RESOLUTION NO. 2017 - 035 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING TENTATIVE TRACT MAP NO. 2016 -06 REQUESTING APPROVAL OF REVISION NO. 1 TO TENTATIVE TRACT MAP NO. 31957 Whereas, Pacific Coves Investments, LLC (Applicant) has filed an application with the City of Lake Elsinore (City) requesting approval of Planning Application No. 2016 -56 (Tentative Tract Map No. 2016 -06 and Extension of Time No. 2016 -03) on August 16, 2016. Tentative Tract Map No. 2016 -06 is Revision No. 1 to TTM 31957 and is proposing changes to reflect the current National Pollution Discharge Elimination System ( NPDES) requirements. The revisions include increasing the basin size and reducing the number of lots by four, removing connection to Mountain Street, and removing storm drain outlets to Running Deer Drive and Mountain Street. TTM 31957, Revision No. 1 will reflect a subdivision of 34.2 acres into 97 single - family residential lots and four lettered lots for open space and a water quality /detention basin. Extension of Time No. 2016 -03 is requesting to extend the life of TTM 31957 four years to September 13, 2020, (Project). The Project site is located northerly of Lincoln Street and westerly of Mountain Street and Running Deer Road more specifically referred to as Assessor Parcel Numbers 391 - 790 -002 and 391 - 790 -003; and, Whereas, pursuant to Lake Elsinore Municipal Code (LEMC) Section 16.24.110, the Planning Commission (Commission) has been delegated with the responsibility of making recommendations to the City Council (Council) pertaining to revisions to the tentative map; and, Whereas, on February 7, 2017, at a duly noticed Public Hearing, the Commission considered evidence presented by the Community Development Department and other interested parties with respect to this item; and, Whereas, pursuant to LEMC Section 16.24.120 the Council has the responsibility of making decisions to approve, conditionally approve, or disapprove recommendations of the Commission for the tentative map; and, Whereas, on March 14, 2017, at a duly noticed Public Hearing, the Council has considered the recommendation of the Commission as well as evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The Council has reviewed and analyzed the proposed Project pursuant to the appropriate Planning and Zoning Laws, and Chapter 16 (Subdivisions) of the LEMC. Section 2. The Council finds and determines that no new California Environment Quality Act (CEQA) documentation is necessary. Mitigated Negative Declaration (MND) No. 2005 -06 was adopted by the Council on September 13, 2005, for the Project. TTM 31957 was revised to reflect current NPDES requirements and the Conditions of Approval were updated to reflect the most current City requirements for development. The revisions that occurred are minor and only include the removal of the connection.to Mountain Street and the loss of four lots to accommodate the larger detention /water quality basin. These changes will also allow the project to conform to the current NPDES requirements as well as City requirements for development. No substantial changes which require major revisions to the mitigated negative declaration exist and no new information of substantial importance which require revisions to the earlier mitigated negative declaration exist. Therefore, no further environmental review is necessary. CC Reso. No. 2017 - 035 Page 2 of 3 Section 3. That in accordance with State Planning and Zoning Law and the LEMC, the Council makes the following findings for approval of Tentative Tract Map No. 2016 -06 (Revision No. 1 to TTM 31957): 1. The proposed subdivision, together with the provisions for its design and improvement, is consistent with the General Plan. The proposed subdivision is compatible with the objectives, policies, general land uses and programs specified in the General Plan (Government Code Section 66473.5). a. TTM 31957, Revision No. 1 is located in the Low Medium Residential (LMR) General Plan Land use designation of the General Plan. The LMR designation provides for single- family detached residences with densities ranging between 1 and 6 dwelling units per net acre. TTM 31957, Revision No. 1 a subdivision of 34.2 acres into 97 single- family residential lots and four lettered lots for open space and a water quality /detention basin. TTM 31957, Revision No. 1 will have 2.84 dwelling units per acre and is therefore consistent with the General Plan. b. All offsite mitigation measures have been identified in a manner consistent with the General Plan. c. All recreational amenities have been provided in a manner consistent with the General Plan. 2. The site of the proposed subdivision of land is physically suitable for the proposed density of development in accordance with the General Plan. a. The overall density and design is consistent and compatible with the adjacent communities. 