CALL TO ORDER
The regular Nuisance Abatement Hearing was called to order by Robin Chipman,
Code Enforcement Manager at 4:33 PM.
PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Loraine Wafts.

Also present were: Code Enforcement Officer Fred Lopez, Code
Enforcement Officer Shawn Slater and Office Specialist Joyce Teyler.
PUBLIC COMMENTS
John Boggs.from Corman Leigh was there to discuss 31363 Machado Street. He
indicated it was a project that Corman Leigh was involved in and they had been
in negotiations with the lender trying to generate funds to take care of the
maintenance on the property. He apologized for the maintenance not having
been done. He stated he would have the problem taken care of by the end of the
week.

PUBLIC HEARINGS
Chairwoman Loraine Watts opened the Public Hearing at 4:35 p.m.
3. 15900 GRAND AVENUE, APN 381-050-0011381-050-002. LAKE
ELSINORE, CA
Chairwoman Watts addressed the case. She indicated there were several
people who would like to speak regarding the case.
Code Enforcement Manager Chipman indicated he would have Officer Slater
introduce the case and then each of the speakers could respond. He stated he
wanted everyone to be on the same page and wanted Officer Slater to show the
pictures he had so everyone could see the current condition of the property.
Code Enforcement Officer Slater indicated that this case involved the Military
Academy with the above address. He addressed the Board and the members of
the community. He stated the Military Academy was on Grand Avenue and had
sat vacant for several years. He commented the case had originally been
brought before the Nuisance Board in June of 2006. He indicated it was
declared a public nuisance and there was a representative from the Garrett
Group at that time that was very responsive. He said she gave them
communication information. He indicated they were out there regularly to clean it
up. He commented trespass paperwork was on file with the Sheriff Department.
He stated there were regular tours of the property by Code Enforcement and
Police. He said since 2006 the property had slipped into its current condition.
He indicated the pictures in front of them were taken on Friday wherein a tour
was taken with Code Enforcement, Sheriff Department and Board Member
Fagan. He stated he would cycle through the pictures. He said the case had
been written up for the perimeter fence which was dilapidated in some areas. He
commented it was either a car accident or a tree had fallen down leaving the
fence badly damaged, open and accessible to people from the main
thoroughfare. He stated the fence had also been damaged off a more secluded
street, Bonnie Lane which was more accessible to community kids. He indicated
it made it more accessible to vandals, transients, fires, crime and the rest of the
community. He commented there was lots of overgrown and dead vegetation,
fallen trees, piles of branches and the building was open in many areas and
boards removed. He said they had accessed the building on Friday. He
indicated the trespassers were out there in the evening hours stripping wires and
metal from everywhere they could get it. He commented the building was literally
stripped clean of all metal and anything of value. He stated the picture they had

been looking at was the backside along the Lake. He commented most of the
main areas were boarded up pretty well. He indicated the power box was
stripped of all the metal and they were trying to steal the box as well. He stated it
looked like they were trying to steal a power line too. He commented they
stripped all the contents from an air conditioner unit. He said that was the
window that was open and accessible that they had walked through. He
indicated the picture showed evidence of transients or people sleeping on the
property. He addressed a picture of two deputies who cleared the area making it
safe for them. He stated the picture showed another room on the second story
level that was an addition that really was not originally a part of the Academy
when it was built. He showed a lot of water damage with structural integrity
diminishing, taggers leaving their mark, Board Member Fagan, another power
box with everything taken out of it, more recent taggings with a date of February
23, 2009, main entrance, and where people tried to strip out the water heaters
while drinking beer. He explained back in 2006 when times were better the
Garrett Group was able to fund the placement of an onsite security staff who
abandoned their trailer there when they left. He indicated some of the
companies who had these services to stay on site supplied the trailer and that
was the condition wherein it was abandoned. He stated the most recent tour of
the property was that afternoon with the Building Official. He commented they
drove the exterior fence line and walked the building exterior themselves. He
said all the accessible portions on the exterior of the building were all boarded
up. He commented members of the Garrett Group were out there. He indicated
Mr. Garrett had been out there for the last couple of days boarding it up. He
stated they had some of their associates cutting the vegetation leaving it in the
piles that you saw on the property. He commented they had regular
communication with the Garrett Group unfortunately due to the economic times
they had not been as responsive as they would have liked them to be. He said
there had been some reorganization of their staffing. He said they had been
there that day. He indicated they had come to City Hall to let the Building Official
know that they did have the intent to improve it and make the necessary changes
to make this a more secure structure to eliminate or medicate any of the risk to
' our community. He stated unless the. Board decided otherwise he would
recommend the Board declare the property a nuisance so we could clear off any
remaining debris or hear what Mr. Garrett had to say and if it was appealing to
the Board give him the time to make those changes before we would have to go
in and do it ourselves.
Chairwoman Watts thanked Officer Slater. She called Scott Garrett to the
podium.
Scott Garrett asked if they needed his address or if they already had it. He
stated he was not sure what the formality was.

