A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE
APPROVING TENTATIVE PARCEL MAP NO. 37093 FOR THE
CONSOLIDATION OF SIX (6) EXISTING PARCELS INTO ONE (1) PARCEL
LOCATED AT APN: 379 - 132 -013
WHEREAS, Glen Robison, Greenberg Farrow, has filed an application for Tentative Parcel Map
No. 37093 with the City of Lake Elsinore (City) requesting approval for the consolidation of six (6)
existing parcels into one (1) parcel (Project) located at the southwestern corner of Riverside Drive
and Joy Street (APN: 379 - 132 -013); and,
WHEREAS, on July 5, 2016, at a duly noticed Public Hearing, the Planning Commission
considered evidence presented by the Community Development Department and other interested
parties with respect to this item; and,
WHEREAS, pursuant to Lake Elsinore Municipal Code (LEMC) Chapter 16.24 (Tentative Map)
the City Council (Council) of the City of Lake Elsinore (City) has the responsibility of making
decisions to approve, conditionally approve, or disapprove recommendations of the Planning
Commission for the tentative map; and,
WHEREAS, on August 9, 2016, at a duly noticed Public Hearing, the Council has considered the
recommendation of the Planning Commission as well as evidence presented by the Community
Development Department and other interested parties with respect to this item.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY
RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The Council has reviewed and analyzed Tentative Parcel Map No. 37093 pursuant
to the appropriate Planning and Zoning Laws, and Chapter 16 (Subdivisions) of the LEMC and
finds and determines that the proposed Tentative Parcel Map No. 37093 is consistent with the
requirements of California Planning and Zoning Law and with the goals and policies of the Lake
Elsinore General Plan and the LEMC.
SECTION 2. The Council hereby finds and determines that the Project is categorically exempt
from California Environmental Quality Act (Cal. Publ. Res. Code § §21000 et seq. "CEQA ") and
the State CEQA Guidelines (14. Cal. Code Regs. § §15000 et seq.), specifically pursuant to
Section 15315 (Class 15: Minor Land Divisions). Class 15 consists of the division of property in
urbanized areas zoned for residential, commercial, or industrial use into four or fewer parcels
when the division is in conformance with the General Plan and Zoning, no variances or exceptions
are required, all services and access to the proposed parcels to local standards are available, the
parcel was not involved in a division of a larger parcel within the previous two 2 years and the
parcel does not have an average slope greater than 20 percent. The Project proposes to
consolidate six (6) parcels into one (1) 1.21 -acre parcel for commercial use. The Project is in
conformance with the current General Plan and Zoning for the Project site and does not require
a variance. Services and access to the proposed parcel are available. The parcel was not involved
in a division of a larger parcel within the previous two (2) years and does not have an average
slope greater than 20 percent.
SECTION 3. That in accordance with State Planning and Zoning Law and the LEMC, the Council
makes the following findings for approval of Tentative Parcel Map No. 37093:

1. The proposed subdivision, together with the provisions for its design and improvement, is
consistent with the General Plan. The proposed subdivision is compatible with the
objectives, policies, general land uses and programs specified in the General Plan
(Government Code Section 66473.5).
The Project site has a General Plan land use designation of General Commercial (GC).
The GC Land Use designation provides for retail, services, restaurants, professional and
administrative offices, hotels and motels, mixed -use projects, public and quasi - public
uses, and similar and compatible uses with a Floor Area Ratio (FAR) not to exceed 0.40.
The proposed Tentative Parcel Map which will consolidate six (6) parcels into one (1)
parcel will allow the development of the proposed convenience store with a FAR of 0.08.
The Tentative Parcel Map is consistent with the designated land use, development and
design standards, and all other appropriate requirements contained in the General Plan
and the Subdivision Map Act.
2. The site of the proposed subdivision of land is physically suitable for the proposed density
of development in accordance with the General Plan.
The project site is vacant and is relatively flat. The proposed Tentative Parcel Map which
will consolidate six (6) parcels into one (1) parcel will allow the development of the
proposed convenience store with gasoline dispensing stations. The maximum FAR for the
GC is 0.40. The proposed Project site will be developed with FAR of 0.08.
3. The effects that this Project are likely to have upon the housing needs of the region, the
public service requirements of its residents and the available fiscal and environmental
resources have been considered and balanced.
The Project site has a General Plan land use designation of GC and will not have a direct
impact on housing. The proposed Tentative Parcel Map which will consolidate six (6)
parcels into one (1) parcel will allow the development of the proposed convenience store
to serve the surrounding residents in the area.
4. The design of the proposed division of land or type of improvements is not likely to cause
serious public health problems.
The Project has been adequately conditioned by all applicable departments and agencies
and will not therefore result in any significant environmental impacts. The proposed use,
together with the conditions applicable thereto, will not be detrimental to the public health,
safety, or welfare or materially injurious to properties or improvements in the vicinity.
SECTION 4. Based upon the evidence presented, the above findings, and the attached
conditions of approval, the Council approves Tentative Parcel Map No. 37093.
SECTION 5. This Resolution shall take effect from and after the date of its passage and adoption.

