CLOSED SESSION REPORT Assistant City Attorney Mann announced that the Closed Session was cancelled due to the City Attorney being ill and threfore no reportable action was taken. Authorize the City Manager to negotiate and approve agreement by and between the STK Architecture, Inc. and the City of Lake Elsinore in an amount not to exceed $250,000 for architecture and engineering services related to schematic design phase, design development phase, and construction document phase for Rosetta Canyon Park phase 2 improvements and authorize the City Manager to execute the agreement, subject to approve as to form by the City Attorney; 2. Authorize the City Manager to approve change orders up to 10% of the agreement in the amount of $25,000. 8) ID# 14 -502 Agreement and Escrow Instructions for Purchase and Sale of Real Property: APN 370 - 120 -045 Attachments: Staff Report re Kane Purchase Sale Agr Kane Map Purchase & Sale Agmt Kane -Ryan 032415 It is recommended that the City Council approve the Agreement and Escrow Instructions for Purchase and Sale of Real Property in substantially the form attached, authorize the Mayor to execute the Agreement in such final form as approved by the City Attorney, and direct the City Manager to execute the Certificate of Acceptance. Mayor Manos pulled Agenda Item No. 6 from the Consent Calendar for discussion. Motion by Council Member Johnson, secundied by Mayor Pro Tern Tisdale to approve the Concent Calendar, less Agenda Item No. 6, passed by unanimous vote as follows: AYES: Council Member Johnson, Mayor Pro Tem Tisdale, Council Member Magee, Council Member Hickman and Mayor Manos NOES: None ABSENT: None ABSTAIN: None City or Lake Elsinore Page 3 City Council Meeting Minutes March 24, 2015 PULLED AGENDA ITEM 6) ID# 14 -500 Tuscany Hills Park Emergency Field Lighting Repairs Attachments: Staff Report - Tuscany Hills Park Emergency Repairs Tuscany Hills - Contractor Services Agreement 2015 1. Approve an exception to bid for emergency field lighting repairs at Tuscany Hills Park and award the Agreement for Contractor Services to West Coast Lighting & Energy in the amount of $75,544, plus contingency of $4,456, for a total construction budget of $80,000. 2. Appropriate a Public Works maintenance budget increase of $80,000 in the General Fund out of reserves. 3. City Council approve the Agreement for Contractor Services in substantially the form attached and authorize the City Manager to execute the Agreement for Contractor Services in such final form as approved by the City Attorney. Public Works Director Damasse provided the report to the Council advising that an unsafe condition was discovered and now staff is asking the Council to appropriate funds for the emergency repairs of the lights and electrical system. Mayor Manos asked the time for completion of the repair work. Director Damasse advised that staff has coordinated with the School District and is working with the affected teams that utilize the field to provide alternatives during the repair; 2- 3 weeks for completion of the work. Motion by Mayor Pro Tern Tisdale, seconded by Council Member Johnson to approve staffs recommendation passed by unanimous vote as follows; AYES: Mayor Pro Tern Tisdale, Council Member Johnson, Council Member Hickman, Council Member Magee and Mayor Manos NOES: None ABSENT: None ABSTAIN: None PUBLIC HEARING(S) 9) ID# 14-494 Public Hearing on the AB1600 Annual Report for Fiscal Year 2013 -14 Attachments: STAFF REPORT AB 1600 AB 1600 Annual Report 1. Conduct a public hearing and take testimony related to the AB1600 Annual Report for Fiscal Year 2013 -14 prepared in accordance with California Government Code Section 66006. 2. Receive and file the AB1600 Annual Report for Fiscal Year 2013.14 and adopt the Findings set forth hereinbelow. City of Lake Elsinore Page 4 City Council Meeting Minutes March 24, 2015 Mayor Manos opened the Public Hearing at 7:31 p.m. Administrative Services Director Simpson provided the report and findings to the Council. Mayor Manos called for public comments; no comments were received. Mayor Manos closed the public hearing at 7:35 p.m. Motion by Mayor Pro Tem Tisdale, seconded by Council Member Johnson, to approve staffs recommendation passed by unanimous vote as follows: AYES: Mayor Pro Tem Tisdale, Council Member Johnson, Council Member Magee, Council Member Hickman and Mayor Manos NOES: None ABSENT: None ABSTAIN: None APPEAL(S) - None BUSINESS ITEMS) 10) ID# 14 -503 Presentation of the Association of California Cities, Orange County (ACC -= by Lacy Kelly, CEO Attachments: ACC -OC Staff Report It is recommended that the City Council receive the presentation and consider formally joining this group. Lacy Kelly, CEO of the Association of Contract Cities Orange County (ACC -OC), made a presentation to the Council about joining the group to create a Southwest Riverside Region. Council Member Magee thanked Ms. Kelly for her presentation and advised that several meetings were held last year with the surrounding cities that were considering joining this group. He stated that time, money and results were the goals of all Southwest cities and that the City should consider re- engaging with the legislator at this time. Council Member Magee offered that the League of California Cities represents the state as a whole and this group focuses on the specific region. Council Member Magee stated that from 2006 to 2009, the City had federal lobbyist efforts at the legislature, however lost that support when the member of congress declined. He offered that now was the time to re- engage and for the five (5) cities to work together to come up with solutions to address major issues such as public safety costs and over - regulations by the Wildlife agencies. Council Member Magee said that the ACC -OC had private partners that made their efforts more effective, which is Lake Elsinore's goal, and that he would be willing to reach out to our sister cities and conduce the necessary research for the same. City of Lake Elsinore Page 5 City Council Meeting Minutes March 24, 2015 Council Member Hickman asked if the other cities were, in fact, interested in forming a new region. Council Member Magee responded that he was aware that Mayor Mann of Menifee was very interested and that the City of Wildomar could benefit, if the group was able to find a way to allow them to participate due to their financial constraints. He