Subject:Approve and Authorize the Executive Director to Purchase Replacement
Stadium Seating from American Seating
Recommendation
Staff recommends that the Successor Agency Board waive the formal bidding process per
Municipal Code Sections 3.08.070 (C) and (G) for the purchase, removal and installation of
replacement seating at the Lake Elsinore Diamond Stadium and approve and authorize the
Executive Director to execute a Purchase Agreement with American Seating in the not to
exceed amount of $823,075.00 in the form attached and in such final form as approved by the
Agency Counsel.
Background
After 23 years the Diamond Stadium seating has reached its useful life. Many of the seats at
Diamond Stadium are unrepairable and repair parts are not available. Staff in collaboration with
Storm management has performed research on various stadium seating options and
determined the American Seating product is superior in many ways to the competition. Also, it
shall be noted American Seating is available for purchase on the California Municipal Awards
Schedule (CMAS) program. The CMAS offers a wide variety of commodities and general
products and services at prices which have been assessed to be fair, reasonable and
competitive under pre-advertised and negotiated contracts. The use of these contracts is
optional and is available to California State and Local Government Agencies. This purchase will
provide the removal and disposal of 5,500 old stadium seats, and complete installation of new
stadium seats. Any benefit or remuneration from the recycling of the existing seating will be
deposited into a Stadium Capital Reserve account to offset other capital improvement costs.
Discussion
After working closely with Lake Elsinore Storm Staff and receiving informal pricing from other
seating manufactures it has been determined the pricing, quality, and availability of repair parts
is superior with the American Seating product. Special consideration will also be taken to
facilitate improved spectating utilizing visually redirected standards and incorporating group
areas into a revised seating design. A major part of this project will include ADA seating and

accessibility, and blend sporting observation and social gathering areas. American Seating will
be assisting with the design of these spectating features.
Pursuant to Sections 3.08.070(C) and (G) of the Municipal Code, bidding procedures do not
apply when the commodity can be obtained through a cooperative purchasing program devoted
to local government procurement such as CMAS and when waiving competitive bidding
requirements is in the best interests of the City/Successor Agency. The benefits of participating
in the CMAS program and beneficial pricing combined with the superior quality, availability of
repair parts and expertise in ADA compliance, design and installation are in the best interests of
the City, Successor Agency and the public.
Fiscal Impact
Diamond Stadium Replacement Seating Project is included in the Fiscal Year 16/17 – 20/21
Capital Improvement Plan (CIP) budget. The contract amount herein is fully funded with ROPS
funding. The attached quote is based upon 4,500 seats, however, we are removing 5,500 seats
until we finalize the layout and changes required for the seating plan to also meet American with
Disabilities Act (ADA) requirements. Staff requires the 4,500 now in order to meet deadlines for
the 2017 baseball season because of the necessary timeline required for fabrication of the seats
with American Seating, but staff is expecting to require the additional 1,000 seats for a total of
5,500 seats. As such, the quote is based upon a quantity of 4,500 but the unit price is firm and
has been adjusted to the contract requested amount based upon quantities needed.