Code Enforcement Manager Chipman asked him to introduce himself on the

Scott Garrett indicted Officer Slater had a good presentation. He stated they
were out there on a regular basis trying to keep the building as secure as
possible. He commented it was an ongoing battle. He said the building was
secure as of that afternoon but he had no idea how long it would be before
someone came along and took the boards off again. He indicated they were out
there quite often. He stated they cleaned around the property and they disked
the big open areas, weed whacked around the building, picked up where they
could and they had noticed that someone on the east side of building had taken
palm fronds, junk and stuff and thrown it in the building. He commented that was
not them. He said a couple of years ago they hired a professional tree trimming
company to clean up some of the palm trees. He indicated they made every
effort they could to keep the building secure as possible and they would like to
work with the City staff. He stated they had a few ideas perhaps in the future
they could discuss because they saw it as a long term challenge. He
commented due to the economy nothing was going to happen with this property
for a couple of years or longer. He said he would like to work with us to see what
they could do to secure it. He asked if there were any questions he would be
happy to respond.
Code Enforcement Manager Chipman thanked Mr. Garrett. He asked Mr. Garrett
Fill to sit down in order to hear the rest of the comments and then the Board would
probably have questions for him.
Chairwoman Watts called Linda Ridenour to the podium.
Linda Ridenour stated she lived at 33628 Brand, Lake Elsinore. She indicated
she felt grief to be there that day. She stated she had walked through the Military
Academy before The Garrett Group purchased the property and it was beautiful.
She commented at that time they had a caretaker, the floors were beautiful,
everything was pristine and in five years it had gone from a beautiful place to a
wreck. She said she begged to differ with him regarding him coming by
regularly. She indicated it had not been happening for two years. She stated
she was there at the meeting in '06 when there had been a lot of promises. She
commented the promises had not been kept. She said it was his responsibility to
keep the property up and she was sorry he was having hard times. She
indicated he had neglected the property from the beginning. She stated it was
listed on the Riverside County Historic Properties. She commented it was his
responsibility to keep the property in the pristine condition that he purchased it in.
She thanked the Board for their time.
Chairwoman Watts thanked her. She called Ruth Atkins to the podium.