offered that former Murrieta Mayor Doug McAllister held the highest title within the legislative group of the League of California Cities, then left to be a part of this group due to their focus on the regional efforts as the elected officials have the vote, and not the private partners despite their paid membership. City Manager Yates added that the Council could give direction to staff to put this membership dues into the budget for the next fiscal year. Council Member Johnson asked Mayor Manos how this group compared to the League of California Cities (LOCC). Mayor Manos responded that as a State Board Member for the LOCC, he could see a lot of overlap. He offered that the State is blue and that this area is mostly red and therefore is set aside from time to time by the legislature; resulting in a need for a Southwest Riverside regional group. However, he had concerns about being on the leading edge due to the budget and needed to confirm a return on the investment. Motion by Council Member Johnson, seconded by Mayor Manos to engage the sister cities, conduct more fact findings and present to Council for consideration prior to the next budget. Mayor Pro Tem Tisdale stated that in 2012, the City re- engaged with reinstating its membership with the League of California Cities to address legislative concerns, however he could see a benefit to a regional group. He asked if this group was in competition with the LOCC? Erin Sasse, representative for the League of California Cities responded that the two groups did have overlap, but she would not call them competitors. Council Member Magee restated that he would be willing to make contact with the sister cities, conduct the research and report back to the Council whether there was a consensus of the group. The motion was called and passed by unanimous vote as follows: AYES: Council Member Johnson, Mayor Manos, Council Member Magee, Council Member Hickman and Mayor Pro Tern Tisdale. NOES: None ABSENT: None ABSTAIN: None 11) ID# 14 -504 Update on Park Maintenance Program Attachments: Update on Parks Maintenance Program 032415 This staff report is an update of staffs efforts on the City's preventative maintenance program for the City's existing 18 parks. Staff has begun the assessment of the City's parks as part of the Parks Facilities Master Plan Update which is currently in progress. Staff has prepared a short presentation to update the City Council to receive and file. City of Lake Elsinore Page 6 City Council Meeting Minutes March 24, 2015 Public Works Director Damasse provided the introduction of the Parks update to the Council. Superintendent DeSantiago presented the assessment of all 16 parks completed by staff and reviewed the maintenance schedule. Director Damasse introduced Seth Yoskowitz, Parks & Facilities Master Plan Consultant with GHD. Mr. Yoskowitz provided the update of the Park & Facilities Master Plan and their method of asset tracking for maintenance purposes. Director Damasse closed the presentation with the updated schedule of activities. Mayor Pro Tern Tisdale stated that he liked where staff was going with the update to the Park & Facilities Master Plan, however had grave concerns with the current City landscaping contractor as he felt that they were not in compliance with the scope of work that was reviewed in detail at a Council meeting. Director Damasse offered that staff has had several meetings with the contractor and CEO and are working with the City Attorney to review the contract specifications. Council Member Johnson asked when the update would be completed? Superintendent DeSantiago replied staff would be done with the park assessments by the end of June. Council Member Johnson asked that signage be used to advise the public when parks and facilities are closed for repair and to include the completion dates at each park cite. Council Member Magee asked when would the City be planting trees as he did not see that on the list? City Manager Yates responded that trees would be added to the list. Council Member Magee commended the City Parks personnel for keeping the facilities usable and safe; he reminded the public that all City parks were fenced closed to the public in 1999 due to the maintenance expenses, but that all are now open and being upgraded for the benefit of the public. Mayor Manos added that it was very important for staff to under promise and over perform when it comes to completion of projects. City of Lake Elsinore Page 7 City Council Meeting Minutes March 24, 2015 CITY COUNCIL COMMENTS Council Member Hickman invited the public to the levee to view the Marine bridge; he announced the Easter Egg Hunt scheduled for April 4th at 10:00 a.m. and wished everyone a Happy Easter. Council Member Johnson thanked staff for their hard work on their thorough staff reports; she thanked the Coast Guard Auxiliary for all the work they do and announced the Clean Extreme event scheduled for April 25th. Council Member Magee thanked his fellow Council Members for their vote of confidence to conduct the ACC -OC research; he thanked Ruth Atkins of the Historical Society for all the research she had completed relating to the Christensen family and asked staff to find something in Canyon Hills that can be named for the family. Council Member Magee acknowledged the Lucas Oil event and the economic impacts of these events upon the community; he asked for developers of educational institutions to look at establishing facilities here in Lake Elsinore to increase educational opportunities for the community members; he asked the City Attorney to monitor the lawsuit between the POA of Canyon Lake against the Elsinore Valley Municipal Water District; and lastly thanked staff for all their hard work. Mayor Pro Tem Tisdale thanked both Police and Fire personnel for all their hard work with the Lucas Oil event and thanked the Council for allowing him to speak freely. Mayor Manos explained that the land purchase at Serenity Park is being done with restricted funds to improve the community and that no Eminent Domain was executed for the same; he expressed appreciation to his colleagues for bringing important things to the agenda, and thanked staff for their hard work. Mayor Manos announced the National Water Ski Races to be held on March 28 - 29 and stated that the lake would be closed during this event; and he invited the public for free lake use on April 4th, opening day.