The proposed project (Tentative Parcel Map No. 37093) proposes to consolidate
six (6) existing parcels into one (1) parcel. The proposed parcel will contain
approximately 1.21 acres after a 20 ft. wide right -of -way dedication along Riverside
Drive has been made. The project is located at the southwestern corner of
Riverside Drive and Joy Street and more specifically referred to as Assessor
Parcel Number 379 - 132 -013.
2. The applicant shall defend (with counsel acceptable to the City), indemnify, and
hold harmless the City, its Officials, Officers, Employees, and Agents from any
claim, action, or proceeding against the City, its Officials, Officers, Employees or
Agents to attack, set aside, void, or annul an approval of the City, its advisory
agencies, appeal boards, or legislative body concerning the Tentative Parcel Map
No. 37093.
3, Within 30 days of project approval, the applicant shall sign and complete an
"Acknowledgment of Conditions" and shall return the executed original to the
Community Development Department for inclusion in the case records.
4, The applicant shall submit a check in the amount of $50.00 made payable to the
County of Riverside for the filing of a Notice of Exemption. The check shall be
submitted to the Planning Division for processing within 48 hours of the project's
approval.
PLANNING DIVISION
5. Tentative Parcel Map No. 37093 will expire two years from date of approval unless
within that period of time a Final Map has been filed with the County Recorder, or an
extension of time is granted by the City of Lake Elsinore City Council in accordance
with the State of California Subdivision Map Act and applicable requirements of the
Lake Elsinore Municipal Code (LEMC).
6. Tentative Parcel Map No. 37093 shall comply with the State of California Subdivision
Map Act and applicable requirements contained in the Lake Elsinore Municipal Code
(LEMC), unless modified by approved Conditions of Approval.

7. The applicant shall provide all project - related on -site and off -site improvements as
required by these Conditions of Approval.
8. All future development proposals shall be reviewed by the City on a project -by-
project basis. If determined necessary by the Community Development Director
or designee, additional environmental analysis will be required.
9. The applicant shall pay all applicable City fees, including but not limited to
Development Impact Fees (DIF), at the rate in effect at the time of payment.
Prior to Recordation of Final Map(s)
10. All lots shall comply with minimum standards contained in Chapter 17.124 (C -2
General Commercial District) of the LEMC.
11. A precise survey with closures for boundaries and all lots shall be provided per the
LEMC.
12. All of the improvements shall be designed by the applicant's Civil Engineer to the
specifications of the City of Lake Elsinore.
13. The applicant shall meet all requirements of Elsinore Valley Municipal Water
District (EVMWD)
Prior to Issuance of Grading Permits /Building Permits
14. Provisions of the City's Noise Ordinance (LEMC Chapter 17.176) shall be satisfied
during all site preparation and construction activity. Site preparation activity and
construction shall not commence before 7:00 AM and shall cease no later than
5:00 PM, Monday through Friday. Only finish work and similar interior construction
may be conducted on Saturdays and may commence no earlier than 8:00 am and
shall cease no later than 4:00 p.m. Construction activity shall not take place on
Sunday, or any Legal Holidays.
15. The applicant shall comply with all applicable City Codes and Ordinances.
16. The applicant shall pay school fees to the Lake Elsinore Unified School District
prior to issuance of a building permit.
17. The project shall connect to sewer and meet all requirements of the Elsinore Valley
Municipal Water District (EVMWD). The applicant shall submit water and sewer
plans to the EVMWD and shall incorporate all district conditions and standards.

