for National Public Works Week, May 21 st — 27th — Public Works Superintendent De Santiago explained Public Works Week; thanked staff for all that they do for the community; and, invited the Council and residents to the annual barbecue. 2) Recognition to Explorer of the Year, Ashley Cockcroft — The recipient was unable to attend. 3) Recognition of Community Services Officer Roxann Baca — The recipient was unable to attend. Page 1 Closed Session Report City Attorney Leibold listed the items discussed by Council and reported that on Item No. 2, the Council affirmed the City's request for Pardee's status in the pending Southern California Edison application for the Ivy Glen Alberhill Project; and, noted that Community Development Director Taylor will provide a project status update at the May 23rd meeting. Public Comments — Non- Agendized Items Appearing to comment were: Ace Vallejos, Ken Crawford and Bentley Brown Consent Calendar It was moved by Council Member Manos, seconded by Mayor Pro Tern Johnson, and unanimously carried, to approve the Consent Calendar. 1) Warrant List Dated April 27, 2017 — received and filed. 2) Minutes of the Regular Meeting of April 25, 2017 — approved. 3) Professional Services Agreement (PSA) for the Auto Center Drive Bridge Condition Assessment — authorized the City Manager to execute the PSA in the amount of $59,831.00 with NV5. 4) Pyro Spectaculars Inc. Agreement for the 4'" of July Firework Show — waived Lake Elsinore Municipal Code 3.08.070F, Exception to Bid Procedures; and, authorized the City Manager to execute the agreement in an amount not to exceed $52,000.00. 5) Emergency Repair Construction Agreement with NPG Asphalt for Street Repairs at 410 West Graham Avenue — adopted the Resolution. Resolution No. 2017 -056 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DECLARING AND FINDING THAT THE PUBLIC INTEREST AND NECESSITY DEMAND THE IMMEDIATE PROCUREMENT AND AWARD OF A CONSTRUCTION CONTRACT TO PERFORM EMERGENCY ASPHALT PAVING REPAIRS AT FIRE STATION NO. 10 AND AWARD CONTRACT TO NPG INC. IN AN AMOUNT NOT TO EXCEED $44,000.00 Business Items) 6) Preliminary Capital Improvement Plan (CIP) Budget for Fiscal Years 2017 -18 to 2021 -22 Assistant City Manager Simpson presented a Power Point presentation. Mayor Magee announced that the City received an email from the Lake Elsinore Valley Chamber of Commerce. There were no members of the Public appearing to speak. Assistant City Manager Simpson responded to questions from the Council regarding proposed projects. Mayor Pro Tern Johnson requested pavement management updates be provided at the next Council meeting. City Manager Yates stated that staff is preparing the plan and will provide to the Page 2 Council and place on the City's website this summer. Mayor Magee requested quarterly pavement management updates be provided. It was moved by Council Member Manos, seconded by Mayor Pro Tern Johnson, and unanimously carried, to receive and file the Preliminary CIP. 7) Amending Penalties for Violations of the Municipal Code, Lake Use Regulations, and Parking Regulations; and Establish Civil Fines and Penalties for Violations of Lake Use Regulations Senior Management Analyst Dailey presented a Power Point presentation. Appearing to speak were: Bentley Brown and Garret Brown, and William Johnson Management Analyst Dailey responded to questions from the Council. It was moved by Mayor Pro Tern Johnson, seconded by Council Member Manos, and unanimously carried, to waive further reading and introduce by title only the Ordinances. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, AMENDING AND RESTATING CHAPTER 1.16, SECTIONS 10 AND 40 OF THE LAKE ELSINORE MUNICIPAL CODE REGARDING VIOLATIONS; and, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, AMENDING CHAPTER 9.96, SECTIONS 40, 180, AND 210, AND ADDING SECTIONS 290, 300, 310, AND 320 OF THE LAKE ELSINORE MUNICIPAL CODE REGARDING LAKE USE REGULATIONS; and, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, AMENDING CHAPTER 10.12, SECTIONS 20, 25, AND 140, AND ADDING SECTIONS 160 AND 170 OF THE LAKE ELSINORE MUNICIPAL CODE REGARDING PARKING REGULATIONS. It was moved by Mayor Pro Tern Johnson, seconded by Council Member Manos, and unanimously carried, to adopt the Resolution. Resolution No. 2017 -057 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ESTABLISHING CIVIL FINES AND PENALTIES FOR VIOLATIONS OF LAKE USE REGULATIONS Recess /Reconvene The meeting recessed to the Successor Agency at 8:35 p.m. and reconvened at 8:35 p.m. with all Members present. Public Comments — Non - Agendized Items Appearing to speak were: Bentley Brown and Garrett Brown. City Manager Comments City Manager Yates introduced Community Development Director Taylor who provided an update on the construction traffic in Alberhill Ranch. Page 3 City Manager Yates stated that the Special Election held last Tuesday was a significant day for the City and thanked the residents and everyone who helped to defeat it. City Council Comments Council Member Manos reported that he attended the Southern California Association of Governments conference and was appointed a Regional Council Representative; announced the Lambs Fellowship 3rtl Annual Car and Motorcycle Show will be on May 20th; and, stated that 83 percent of the voters voted against the measure and this is a turning point for the City. Council Member Hickman echoed the sentiment regarding the election; announced that the Time Capsule Reburial ceremony will be on May 1211 and the Special Olympics will be on May 12th; invited everyone to come downtown at night and visit the new restaurants; and, announced the Riverside Transit Agency has 25 cents bus passes for students during the summer. Council Member Tisdale thanked everyone for Measure A; reported that he, Council Member Manos and the City Manager attended the Board of Supervisors meeting regarding the fire station at Canyon Lake; requested that when the contract is renewed, Fire Station Nos. 97 and 94 only service the City as a first response; provided an update on the homeless cleanups and requested to form a task force; and, announced the Healthy LE Holistic Wellness Fair will be on May 201h and the Memorial Day Service will be on May 29th. Mayor Pro Tern Johnson stated that she wants to serve on the Homeless Task Force; thanked Assistant City Manager Simpson and the team for the CIP budget presentation and the Lake Elsinore Valley Chamber of Commerce for leading the charge against Measure A; reported she attended the Lake Elsinore Valley Chamber of Commerce Student of the Year Awards; noted that the Central Plaza and Artisan Alley projects are under construction; and, thanked staff for their work on the Lake Use Violations Ordinances. Mayor Magee appointed Council Member Tisdale and Mayor Pro Tern Johnson to the Homeless Task Force; thanked the Lake Elsinore Valley Chamber of Commerce for their work in defeating Measure A; and, announced the annual Pet Walk will be on May 13th at the levee, the Serenity Park BMX Track and Dog Park ribbon cutting will be on May 24th, and the April photo contest winner is Lauren Zelinski. Adjournment The meeting adjourned at 9:05 p.m. to Tuesday, May 23, 2017, at 7:00 p.m. in the Cultural Center located at 183 N. Main Street, Lake Elsinore. Robert E. ee an M.
