SUBJECT: Second Reading of Ordinance No. 2016-1346 Approving the
Amendment to the Municipal Code Regarding Busking Permit
Ordinance
Recommendation
1. It is recommended that the City Council waive further reading and adopt by title
only ORDINANCE NO. 2016-1346, AN ORDINANCE OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, AMENDING TITLE 5 OF THE LAKE ELSINORE
MUNICIPAL CODE TO ADD CHAPTER 5.58 PROVIDING FOR THE
REGULATION AND PERMITTING OF BUSKING.
Background
On July 28, 2015, City Council formed the Arts & Culture Ad Hoc Subcommittee. The
Ad Hoc Subcommittee has created and adopted an ambitious vision of arts and culture
in the community. A component of the Ad Hoc Subcommittee’s vision is to “incorporate
the arts into civic planning…as well as bolster economic activity.” The Busking Program
supports the adopted vision by encouraging art and performance entertainment in the
public realm. The Busking Program invites buskers to entertain the public and allow the
public to purchase busking-related goods and services. The Busking Permit Ordinance
supports this vision by introducing “policy that draws artistic activity” into the public
realm.
Discussion
Ordinance No. 2016-1346, was introduced for the first reading on December 8, 2015.
Today, we bring before you the second reading for consideration and approval to
amend the City of Lake Elsinore Municipal Code to provide for the regulation and
permitting of busking activities in the public right-of-way. The Ordinance provides a
regulatory framework to ensure that the busking program participants are protected
from violations related to solicitation, yet also ensures that the participants contribute

positively to the public realm. The Ordinance refers to “Busking Guidelines and Rules,”
which will provide additional regulation for administering the program. The Ordinance
also refers to a “Busking Permit” and “Busking Locations.” The “Busking Guidelines and
Rules,” “Busking Permit Application” and “Busking Locations Map” are also attached for
your consideration in connection with the approval of the proposed Ordinance.
