A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, DECLARING AND FINDING THAT THE PUBLIC INTEREST AND
NECESSITY DEMAND THE IMMEDIATE PROCUREMENT AND AWARD OF A
CONSTRUCTION CONTRACT TO PERFORM EMERGENCY SLOPE AND
DRAINAGE REPAIRS ON SKYLINE DRIVE; AWARD OF CONTRACT
WHEREAS, Skyline Drive is a public right of way and is owned and maintained by the City of
Lake Elsinore; and,
WHEREAS, the City's Public Works Department and Engineering Department have identified
three areas in which the slope supporting Skyline Drive is severely eroded and poses an
immediate risk of failure; and,
WHEREAS, in the event that the slope does in fact fail prior to repairs being performed, the cost
to repair the slope and the road will significantly increase; and,
WHEREAS, competitive procurement of a qualified contractor for this type of specialized work
could take up to three months; and,
WHEREAS, California Public Contract Code Section 22050(a)(1) authorizes public agencies to
take emergency action to repair or replace a public facility without competitive bidding; and,
WHEREAS, the Public Works Department has obtained a bid from a seasoned contractor with
expertise in slope and drainage repairs of this type and magnitude and determined that such bid
is reasonable; and,
WHEREAS, the City desires to immediately procure the contractor to begin work.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY
RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1: The Council finds that, based on substantial evidence, the emergency will not permit
a delay resulting from a competitive solicitation for bids, and that this action is necessary to
respond to the emergency.
SECTION 2: Based on substantial evidence as described in the Staff Report prepared by Brad
Fagrell, City Engineer, public interest and necessity demand the immediate procurement and
award of a construction contract to perform emergency repairs on Skyline Drive without
competitive bidding.
SECTION 3: A contract for emergency slope repairs on Skyline Drive is hereby awarded to
Hillside Companies, for the amount of $202,635, which includes a 10% contingency and, further,
the City Manager is authorized to execute the contract with Hillside Companies in such final form
as approved by the city attorney.
SECTION 4. The City Clerk shall certify to the passage and adoption of this resolution and enter
it into the book of original resolutions.

SECTION 5. This Resolution shall take effect immediately upon its adoption.
PASSED AND ADOPTED at a Regular meeting of the City Council of the City of Lake
Elsinore, California, held on July 26, 2016.