3. The effects that this project are likely to have upon the housing needs of the region, the public service requirements of its residents and the available fiscal and environmental resources have been considered and balanced. a. The Project is consistent with the City's General Plan. During the approval of the General Plan, housing needs, public services and fiscal resources were scrutinized to achieve a balance within the City. 4. Subject to the attached Conditions of Approval, the proposed division of land or type of improvements is not likely to result in any significant environmental impacts. a. An Initial Study (MND 2005 -06) was prepared for TTM 31957. The Initial Study identified potentially significant environmental effects but proposals made or agreed to by the applicant avoid the effects or mitigate the effects to a point where no significant effects would occur. Mitigation measures are required to ensure all potentially significant impacts are reduced to levels of insignificance. TTM 31957 has been conditioned to comply with these mitigation measures. b. The revisions that occurred with Revision No. 1 to TTM 31957 are minor and only include the removal of the connection to Mountain Street and the loss of four lots to accommodate the larger detention /water quality basin. No substantial changes that require major revisions to the mitigated negative declaration have occurred. 5. The design of the proposed division of land or type of improvements is not likely to cause serious public health problems. CC Reso. No. 2017 - 035 Page 3 of 3 a. TTM 31957, Revision No. 1 has been designed in a manner consistent with the General Plan and does not divide previously established communities. 6. The design of the proposed division of land or type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed division of land. a. All known easements or request for access have been incorporated into the design of TTM 31957, Revision No. 1. b. The map has been circulated to City departments and outside agencies, and appropriate Conditions of Approval have been applied to the Project. Section 4. Based upon all of the evidence presented, the above findings, and the Conditions of Approval imposed upon the Project, the Council hereby approves Tentative Tract Map No. 2016- 06 (Revision No. 1 to TTM 31957). Tentative Tract Map No. 31957 will expire on September 13. 2020, unless within that period of time a Final Map has been filed with the County Recorder in accordance with the State of California Subdivision Map Act and applicable requirements of the Lake Elsinore Municipal Code (LEMC). The applicant shall pay all applicable City fees, including but not limited to Development Imp act Fees (DIF) per LEMC Section 16.74 at the rate in effect at the time of payment. ENGINEERING General 29. In accordance with the City's Franchise Agreement for waste disposal & recycling, the developer shall be required to contract with CR &R Inc. for removal and disposal of all waste material debris vegetation and other rubbish generated during cleaning, demolition clear and grubbing or all other phases of construction. 30. Developer shall mitigate to prevent any flooding and /or erosion downstream caused by development of the site and or diversion of drainage. Running Deer Road shall be fully improved to Local Street Standard, within the existing right of way, between Cielito Drive and the project boundary. Applicant shall design and install the Rice Canyon Wash Levee system which will convey a 100 -year storm past the project site. Vehicular access to /from Billings Lane and across the levee shall be provided from Lincoln Street to maintain access to properties granted access rights per Instrument No. 3819 recorded January 14, 1969. Final location and design of driveway access with proposed levee and design of raised median in Lincoln Street shall be submitted to Engineering for review and approval. Applicant shall protect all downstream properties from damages caused by alteration of the drainage patterns i.e. concentrations or diversion of flow. Protection shall be provided by constructing adequate drainage facilities including enlarging existing facilities and /or by securing a drainage easement. A maintenance mechanism shall be in place for any private drainage facilities constructed on site or off site. Any grading or drainage onto private off site or adjacent property shall require a written permission to grade and /or a permission to drain letter from the affected landowner. 58. Developer shall provide soils geology a seismic report including street design recommendations. Provide final soils report showing compliance with recommendations. 