After reviewing your letter with the City Council, the City has the following comments regarding the points you listed: The City agrees to condition any development of the Werner property for the extension of EI Toro Road, contiguous to the development site, with the purpose of providing a direct course of travel from Temescal Canyon High School to Nichols Road. 2. The City agrees that there will be free public access to any recreational uses developed on the "Bow Tie" properties by the developer and that such facilities will be available for the use of the residents of the Warm Springs community on the same terms as City residents. 3. The City agrees that if the City of Lake Elsinore decides to break away from contracting with the County for police and fire, the City of Lake Elsinore would agree to provide police and fire services to the Warm Springs community. 4. The City agrees to enter into a Memorandum of Understanding (MOU) documenting that if and when the mine site develops (an estimated 20 years) that the City will process to completion an annexation application through LAFCO for annexation of the Warm Springs community. The MOU shall include a provision that should the annexation fail due to landowner and/or registered voter protest; that the City has met its obligation regarding annexation of the Warm Springs Community. 951.674.3124 130 S. The City agrees to work with the County to develop a comprehensive annexation plan for unincorporated land within the City's sphere of influence at the County's expense. The City requests that County agree that it will not impede completion of the Nichols Road Annexation (2015- 07-1; Annexation 83) or the Summit Annexation (2016-04-1; Annexation 84) which are currently being processed by LAFCO; while the comprehensive annexation plan is being prepared. 6. The City agrees that the agreement between the City and the County shall include the County's commitment to continue our partnership leading towards the completion of the EI Toro Ethanac Expressway (Nichols Road extension); which includes having the County continue to take the lead as the project moves forward with such issues as right-of-way, environmental clearances, correcting historic drainage issues (natural and man-made) and agreeing to work with the City on the creation of an Enhanced Infrastructure Financing District (EIFD) to help fund the project. 7. On August 26, 2016, the Lake Elsinore City Council requested the County to work with the City and the current residents of Warm Springs in a number of areas. The City Council, in making these recommendations, understands the County has limited fiscal resources and many of these can be accomplished by working with the City as we move forward. The provisions include: a. In the future, the County shall review its General Plan's Land Use Element to consider changes to the land use designations within the Warm Springs community to reflect the ultimate highest and best uses along the EI Toro Ethanac Expressway (Nichols Road extension), Highway 74 and Interstate 15. The County will agree to work with the City in identifying appropriate land uses and will consider the City's suggestions in its proposed General Plan Amendment. The City will commit to process an amendment of its General Plan to mirror the County's revised Land Use Plan for the Warm Springs community. Following adoption of its revised Land Use Plan, the County will bring the zoning in the Warm Springs community into conformance with the new land use designations. b. The County will work with the Riverside County Flood Control and Water Conservation District to proactively correct the drainage issues that hinder economic development in the Warm Springs community. c. The County Transportation Department will seek creative ways to address needed road improvements within the Warm Springs community. The County will agree to have its Economic Development Agency partner with the City to bring economic development to the Warm Springs community, especially along Highway 74 and in the future along the EI Toro Ethanac Expressway (Nichols Road extension); including the elimination of "road blocks" to economic development within this area. e. Where the MSHCP HANS process is required, the County will agree to the best of its ability to streamline that process for any future development within the Warm Springs community in order to expedite economic development within the area. We look forward to finalizing an agreement with you, so we can proceed to the LAFCO hearing on the Nichols Road Annexation at the earliest opportunity.