ENGINEERING DIVISION
General

18. All slopes and landscaping within public right -of -way shall be maintained by the
property owner or property owner's association or another maintenance entity
approved by the City Council.
19. In accordance with the City's Franchise Agreement for waste disposal & recycling,
the developer shall be required to contract with CR &R Inc. for removal and
disposal of all waste material, debris, vegetation and other rubbish generated
during cleaning, demolition, clear and grubbing or all other phases of construction.
20. Developer shall mitigate to prevent any flooding and /or erosion downstream
caused by development of the site and or diversion of drainage.
Fees
21. The developer shall pay the Master Plan of Drainage Fee, prior to approval of the
final parcel map, per LEMC 16.72.010.
Flood Plain
22. Project lies within the FEMA mapped 500 -year floodplain. An elevation certificate
will be required prior to occupancy.
Final Tract or Parcel Map
23. The developer shall submit for plan check review and approval a final map.
24. Prior to City Engineer approval of the Parcel Map, the developer shall, in
accordance with Government Code, have constructed all improvements or noted
on the title sheet of the map the improvements to be constructed or have
improvement plans submitted and approved, agreements executed and securities
posted.
Utilities
25. Underground water rights shall be dedicated to the City pursuant to the provisions
of Section 16.52.030 (LEMC), and consistent with the City's agreement with the
Elsinore Valley Municipal Water District.

26. The owner shall dedicate in fee title to the City a strip of right -of -way along Joy
Street adjacent to the property frontage for a total right -of -way of 34' from
centerline to the project property line, prior to map recordation.
27. The developer shall construct half width + 12' street improvements on Joy Street
such that the ultimate right -of -way width conforms to General Plan Collector
Highway cross sections.
28. The owner shall dedicate in fee title to the City a strip of right -of -way along
Riverside Drive adjacent to the property frontage for a total right -of -way of 60' from
centerline to the project property line, prior to map recordation.
29. The developer shall construct street improvements and dedicate the half -width
right -of -way on Riverside Drive per General Plan Urban Arterial street right -of -way
requirements. The cross section of roadway improvements shall be consistent with
Caltrans requirements and subject to Caltrans approval. The Riverside Drive
striping shall be right in, right out only, with left turn movement restricted, as
identified by Caltrans letter dated February 17, 2015.
30. The developer shall construct a signal at the intersection of Riverside Drive and
Joy Street. The signal and intersection improvements shall be consistent with
Caltrans requirements and subject to Caltrans approval.
31. The applicant shall pay cash in lieu of construction of a raised median on Riverside
Drive if no restriction is constructed, per City Engineer approval. The fee shall be
equal to City Engineer approved cost estimate for improvements, for the length of
the project frontage on Riverside Drive, (including contingency) plus an additional
15% of the total construction cost estimate to cover design and administrative
costs. The cost estimate shall be approved by the City Engineer.
32. The owner shall process a reciprocal access easement across the "future access
aisle" for public use with the adjacent property owner.
FIRE CONDITIONS
General Conditions
33. Riverside County Fire Department Lake Elsinore Office of the Fire Marshal -
It is the responsibility of the recipient of these Fire Department conditions to
forward them to all interested parties. The permit number (as it is noted above) is
required on all correspondence.

