HomeMy WebLinkAboutAgenda Item # 9Agenda Item No. 9 From: Henry Rogers <henry(crearstrate lies.com> Date: October 26, 2015 at 9:06:44 PM PDT To: "barbara c ee a.com" <barbara a cega.com> Subject: Unattended Donation Bins City Attorney Leibold, I would like to take the opportunity to comment on the Municipal Code Amendment to be heard by Council on Tuesday, October 26, 2015 concerning the regulation of unattended collection boxes. USAgain is a for -profit textile recycling company with a basis of operation in Anaheim. Overall, the City of Lake Elsinore is revising the ordinance to allow for both non - profitand for -profit operators; however we have a few concerns and recommendations to improve the ordinance. First, the responsibility should not be shared between the operator and property owner. To ensure best practices of collection box operators, the responsibility and liability should remain with the box operator. The property owner should not be punished for the actions of an operator and this shared responsibility incentivizes property owners not to host collection boxes and provide this service to the community. The second concern that USAgain has it that the ordinance requires the signed written consent from the property owner and does not include the owner's agent. While we agree that consent is required, in practice permission may be received from the owner's agent. It is often time consuming and impractical to obtain consent from an owner and an owner's agent should suffice. I will be at the council hearing on Tuesday evening and hope those two amendments can be made to the current ordinance.
