A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, APPROVING THE PRECISE ALIGNMENT FOR THE DIAMOND
DRIVE ULTIMATE RIGHT -OF -WAY AND STREET IMPROVEMENTS
WHEREAS, the City of Lake Elsinore on behalf of development applicants Nick
Tavaglione and Steve Semingson are requesting City Council approval of a precise
alignment for Diamond Drive; and,
WHEREAS, Diamond Drive is currently developed with an 80' right -of -way (ROW)
and the City's General Plan Circulation Element identifies this section of Diamond Drive
as a Major Highway, 4- lanes, 100' ROW; and,
WHEREAS, Diamond Drive currently has a bend at the intersection of Pete Lehr
Drive that should be realigned to address safety and sight distance concerns; and,
WHEREAS, the property owners have submitted development applications and
cannot proceed with environmental review as set forth in the California Environmental
Quality Act (CEQA) Guidelines until a precise alignment is approved by the City Council;
and,
WHEREAS, City engineering consultants and the property owners engineers have
reviewed options and worked together to find the most viable precise alignment that will
minimally impact development potential, address safety and sign distance concerns; and
be consistent with the General Plan Circulation Element; and,
WHEREAS, the precise alignment for Diamond Drive is categorically exempt from
the California Environmental Quality Act pursuant to Section 15332 (Class 32 — In -Fill
Development) because the project is consistent with the application General Plan
designation and policies, as well as zoning designation and regulations; and,
WHEREAS, both properties submitting development applications have proposals
that are consistent with the General Plan, Diamond Specific Plan, and Lake Elsinore
Municipal Code; and,
WHEREAS, on April 12, 2016, at a duly noticed regular meeting, the City Council
has considered the recommendation of engineering staff as well as evidence presented
by the Community Development Department and other interested parties with respect to
this item.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE
DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The City Council has considered the proposed precise alignment for
Diamond Drive and has found it acceptable. The City Council has reviewed and analyzed
the proposed precise alignment and determined the proposal consistent with the
California Planning and Zoning Laws (Cal. Gov. Code §§ 65000 et seq.), the Lake
Elsinore General Plan, the Diamond Specific Plan, and the Lake Elsinore Municipal Code.
SECTION 2. The City Council has considered oral and written testimony offered
at the regular meeting and determined that the precise alignment is in compliance with
the California Environmental Quality Act.
SECTION 3. The City Council finds that the precise alignment as set forth in
attached Exhibit A will address potential safety and sight distance impacts and will make
minimal negative impacts on the adjacent properties development proposals.
SECTION 4. Based upon all of the evidence presented, the above findings, and
consistency with the Lake Elsinore General Plan, Diamond Specific Plan and Lake
Elsinore Municipal Code, the City Council of the City of Lake Elsinore hereby approves
the precise alignment for Diamond Drive as set forth in attached Exhibit A.
SECTION 5. This Resolution shall take effect from and after the date of its
passage and adoption.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the City Council
of the City of Lake Elsinore, California, on the 12th day of April, 2016.
