Domen, City Clerk Date:December 13, 2016 Subject:Declaring The Results of the General Municipal Election Held on November 8th, 2016 Recommendation adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DECLARING THE RESULTS OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2016 Background On June 28, 2016, the City Council adopted Resolution No. 2016-78 calling for the General Municipal Election of November 8, 2016. Following is a list of candidates who qualified for the ballot, in ballot order: City Council (3 Seats) Edwin Castro Steve Martin Steve Manos Bob Magee Natasha Johnson City Treasurer (1 Seat) Allen P. Baldwin Discussion On November 8, 2016, in compliance with the Election Code of the State of California, the General Municipal election was held. The canvass of the election was completed and the election certified by the Riverside County Registrar of Voters on December 6, 2016, with the official results posted the same day. The five-day protest period expires on December 12, 2016, at 5:00 p.m. and at the time of the writing of this report, no protests were received. The certified report of the results of the votes cast in each precinct; as well as the final votes cast for each of the candidates; and the number of ballots received per precinct, is attached to the resolution as Exhibit A. The summary indicates the following results: General Municipal Election Page 2 The summary indicates the following results for City Council: Edwin Castro (3,129 votes); Steve Martin (5,324 votes); Steve Manos (8,472 votes); Bob Magee (7,649 votes); Natasha Johnson (7,586 votes). Steve Manos, Bob Magee and Natasha Johnson received the highest number of votes and are therefore, declared to be duly and regularly elected to said office for a full term of four years. The results for City Treasurer are: Allen P. Baldwin (11,851 votes), being the only candidate who qualified for the ballot is therefore, duly and regularly elected to said office for a full term of four years. Fiscal Impact The conducting of the election has a fiscal impact that was previously budgeted; however, the declaration of the results has no impact other than staff time. Exhibit Exhibit A – Resolution RESOLUTION NO. 2016-_____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECITING THE FACTS OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2016, AND DECLARING THE RESULTS AND SUCH OTHER MATTERS AS MAY BE PROVIDED BY LAW Whereas, a General Municipal Election was held and conducted in the City of Lake Elsinore, California, on Tuesday, November 8, 2016, as required by law; and, Whereas, Notice of the Election was given in time, form and manner, voting precincts were properly established, election officers were appointed and in all respects the election was held and conducted as required by the provisions of the Elections Code of the State of California; and, Whereas, the votes were cast, received and canvassed by the Riverside County Registrar of Voters and the returns made and declared in time, form and manner for the holding of elections in general law cities; and, Whereas, pursuant to Resolution 2016-80 adopted on June 28, 2016, the Riverside County Registrar of Voters canvassed the returns of the election and has certified the results which is attached as Exhibit A to this Resolution. Now, Therefore, the City Council of the City of Lake Elsinore, California, Does Hereby Declare, Determine and Resolve: Section 1. The whole number of votes cast in the precincts for the contest of Member of the City Council and City Treasurer, excluding Vote-by-Mail ballots and provisional ballots, was 7,161. The whole number of Vote-by-Mail ballots and provisional ballots cast for the contest of Member of the City Council and City Treasurer was 11,165, making a grand total of 18,326 ballots cast in the City. Section 2. The names of persons voted for at the election for Member of the City Council and City Treasurer, and the number of votes received by each person are as follows: Council Member (3 seats)Election Results Edwin Castro 3,129 Steve Martin 5,324 Steve Manos 8,472 Bob Magee 7,649 Natasha Johnson 7,586 City Treasurer (1 Seat) Allen P. Baldwin 11,851 Section 3. The City Council does declare and determine that: Steve Manos, Bob Magee and Natasha Johnson were re-elected as Members of the City Council for the full term of four years each beginning in December of 2016. Section 4. The City Clerk shall enter on the records of the City Council of the City of Lake Elsinore, a statement of the result of the election showing: (1) the whole number of votes cast in the City; (2) the names of the persons voted for; (3) for what office each person was voted for. The City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated and that the City Clerk shall cause to be administered to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the Office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. Section 8. The City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions. Passed, and Adopted on this 13th day of December, 2016.