Questions should be directed to the Riverside County Fire Department, Lake
Elsinore Office of the Fire Marshal at 130 S. Main St., Lake Elsinore, CA 92530.
Phone: (951) 671 -3124 Ext. 225. The following fire department conditions shall be
implemented in accordance with the Lake Elsinore Municipal Code and the
adopted codes at the time of project building plan submittal, these conditions are
in addition to the adopted code requirements.
34. Blue Dot Reflectors - Blue retro- reflective pavement markers shall be mounted
on private streets, public streets and driveways to indicate location of fire hydrants.
Prior to installation, placement of markers must be approved by the Riverside
County Fire Dept.
35. Minimum Hydrant Fire Flow - Minimum required fire flow shall be 1,750 GPM for
2 -hour duration at 20 PSI residual operating pressure, which must be available
before any combustible material is placed on the job site. Average spacing
between hydrants 500' and 250' maximum distance from any point on the street or
road frontage to hydrant.
36. Super Fire Hydrants - Super fire hydrants (6" x 4" x 2 -2 1/2 "), shall be located not
less than 25 feet or more than 250 feet from any portion of the building as
measured along approved vehicular travel ways.
37. Minimum Access Standards - The following access requirements are required
to be implemented to ensure fire department and emergency vehicular access. All
roadways shall conform to the City of Lake Elsinore approved roadway standards
but in no case shall the minimum fire department vehicular access be less the
following provisions:
Twenty -four feet (24') clear width. Where parking is to be provided, each
parking side shall be provided with eight (8') additional feet on each side of the
fire department access.
2. Median openings or crossovers between opposing lanes of a divided highway
or street shall be located only at approved intersections at intervals of not less
than 500 feet. [Ord. 529 § 3.2(F), 1973].
3. The required all weather vehicular access shall be able to support no less than
60,000 lbs. over 2 axles.
4. Roadway gradient shall not exceed 15% on any access road, driveways, and
perimeter roads.
5. Turning Radius shall be 26' inside and 38' outside for all access roads.

38. Secondary Access - In the interest of Public Safety, this project shall provide an
Alternate or Secondary Access. Said access shall be constructed in accordance
to the City of Lake Elsinore Engineering Department standards to accommodate
full fire response and community evacuation.
39. Operating Permit Required - This project has been review and may require an
operating permit in addition to the construction permit that has been conditioned
for this project in accordance with 105.6 of The California Fire Code.
Prior to Building Permit Issuance
40. Plan Check Fee - Building plan check fees shall be made payable to the "City of
Lake Elsinore ", and shall be submitted to the Fire Department at the time of plan
submittal.
41. Water System Plans - Applicant and /or developer shall submit 2 sets of water
system plans to the Fire Department for review. The plans must be signed by a
registered Civil Engineer and /or water purveyor prior to Fire Department review
and approval. Mylars will be signed by the Fire Department after review and
approval. Two (2) copies of the signed and approved water plans shall be returned
to the Fire Department before release of a building permit.
42. Prior to Building Construction Verification - This project shall be inspected and
approved by the Fire Marshal or designee prior to bringing combustible materials
on site. During said inspection all permanent road signs shall be in place, all
hydrants shall on operating and approved for use by the water purveyor, and all
permanent road surfaces shall be completed including primary and secondary
access circulation.
Prior to Building Final Inspection
43. Designated Fire Lanes - The applicant shall prepare and submit to the Fire
Department for approval, a site plan designating required fire lanes with
appropriate lane painting and/ or signs.
44. Knox Rapid Entry Box - A rapid entry Knox Box shall be installed on the outside
of the building. Key(s) shall have durable and legible tags affixed for identification
of the correlating tenant space. Special forms are available from this office for
ordering the Knox Box. If the building /facility is protected with a fire alarm or burglar
alarm system, it is recommended that the lock box be "tamper" monitoring.
45. Fire Extinguishers - Minimum. Install portable fire extinguishers complying with
Section 906 of the 2013 California Fire Code with a minimum rating of 2A -10BC
and signage. Fire Extinguishers located in public areas shall be in recessed

cabinets mounted 48" (inches) to center above floor level with maximum 4"
projection from the wall. Contact Fire Dept. for proper placement of equipment prior
to installation.
46. Underground Fuel Tank Permits - Applicant and /or developer shall be
responsible for obtaining underground fuel tank and dispenser tank permit, from
the Riverside County Fire Department and Environmental Health Department.
Plans must be submitted along with our "Plan Review Form" for approval prior to
installation. Contact the Fire Planning office for current plan check fees.
