Subject:License Agreement for a Community Arts and Culture Facility
Recommendation:
Approve the License Agreement with Studio 395 Foundation for a Community Arts and Culture
Programming and Authorize the City Manager to Execute the Agreement, Subject to any Minor
Modifications as Approved by the City Attorney.
Background:
On July 28, 2015, City Council adopted the Arts & Culture Ad Hoc Subcommittee, consisting of
representation from City Council, City Staff, and Studio 395 Foundation. Since this initial
establishment, the Ad Hoc Subcommittee was successful in several significant efforts, such as
the establishment of the Busking Program and various public art projects throughout the City. In
January 2016, City Council adopted a resolution authorizing the continuation of the efforts by
changing the status from an Ad Hoc Subcommittee to the Arts and Culture Subcommittee.
The Subcommittee has created and adopted an ambitious vision of arts and culture in the
community. A component of the Subcommittee’s mission is to “…draw artistic activity to our
downtown, support and promote…programming that further public artistic efforts…” In order to
address this mission, the Subcommittee seeks to host a community facility within the downtown
corridor that is dedicated to the arts.
On November 10, 2016, City Staff provided an update to the City Council regarding the
successes and introduced the need for a community arts and culture facility in the downtown
area. City Staff identified and presented two contiguous underutilized parcels, located at 125
Library Street and 304 Short Street, and suggested them as a temporary home for the arts
community. The site is the gateway to the Old Historic Downtown Lake Elsinore. It is partially
fenced and primarily vacant with the exception of a small structure. It is the perfect location for a
primarily outdoor use with limited infrastructure and beautiful inspiring views of the lake. The
vision for the site is of an outdoor venue with shade structures for workshops, artist work stalls
for rent, a sculpture garden gallery, a stage for events, and storage areas. At this November 10th

meeting, City Council announced a donation of ten thousand dollars ($10,000) to make
improvements to the existing site.
Studio 395 Foundation proposes to work with the Community Development Department to make
any additional improvements to maximize use of the property for artist. With these
improvements the site will act as an identifying cornerstone to the downtown corridor and a
catalyst for downtown development.
Discussion:
In order to fulfill the Arts and Culture Subcommittee vision of having art drive economic
development in downtown Lake Elsinore, we propose a temporary community arts and culture
facility on Main Street. Studio 395 Foundation has volunteered to develop and manage the
community arts and culture facility at the sole cost of one dollar ($1) per year. The License
permits Studio 395 to utilize the property in accordance with the conditions identified in the
License for three years (3) with the option of two (2) additional one (1) year extensions. We
hereby present for your consideration a License Agreement by and between the City of Lake
Elsinore and for Studio 395 Foundation to operate a public facility that hosts arts and culture
programming activities at this designated location at the west end of Main Street.
The City is in the process of renovating the building to meet occupancy standards. Operations
within the structure shall commence after the completion of such improvements.
As stipulated in this License, Studio 395 Foundation proposes to host workshops, artist work
stations and a variety of events that will promote arts and culture along Main Street and become
an economic development catalyst for the area.
Fiscal Impact:
The fiscal impact includes the following:
Minimal revenue resulting from License Agreement Fees.
Anticipated expenditure to result from maintenance and repair of the existing structure to
bring it up to occupancy standards.
Anticipated expenditure to result from allocation of $10,000 worth of improvements.