Ruth Atkins asked if she could ask Mr. Garrett a question.
Chairwoman Watts asked her to speak into the mike because they could not hear
her.
Ruth Atkins asked Mr. Garrett if it was true that he attended the Military
Academy.
Mr. Garrett stated he had a picture of his father and his first cousin from 1936.
He indicated they went to summer camp there so they did have a long history.
Ruth Atkins thanked him. She indicated based upon what Mr. Garrett had said
that the family had a long history, she would be ashamed if she were them to
have let this lovely facility become what it looked like now. She stated there were
many people who were extremely upset and she was one of them that had saw
all of the things that had gone on there. She commented the place would not be
touched for weeks and the windows that Officer Slater had shown that were
uncovered were not covered for several weeks. She indicated she thought they
needed to give prompt attention to the property. She stated the representatives
had come to the Historical Society and had given a presentation a year and a
half ago of what the project was going to become. She commented that was fine
but from that time on nothing had happened and it had gone downhill. She said if
they did not want to keep it up she suggested they move on because there were
people who would love to get a hold of that property and restore it to what it was
at least five years ago. She indicated they thought it was a shame that this
treasure of Lake Elsinore, built in the '20's and a reputable school from 1936 to
1976 was in this condition. She stated they needed to give it a little more
attention. He commented she sympathized with them for the property situation
being what it was but she had people say to her that they may be telling Lake
Elsinore that they did not have the money but she understood they were doing
quite well on some other properties. She said she felt they needed to find a little
bit of money and at least show them that they were sincere about making the
property look more presentable.
Chairwoman Watts thanked Ruth Atkins. She called Pete Dawson to the
podium.
Pete Dawson greeted the Board. He indicated he lived at 18010 Grand Avenue,
Lake Elsinore. He stated he represented a group of property owners concerned
with the condition and security of the Military School. He commented the number
one concern was the preservation of this historical monument but also concerned
for the nuisance that the lack of security represented. He said he did not believe
Mr. Garrett meant what he said when he looked at the doors and windows. He
indicated the doors and windows he recognized as months not weeks opened.
He stated when that party took over the Military School they were elated that that

member of their society with the long history with the Military School was going to
take over. He felt they would take good care of it. He commented that recently
the vandalism and the nuisance to neighboring properties was increasing. He
indicated break-ins at the neighborhood communities were directly reflected from
people occupying the Military School. He said many access points were not
addressed for months. He commented two years ago he made a comment at a
Historical Society Meeting that he thought The Garrett Group's plan was to allow
as much nuisance as possible and hopefully someone would set fire to the
building and then they would have the same thing as across the lake. He
indicated he was assured that that was not the case. He stated he was given a
number and a name for people to call when problems arose. He commented
there was no one at that number. He said no one answered the phone and it
was a problem. He indicated it represented a real big problem for him because
he was given the Small Business of the Year award in the building. He stated he
believed the last meeting that was held in that building was in 1999 or 2000 when
the last Business of the Year was represented there. He said he had that award
and he had a picture of that building of how nice it was and now he was ashamed
of what had happened to that building since. He commented he wanted
something done. He said he did not just want it boarded up again. He indicated
he wanted the repair of what had been vandalized. He thanked the Board for
their time.
i Chairwoman Watts thanked Mr. Dawson. She called Dotty Paulsen to the
podium.
Dotty Paulsen stated she lived at 15937 Avondale Way which shared the same
fence line with the Military School. She indicated as far as someone keeping an
eye on the place that was non-existed. She commented they would have seen it.
She stated they had not seen anyone since Mitch left. She said when Rose was
handling it, it was not pristine but it was in nice condition. She indicated since
that time her major upset was the way they kept the grounds. She stated the
weed abatement was terrible. She commented her allergies were going way out.
She said the,weeds go so high you could not see people walking over there, they
were hiding. She indicated that the weeds get so high they are living there. She
stated they come out and do partial weed abatement like last year and figured
that was good enough. She commented it was not and that they needed
tractors. She said they could not just have a weed whacker go down there and
do it because it comes right back. She indicated the property was so big and
there were so many things you needed a tractor to tear up. She stated like when
Rose had done it, she had a tractor come in once a year. She commented now it
was not being done and the weeds were just growing way out of'hand. She said
they come with a weed whacker and they whack a little bit and then they leave.
She indicated as far as someone coming down to watch the property that was
non-existing because they would have seen it since they share the same
property fence line. She thanked the Board.

Board members thanked Dotty Paulsen.

