HomeMy WebLinkAbout0003_2_Larimer Design Architect - 1st Amendment Professional Services Agmt 2014AMENDMENT NO. 1 TO AGREEMENT BETWEEN SUCCESSOR AGENCY OF THE REDEVELOPMENT AGENCY OF THE CITY OF LAKE ELSINORE AND LARIMER DESIGN ARCHITECT DIAMOND STADIUM SEATING AMENDMENT NO. 1 is made and entered into as of October 25, 2016 by and between the City of Lake Elsinore, a municipal corporation (‘‘City") and Larimer Design Architect. ("Consultant"). In consideration of the mutual covenants and conditions set forth herein, the parties agree as follows: 1. This Amendment No. 1 is made with the respect to the following facts and purposes: A. On August 1, 2016, the City and Consultant entered into that certain agreement entitled “Agreement for Professional Services” (the “Original Agreement”). The Original Agreement as amended by this Amendment No. 1 is hereafter referred to as the “Agreement”. B. City desires to retain Consultant to perform additional services as provided herein and Consultant desires to provide such professional services as set forth in this Agreement. C. Consultant possesses the skill, experience, ability, background, certification and knowledge to perform such additional services. 2. Section 1. Scope of Work of the Agreement is amended to read as follows: Consultant shall perform the services described in Consultant’s proposal (Exhibit A) and such additional services described in Exhibit A-1. Consultant shall provide such services at the time, place, and in the manner specified in Consultant’s Proposal (Exhibit A) and the additional scope of work (Exhibit A-1), subject to the direction of the City through its staff that it may provide from time to time. 3. Section 3. Compensation of the Agreement is hereby amended to read as follows: Compensation to be paid to Consultant shall be in accordance with the fees set forth in Consultants’ Proposal (Exhibit A) and shall be increased by Seventy-Seven Thousand Three Hundred Seventy-Five Dollars and No Cents ($77,375.00) for additional services described in Exhibit A-1. In no event shall Consultant’s total compensation exceed One Hundred Seven Thousand, Three Hundred Seventy-Five Dollars and No Cents ($107,375.00). Notwithstanding any provision of Consultant’s Proposal to the contrary, out of pocket expenses shall be reimbursed at cost without an inflator or administrative charge. Payment by City under this Agreement shall not be deemed a waiver of defects, even if such defects were known to the City at the time of payment. 4. Exhibit A-1. Additional Services. Exhibit A-1 is attached hereto and incorporated by reference herein and made a part of the Agreement. DESIGN DEVELOPMENT Preliminary code check and review of Agency requirements. Prepare Design Development documents, including: site plan, site accessibility plan, site egress plan, demolition plan, floor plan, reflected ceiling plan, exterior elevations, building sections, interior elevations, door schedules, and preliminary construction details. CONSTRUCTION DOCUMENTS Prepare Construction Documents, including: title sheet / project information; site plan; site egress plan; site accessibility plan; demolition plan; floor plan; reflected ceiling plan; exterior elevations; building sections; wall sections; interior elevations; door schedules; construction de ails, and finish plans. Prepare Project Specifications, as required. Coordinate preparation of Consultants’ Construction Documents, details, calculations and specifications, as required for plan check submission to the Building Department. GOVERNMENTAL PROCESSING City of Lake Elsinore Building Department Prepare and submit Plan Check Submittal documents to local Building Department. Review Building Department Plan Check issues with Client and Design Team; prepare response to Plan Check issues. Coordinate refinement of Plan Check Resubmission documents. Attend Plan Check Cycle Review meetings with Building Department Staff to clear Plan Check Issues, finalize plan check process and prepare plans for building permit issuance. This Amendment Amount:$77,375.00