76. All grading shall be done under the supervision of a Geotechnical Engineer and he shall certify all slopes steeper than 2 to 1 for stability and proper erosion control. All manufactured slopes greater than 30 feet in height shall be contoured. 77. Convey onsite runoff to the public storm drain system. Any non - historic storm flows shall be accepted by adjacent property owners with a notarized and recorded letter of drainage acceptance or conveyed to a drainage easement. 78. Prior to gradba or building permit for construction or demolition and /or weed abatement activity_ rojects subject to coverage under the NPDES General Construction Permit shall demonstrate that com liance with the permit has been obtained by rovidin a copy of the Notice of Intent (Nab submitted to the State Water Resources Control Board and a cape of the notification of the issuance of a Waste Discharge Identification (WDID) Number or other proof of filinq to the satisfaction of the City Engineer. A copy of the SWPPP shall be kept at the proiect site updated, and be available for review upon request. 98. Erosion & Sediment Control — ALL PROJECTS - Prior to the issuance of any gradinq or building permit for construction or demolition the applicant shall submit for review and approval by the City Engineer, an Erosion and Sediment Control Plan as a separate sheet of the grading plan submittal to demonstrate compliance with the City's NPDES Program and state water quality regulations for grading and construction activities. Minimum BMPs as identified by the City shall be implemented by all projects. Post - Construction 100. Prior to the issuance of a certificate of use and /or occupancy, the applicant shall demonstrate com fiance with applicable NPDES permits for construction MS4 etc. to include: • Demonstrate that the project has complied with all non - structural BMPs described in the project's WQMP. • Provide signed, notarized certification from the engineer of work that the structural BMP's identified in the ro'ect's WQMP are installed in conformance with approved plans and specifications and operational. • Submit a copy of the fully executed recorded City approved Operations and Maintenance (O &M) Plan and Agreement for all structural BMPs or a copy of the recorded City approved CC &R. • The Operation and Maintenance O &M Plan and Agreement and /or CC &R's shall (1} describe the long -term operation and maintenance requirements for BMPs identified in the BMP Exhibit 2 identify the entity that will be responsible for Ion - term o eration and maintenance of the referenced BMPs 3 describe the mechanism for funding the long-term operation and maintenance of the referenced BMPS-, and 4 provide for annual certification of water quality facilities by-.- a registered civil engineer. The City format shall be used. • Demonstrate that copies of the romect's approved WQMP with recorded O &M Plan or CC &R's attached are available for each of the initial occupant (commercial /industrial) or HOA as appropriate. • Agree to pay for a Special Investigation from the City of Lake Elsinore for a date twelve (12) months after the issuance of a Certificate of Use and /or Occupancy for the project to verify compliance with the approved WQMP and O &M Plan. A signed/sealed certification from the engineer of work dated 12 months after CofO will be considered in lieu of a Special Investigation by the City. • Provide the City with a digital .pdf copy of the Final WQMP. Final Tract or Parcel Map 101. The developer shall submit for plan check review and approval a final map. 102. All ingress/egress easements required to maintain access across the Levee shall be shown on the final map. 103. Prior to final map approval, provide evidence of the vacation of existing easements within prop rty boundaries. Lake Elsinore Fire Protection Planning Office Responsibility - It is the responsibility of the recipient of Fire Department conditions to forward them to all interested parties. The permit number is required on all correspondence. Questions should be directed to the Riverside County Fire Department Lake Elsinore Fire Protection Planning Division at 130 S. Main St. Lake Elsinore, CA 9_2530. Phone: (951) 671 -3124 Ext. 225. The following fire department conditions shall be implemented in accordance with the Lake Elsinore Municipal Code and the adopted codes at the time of project building plan submittal, these conditions are in addition to the adopted code requirements. 