SUBJECT: Amendment to Transportation Uniform Mitigation Fee Regional
Arterial Agreement with RCTC for the Railroad Canyon Road at
Interstate 15 Interchange Project
Recommendation
That the City Council approve Agreement No. 10-72-016-05, Amendment No. 5 to
Agreement No. 10-72-016-00, with Riverside County Transportation Commission
(RCTC) for the Railroad Canyon Road/Interstate 15 interchange project, authorizing an
additional $350,000 in Transportation Uniform Mitigation Fee (TUMF) funds to complete
the Project Approval and Environmental Document (PA&ED) phase, which would adjust
the PA&ED budget to a maximum of $2,555,000.
Background
The Railroad Canyon Road and I-15 Interchange is a significant regional transportation
corridor, serving the cities of Lake Elsinore, Menifee, Canyon Lake and the County of
Riverside. Due to the continuous growth in the area, this interchange has caused
increased traffic congestion and unnecessary delays for travelers. The current design
can no longer adequately serve the Region.
In 2010, the City, along with the design consultant and Caltrans began studying more
than 28 improvement alternatives for this interchange. The review team sought to select
an alternative that would adequately address current and projected growth, while
meeting Caltrans design standards.
In October 2013, the City requested that RCTC reinitiate the project approval and
environmental design (PA&ED) phase of the I-15/Railroad Canyon Road Interchange
Project. In December 2013, RCTC approved the City’s request and they authorized
additional funding to update the Environmental and Civil studies to meet Caltrans
requirements.
In April 2016, Amendment No. 4 was executed between the City and RCTC to allocate
$2,000,000 of TUMF Regional Fund toward project final design and $2,600,000 toward
Right-of-Way acquisition.

Discussion
The proposed Amendment No. 5 would enable the project PA&ED to move forward to
completion. The proposed additional funding allocation of $350,000 would go toward
the following: RCTC staff time currently managing this project, which is estimated to
cost $85,500, $34,500 in additional project contingency, and $230,000 toward
engineering and environmental consulting services.
The proposed Amendment No. 5 would increase the total PA&ED funding appropriation
to $2,555,000, which is still below the proposed TUMF funding estimate.
In an effort to recover some of the lost time due to the extensive review process, RCTC
in coordination with the City, will be advertising the Plans, Specification and Estimates
(PS&E) Consultant Selection prior to final approval of PA&ED. This approach would
enable the final design to start immediately after the final approval of PA&ED, and save
approximately three months in the project schedule.
Fiscal Impact
This action does not have any additional fiscal impact. Funds to complete the PA&ED,
Phase 1 final design and right-of-way acquisition have already been allocated from the
TUMF Regional and Zone funding. No additional local matching funds are required to
complete the PA&ED, Phase 1 design and right-of-way acquisition.

AMENDMENT NO. 5
TO AGREEMENT FOR THE FUNDING OF TUMF REGIONAL ARTERIAL
IMPROVEMENTS WITH THE CITY OF LAKE ELSINORE FOR THE RAILROAD
CANYON ROAD AT I-15 IMPROVEMENTS
1. PARTIES AND DATE
This Amendment No. 5 is made and entered into as of this ______ day of
___________, 2016, by and between the RIVERSIDE COUNTY TRANSPORTATION
COMMISSION (“Commission”) and CITY OF LAKE ELSINORE ("City").
2. RECITALS
2.1 The Commission and the City have entered into an agreement entitled
"Agreement for the Funding of TUMF Regional Arterial Improvements with
the City of Lake Elsinore" dated February 4, 2010 (the "Master
Agreement"). The Master Agreement provides the terms and conditions,
scope of work, schedule and funding amount for the Project Approval and
Environmental Document ("PA&ED") Phase related to the Railroad
Canyon Road at the I-15 Improvements Project (hereinafter the "Project").
The Project is more specifically described in Exhibit "B" of the Master
Agreement.
2.2 The Commission and the City have entered into an Amendment No. 1 to
the Master Agreement, dated June 6, 2011, (“Amendment No. 1”) for the
purpose of increasing the Funding Amount and assuming the City's
existing professional services agreement with SC Engineering for the
PA&ED services for the Project.
2.3 The Commission and the City have entered into an Amendment No. 2 to
the Master Agreement, dated December 19, 2013, (“Amendment No. 2”)
for the purpose of increasing the Funding Amount and assuming the City's
existing professional services agreement with SC Engineering for the
PA&ED services for the Project.
2.4 The Commission and the City have entered into an Amendment No. 3 to
the Master Agreement, dated July 15, 2014, (“Amendment No. 3”) for the
purpose of providing additional TUMF funding for the completion of the
PA&ED Phase of the Project.

2.5 The Commission and the City have entered into an Amendment No. 4 to
the Master Agreement, dated April 12, 2016 (“Amendment No. 4”) for the
purpose of providing additional TUMF funding for design and right of way
related services for the Project.
2.6 The parties now desire to amend the Master Agreement in order to
provide additional TUMF funding for the completion of the PA/ED Phase of
the Project.
3. TERMS
3.1 The Funding Amount, as set forth in Section 3.2 of the Master Agreement,
as amended by Amendment No. 4, shall be increased from Six Million
Eight Hundred Five Thousand Dollars ($6,805,000) to Seven Million One
Hundred Fifty Five Thousand Dollars (7,155,000).
3.2 The funding allocations identified in Exhibit "A" of the Master Agreement
shall be replaced by the funding allocations identified in Exhibit "A"
attached to this Amendment and incorporated herein by reference. The
Funding Amount shall be utilized as specified in the attached Exhibit "A"
and in accordance with the terms of the Master Agreement.
3.3 Except as amended by this Amendment, all provisions of the Master
Agreement, as amended by Amendment Nos. 1, 2, 3 and 4, including
without limitation the indemnity and insurance provisions, shall remain in
full force and effect and shall govern the actions of the parties under this
Amendment.
