A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, ESTABLISHING FEES FOR
HAZARDOUS VEGETATION AND RUBBISH ABATEMENT
PROGRAM
WHEREAS, Government Code sections 39501 and 39502 authorize the City of Lake Elsinore to
adopt procedures making it the responsibility and duty of the owners, lessees, and occupants of
real property within the City to prevent and abate public nuisances caused by weeds or rubbish
on or about their property; and,
WHEREAS, the City Council adopted Ordinance No. 2016 -1349 amending the Lake Elsinore
Municipal Code regarding Hazardous Vegetation and Rubbish Abatement to streamline the
program and establish efficient and effective procedures that will encourage greater compliance,
improve public safety and ensure adequate cost recovery for the program; and,
WHEREAS, the City incurs certain costs associated with the Hazardous Vegetation and Rubbish
Abatement Program including administration and abatement costs that may be recovered by any
manner authorized by law; and,
WHEREAS, the City seeks to establish a new schedule of administrative and abatement fees for
the new Hazardous Vegetation and Rubbish Abatement Program and conducted a cost analysis
to determine fees that more accurately and effectively recover the costs associated with the
program.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, RESOLVES,
DETERMINES AND ORDERS AS FOLLOWS:
SECTION 1. The Council finds and determines that the foregoing recitals are true and correct.
SECTION 2. The Council hereby authorizes and establishes the following fee schedule for the
Hazardous Vegetation and Rubbish Abatement Program:

Administrative Fee: $350.00 Assessed Upon Failure to Comply
by Notice Deadline
Appeal Filing Fee: $ 50.00 Refunded if Appeal is Granted
Abatement Fees:
If the property is abated by the City and /or a subcontractor, the following fees will be
charged:

Single Parcel - Less than one (1) acre $155.25 Fixed Fee
Single Parcel - Over one (1) acre $155.25 Per Acre

SECTION 3. Staff is further directed to include the fee schedule with at least one of the notices
of violation to property owners and to post all associated fees on the City's website to ensure all
parties are aware of the newly established fees.
SECTION 4. This Resolution shall take effect from and after its adoption.
PASSED AND ADOPTED at a meeting of the City Council of the City of Lake Elsinore,
California, on the 31St day of May, 2016.
