A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 2012-06 FOR THE ESTABLISHMENT OF A SIX SPACE PRIVATE CAMPGROUND, BOAT
LAUNCH, AND 15 BERTH BOAT DOCK LOCATED AT APN: 381-040-005
WHEREAS, Larry Markham of MDMG on behalf of John Gamble (the “Applicant”) has requested approval of Conditional Use Permit 2012-06 for the establishment of a six space private camp ground,
boat launch, and a 15 slip boat dock (the “Project”); and
WHEREAS, Chapter 17.168 of the Lake Elsinore Municipal Code (LEMC) provides that certain uses have operational characteristics that, depending on the location and design of the use,
may have the potential to negatively impact adjoining properties, businesses or residents and therefore are permitted subject to the issuance of a Conditional Use Permit, which allows
the City to comprehensively review and approve the use; and
WHEREAS, pursuant to LEMC Chapter 17.168 (Conditional Use Permits) the Planning Commission of the City of Lake Elsinore has been delegated with the responsibility of reviewing and approving,
conditionally approving, or denying conditional use permits; and
WHEREAS, on August 16, 2016, at a duly noticed public hearing, the Planning Commission has considered evidence presented by the Community Development Department and other interested
parties with respect to this item.
WHEREAS, pursuant to Section 17.168 (Conditional Use Permits) of the Lake Elsinore Municipal Code (“LEMC”) the City Council of the City of Lake Elsinore has the responsibility of making
decisions to approve, modify or disapprove recommendations of the Planning Commission for Conditional Use Permit applications; and
WHEREAS, on August 23, 2016, at a duly noticed public meeting, the City Council has considered the recommendation of the Planning Commission as well as evidence presented by the Community
Development Department and other interested parties with respect to this item.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The Planning Commission has considered Conditional Use Permit No. 2012-06 for the Beach Resort prior to making a decision and has found it acceptable.
SECTION 2. On August 23, 2016, after consideration and evaluation of all written reports and comments and oral testimony presented by the Community Development Department and other
City departments, property owners, residents and other interested parties and such other matters as are reflected in the record of the noticed public hearing