Chairwoman' Watts asked Axel Paulsen to come to the podium.
Axel Paulsen stated he was her husband. He commented his thoughts were if
the Historical Society and the City of Lake Elsinore were really concerned they
should make a petition for donations to help.
The Board thanked Mr. Paulsen.
Chairwoman Watts indicated she would bring that up with Ruth Atkins. She
asked Ms. Atkins if it was a historic building with the Historical Society in Lake
Elsinore or with the County of Riverside.
Ruth Atkins stated it was with the Lake Elsinore Historical Society of the South.
Chairwoman Watts asked Mr. Garrett to step to the podium. She directed to him
that he had heard the comments that the neighbors had made about his property.
She indicated that there apparently was no one there watching the property or
doing what had to be done. She asked him what he had decided to do with the
property.
Scott Garrett indicated they would continue to monitor it and keep it clean. He
stated he had worked with the City in the past. He commented they had a tractor
out there at least once a year. He said they had a tractor out there last Spring.
He stated they usually wait until after the weeds had grown and they disked the
whole site. He indicated they work around the structure where ever they cannot
disk but they do have a tractor out there. He commented a couple of years ago
they had cleared it all the way to the shoreline. He said there had been a lot of
stuff they had cleared out, debris. He indicated.it mysteriously reappears. He
stated they had spent a couple of weeks on the shoreline a couple of years ago
cleaning up all sorts of stuff. He commented they would make every effort and
they would like to work with the City on a couple of ideas which he felt was not
appropriate to discuss right now. He indicated he would like to work with the staff
to say this was how we would like to monitor the site better.
Board Member Fagan asked was he claiming they had been maintaining the
property both the grounds and the building over the last four years.
Scott Garrett indicated the grounds, yes. He stated he could only speak from
what he had seen since the time he had been in the building and that had been
from the time they had taken it over. He commented he had never seen it in
good shape. He said he was not saying it was not in good shape, he was sure it
was in shape, but from the time that they had taken it over the addition that was

I I made onto the front where the last caretaker lived was there, the roof had always
leaked and stuff like that.
Board Member Fagan asked when he took the property over was it in the
condition like you see in those pictures.
Scott Garrett indicated no, it had degraded. He stated the electricity in the
building was working and they had rewired all the lights around the building
recently. He commented when the price of copper got high in the last couple of
months or year, they had come in and stole everything they had. He said the
panel energized, they had electricity through the building, motion detector lights,
they had done everything and they tried to keep the building as secure as they
could. He indicated they would like to work with the City to see if they could do
something more. He stated that talking to the City staff that day, their people
were out there cleaning and when they were out there it was mostly kids coming
out of the hills and some coming from Bonnie Bell Street or Bonnie Lane
whatever it was. He indicated they would make an effort to repair the fence but
the fence gets cut on the street and the kids come out of the hill and they could
not chase them down but they go back across Grand Avenue up into the hills.
Board Member Fagan indicated what he was hearing him say was that he was
unable to maintain the property.
Scott Garrett indicated he did not believe he was saying that.
Code Enforcement Manager Chipman indicated it seemed to him the biggest
issue was the lack of security on the site itself. He stated you could not expect
that vacant parcel, almost forty acres, was that correct?
Scott Garrett concurred.
Code Enforcement Manager Chipman stated without anyone on site you were
going to get vagrant activity out there constantly. He commented they were
going to need a security on that site. He said going back two years ago when the
Board declared it a nuisance, he believed Linda somebody.
Code Enforcement Officer Slater corrected Nancy Daniels.
Code Enforcement Manager Chipman concurred, Nancy Daniels. He indicated
she had represented his company, and they had put the effort out at that time.
He commented they had secured the site like he had commented but the biggest
improvement was having the security guard on site. He stated that deterred
most all the activity and it was not until after the guard left that the building went
downhill again.