119. Blue Dot Reflectors - Blue retro - reflective pavement markers shall be mounted on private streets, public streets and driveways to indicate location of fire hydrants. Prior to installation placement of markers must be approved by the Riverside Count Fire Dept. 120. Minimum Hvdrant Fire Flow - Minimum required fire flow shall be 1,500 GPM for 2 hours duration at 20 PSI residual operating-pressure, which must be available before an combustible material is placed on the job site. Average spacing between_ hydrants 500' and 250' maximum distance from any point on the street or road frontage to hydrant. Standard Fire hydrants shall be installed (6" x4" x2- 1..12 121. Standard Fire Hydrants - Super fire hydrants 6" x 4" x 2 -2 1/2"), shall be located not less than 25 feet or more than 250 feet from any portion of the buildinq as measures along approved vehicular travel ways. The required fire flow shall be available from any adiacent hydrant(s) in the system. 122. Minimum Access Standards - The following access re uirements are required to be implemented to ensure fire department and emergency vehicular access. All roadways shall conform to the City of Lake Elsinore approved roadway standards but in no case shall the minimum fire department vehicular access be less the following provisions: A. Twenty -four feet (24') clear width. Where par_kinq is to be provided, each parkin side shall be rovided with eight (8') additional feet on each side of the fire department access. B. Median openings or crossovers between opposing lanes of a divided -highway or street shall be located only at approved intersections at intervals of not less than 500 feet. Ord. 529 § 3.2(F), 19731. C. The required all weather vehicular access shall be able to support no less than 70,000 lbs. over 2 axles. D. Roadway gradient shall not exceed 15% on any access road driveways, and perimeter roads. E. Turning Radius shall be 26' inside and 38' outside for all access roads. 123. Secondary Access - In the interest of Public Safety, this project shall provide an Alternate or Secondary Access. Said access shall be constructed in accordance to the City of Lake Elsinore Engineering Department standards to accommodate full fire response and community evacuation. Separation of Occupancy - A fire barrier wall for the separation of occupancies is required per the California Building Code. Fire walls fire barriers fire partitions, smoke barriers and smoke partitions or any other wall required to have protected openings or penetrations shall be effectively and permanently identified with signs or stenciling. Such identification shall be located in accessible concealed floor, floor ceiling or attic spaces repeated at intervals not exceeding 30 feet along the wall and include lettering not less than 0.5 inch in height, incorporating the suggested wording "FIRE AND /OR SMOKE BARRIER - PROTECT ALL OPENINGS." or other wording. Prior to Building Permit Issuance 125. Plan Check Fee - Building plan check fees shall be made payable to the "City of Lake Elsinore" and shall be submitted to the Fire Department at the time of plan submittal. 126. Water System Plans - Applicant and /or developer shall separately submit 2 sets of water system plans to the Fire Department for review. Plans must be signed by a registered Civil Engineer and /or water purveyor prior to Fire Department review and approval. Molars will be signed by the Fire Department after review and approval. Two 2 copies of the si ned and approved water tans shall be returned to the Fire Department before release of a building permit. 127. Prior to Buildina Construction Verification - This proiect shall be inspected and approved by the Fire Marshal or designee prior to bringing combustible materials on site. During such inspection all permanent road signs shall be-in-place, all hydrants on operating ..rating and approved for use by the water purveyor, and all permanent road surfaces_ shall be completed including primary and secondary access circulation. Prior to Building Final Inspection 128. Residential Fire Sprinkler Systems for Single family and two- family 13D - Install a complete fire sprinkler system designed in accordance with California Residential Code California Fire Code and adopted standards. A C -16 licensed contractor must submit fans along with the current fee to the Fire Department for review and approval prior to installation. ADMINISTRATIVE SERVICES DEPARTMENT Annex into CFD 2015 -1 (Safety) Law Enforcement Fire and Paramedic Services CFD 129. Prior to approval of the Final Map, Parcel Map, Residential Design Review, or Conditional Use Permit as applicable), the applicant shall annex into Community Facilities District No. 2015 -1 (Safety) the Law Enforcement Fire and Paramedic Services Mello -Roos Community Facilities District to offset the annual negative fiscal impacts of the progect on public safety operations and maintenance issues in the City.
