CITY OF LAKE ELSINORE AND
AP CONSTRUCTION GROUP INC.
For the DIAMOND STADIUM HVAC PROJECT
CIP PROJECT NO. RDA Z20003
THIS SECOND AMENDMENT is made and entered into as of May 31, 2016 by and between
SUCCESSOR AGENCY OF THE REDEVELOPMENT AGENCY OF THE CITY OF LAKE
ELSINORE, a municipal corporation (‘‘Agency") Maples and Associates ("Contractor"). In
consideration of the mutual covenants and conditions set forth herein, the parties agree as
follows:
1. This Amendment is made with respect to the following facts and purposes:
a. On December 1, 2015, the Agency and Contractor entered into an agreement entitled
“Consultant Services Agreement for Public Works Construction AP Construction Group
Inc. for the Diamond Stadium HVAC Project.
b. On March 8, 2016, a first amendment was approved in the amount of forty-eight
thousand one hundred thirty-seven dollars and ninety-five cents ($48,137.95) to upsize
the HVAC units in the private suites.
c. The parties now desire to increase the agreement amount for an additional twenty seven
thousand five hundred twenty one dollars and eighty seven cents ($27,521.87) and
amend the Agreement as set forth in this Amendment.
2. 2. Compensation of the Agreement is hereby amended to increase the amount that the
Agency agrees to pay the Contractor by twenty-seven thousand five hundred twenty-one
dollars and eighty seven cents ($27,521.87) for a total not-to-exceed amount of one million
three hundred fourteen thousand six hundred fifty nine dollars and eighty two cents
($1,314,659.82).
3. Except for the changes specifically set forth herein, all other terms and conditions of the
Agreement shall remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed by
and through their respective authorized officers, as of the date first above written.