Scott Garrett indicated that was what they would like to do, and he had spoken to
Manager Chipman last week about whether they could put someone on site. He
stated they would like to have lights to light it up which meant they would have to
have electricity. He commented they could have someone there, someone who
could stay or maybe a shift of people with a trailer. He said given the situation
and given this was going to be like this, the economy was going to be the way it
was nothing was probably going to happen on the site for a couple of years. He
indicated they needed to get power to the site in order to light it up in order to
have security lighting. He stated they did have power at one time. He
commented they paid a guy and put all those lights in. He said they wanted
power to the pole so they could get lights on the site which would be very
important to them.
Chairwoman Watts indicated in 2006 the economy was good and this was 2009 .
and the economy was bad but any time you have a building in which no one was
there to make sure it was secure people were going to break in. She stated it
was a known fact how they were stealing copper or steal anything they thought
they could sell. She commented they would steal the building if they thought
they could sell it. She said she remembered in 2006 when Ms. Daniels had
given them the wonderful presentation stating everything was going to be done.
She indicated right before nuisance abatement something gets done but then
once it was out of nuisance abatement then it goes downhill. He stated to be
honest the City of Lake Elsinore was trying to keep the image we wanted for the
City and then to pass this huge boarded up building did not help our image.
Scott Garrett commented the most critical thing they needed to do was to put
someone or.someone's on the site so they had someone there all the time. He
indicated they believed they could do it with generator power. He stated it would
be more expensive and it would not be as environmentally friendly but they could
do it if they were left with no other option. He commented they would like to get
power to the. site so they could re-wire the lights all along the back and all along
the front with motion detectors. He stated this way the person or people who
were there could see what was moving around because they wanted them to be
secure too. He indicated they would work with them however they could.
Board Member Fagan asked if they had a plan already.
Scott Garrett asked him if he was talking about a plan for the site.
Board Member Fagan stated for the plan he was talking about.
Scott Garrett asked if he meant was it drawn out on paper.

Scott Garrett indicated no. He commented the existing pole that was there, they
could put a meter back on the pole or if they had to put a new box on that they
could. He stated the pole and building were very close and they could run power
to the building and not energize the whole building.
Board Member Fagan indicated getting power to the building was not the
problem.
Scott Garrett asked then what was the problem?
Board Member Fagan commented keeping the power going to the building. He
stated people come by and steal it so it had to have an eye kept on it.
Scott Garrett stated he understood. He indicated his electrician had his ladder
stolen while he was working there. He commented it was a big ladder. He said
they had gone into the basement and stole the ladder and that took work to steal.
He stated that they wanted to put someone there fulltime and get water and
electricity so they could maintain some of the grounds. He indicated they looked
at it as a long term, ongoing situation. He stated they would have to maintain the
property a couple of years before they do something else to develop that site.
He commented they would like to work with us and agreed they needed to get
someone on the site. He said they would like to get more than one person on the
site with electricity and water so they could do the best they could.

Code Enforcement Manager Chipman indicated the Board did not have the
latitude to grant you power and/or the right to have someone stay on the
property. He stated that would be handled through the City Hall and Planning
and Zoning and Building. He commented they had discussed the power issue a
week ago. He said Mr. Fagan was correct simply giving power to the site was
not the answer. He indicated it would have to be in conjunction with the whole
plan that you would lay out regarding security and who was to be on site. He
stated it would not be just somebody he hired off the street to be security, it
would be a trained security person or personnel. He commented there would
have to be a whole plan laid down before the City would agree to that. He
indicated it had gone drastically downhill. He stated he was shocked when he
saw it that day. He commented those people were right. He said from a couple
of years ago when Nancy Daniels cleaned up, it had deteriorated drastically. He
indicated Officer Slater and him saw signs. He stated they saw the brush
underneath the basement which looked like someone was getting ready to light
the building on fire.
Scott Garrett indicated that was done with effort.
Code Enforcement Manager Chipman stated someone had done that.

Scott Garrett commented the palm fronds did not just walk under there. He said
~I someone took a lot of effort to do that. He indicated he would have his people
pull that out and get it out there. He stated he noticed that when he was out
there on Thursday or Friday.
Chairwoman Watts thanked Mr. Garrett. She asked if the Board had anything to
discuss.
Board Member Fagan stated no.
Code Enforcement Manager Chipman asked that Mr. Garrett put together a plan
and present it to the City on how he proposed to have onsite security. He stated
also that he show how power would be supplied to the property, if the City was
willing to give him electricity, how you would use that electricity for security and
for whatever reasons. He commented they needed to see the plan put together
before they could make those determination.
Board Member Fagan indicated with a schedule when these things would be
accomplished.
Code Enforcement Manager Chipman stated he agreed there had to be a time
frame implemented.

UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE THE

4. 31363 MACHADO STREET APN 379-150-044 LAKE ELSINORE CA
Board Member Watts asked Code Enforcement Officer Lopez to speak regarding
the case.
Code Enforcement Officer Lopez indicated the case was initiated January 7,
2009 on routine patrol. He stated he noticed there was a large amount of graffiti
on that particular job site. He commented it had not been maintained to City
standards as far as graffiti. He said proper notice was sent with a Notice of
Violation and a Warning. He indicated he also sent out one citation. He stated
once there was no response, no phone call, nothing, he had decided to take the
case to nuisance in order to have the graffiti abated. He stated if the gentleman
was willing to get that taken care of by the week's end, he did not have a problem
with extending it out. He indicated the other issue that was probably going to
happen, not necessarily through Code Enforcement but through Public Works

n was the weed abatement issue. He stated that was a total separate issue but
that would probably be noticed soon as well.
Code Enforcement Manager Chipman stated the names on the notifications were
different than Corman Leigh was there someone else who actually owned the
property.
Chairwoman Watts asked Mr. Boggs to step up to the mike.
Mr. Boggs stated the property was an assemblage of different parcels and this
was one of the old parcel owners. He indicated our information was old. He
commented they were responsible for the walls and they would take of them.
Code Enforcement Manager Chipman stated alright.
Board Member Fagan indicated he had driven by that day and there was debris
in various parts of the field.
Code Enforcement Officer Lopez stated that was a possibility but his only focus
at that time was the graffiti. He indicated every time he had gone out there it had
been locked so he had not had access to actually go back there to look. He
commented that part of the weed abatement process notices were sent out twice
F1 a year to vacant parcels such as that one. He said he believed those notices
were sent out around March 1 st which would have included that property.
Mr. Boggs stated they had done the fall weed abatement but it had grown back
since then. He indicated they 'had made efforts to keep the site as secure as
they could but obviously kids, vandals and people that do this kind of thing tear
that stuff up. He stated there could be some additional debris. He indicated he
did not think there was much debris out there because it had been pretty well
locked. He-said it was mostly pedestrian traffic that he saw going in and out of
there. He commented they had been out there and done some work with
EVMWD to try to preserve the integrity of the water system that runs through
there which was active. He indicated he would take a look and if there was stuff
out there they would get it picked up.
Code Enforcement Manager Chipman indicated to Mr. Boggs since his project
was on hold due to the economy, did they have a regular crew that went out and
maintained the property.
Mr. Boggs stated Mr. Chipman was looking at it.

Code Enforcement Officer Lopez asked Mr. Boggs for his contact information so
if there were any further issues he could just contact him directly.
Mr. Boggs indicated that was no problem.
Code Enforcement Officer Lopez indicated the information he had was the most
recent as recorded through Riverside County and the name that had come up
was Wah Taing out of Temecula.
Mr. Boggs stated it was hard to explain but there were three pieces of property
that were assembled there or maybe four. He explained when they had gone
through there and graded the site there were out parcels that were there and the
address was the Wah Taing property but the walls were located on the rest of the
property. He said that was why ',he was there instead of Mr. Wah Taing.
Code Enforcement Officer Lopez indicated that was okay.
Code Enforcement Manager Chipman recommended they continue the case to
allow Mr. Boggs time to clean up the property and if resolved within the thirty
days then they would dismiss the case.

6. Nuisance Abatement Board Comments:
Board Member Fagan indicated the Military Academy was a perfect spot
for dumping and he asked Code Enforcement Officer Slater if he had it on
a schedule to keep an eye on the property or the Sheriffs Department.
Code Enforcement Officer Slater explained he drove by daily and the two
new deputies also drove by several times a week with a combination to
the locks and were very eager to catch anyone on the property.
