HomeMy WebLinkAboutCC Reso No 2014-072 Tentative Parcel Map No. 36632 Finance & Convetance of the Spyglass Specific Plan 10-14-2014RESOLUTION NO. 2014 -072 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING TENTATIVE PARCEL MAP NO. 36632 FOR FINANCE AND CONVEYANCE PURPOSES LOCATED NORTHERLY OF THE SPYGLASS SPECIFIC PLAN, SOUTHERLY OF ROSETTA CANYON AND EASTERLY OF CAMINO DEL NORTE AND 1 -15 FREEWAY WHEREAS, Erik Lunde, Pacific Coves Investments, LLC, has filed an application with the City of Lake Elsinore requesting approval of Tentative Parcel Map No. 36632 for Finance and Conveyance Purposes; and WHEREAS, the 227 -acre project site is generally located northerly of the Spyglass Ranch Specific Plan, southerly of the Rosetta Canyon development, easterly of Camino Del Norte and the 1 -15 Freeway; and WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated with the responsibility of making recommendations to the City Council for approval of Tentative Parcel Maps; and WHEREAS, pursuant to the California Environmental Quality Act (Cal. Pub. Res. Code §§ 21000 et seq.: "CEQA ") and the CEQA Guidelines (14 C.C.R. §§ 15000 et seq.), public agencies are expressly encouraged to reduce delay and paperwork associated with the implementation of CEQA by using previously prepared environmental documents when those previously prepared documents adequately address the potential impacts of the proposed project (CEQA Guidelines Section 15006); and WHEREAS, CEQA Guidelines Section 15162 establishes the standard to be used when determining whether subsequent environmental documentation is necessary and says that when an environmental document has already been adopted for a project, no subsequent environmental documentation is needed for subsequent entitlements which comprise the whole of the action unless substantial changes or new information are presented by the project; and WHEREAS, pursuant to and consistent with the California Environmental Quality Act (CEQA), environmental clearance for the proposed project is provided by Mitigated Negative Declaration No. 2005 -08, which evaluated the environmental impacts that would result from maximum build -out project site and was adopted by the City Council on November 8, 2005 for Tentative Tract Map 31593; and WHEREAS, on September 2, 2014 at a duly noticed public hearing the Planning Commission considered evidence presented by the Community Development Department and other interested parties with respect to this item; and made its recommendation to the City Council to approve Tentative Parcel Map No. 36632 by adopting Planning Commission Resolution No. 2014 -36; and City Council Resolution No. 2014 -072 Page 2 of 3 WHEREAS, on October 14, 2014 at a duly noticed public hearing, the City Council considered the recommendation of the Planning Commission as well as evidence presented by the Community Development Department and other interested parties with respect to this item. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The City Council has reviewed and analyzed the Project prior to making a decision to approve Tentative Parcel Map No. 36632 for Finance and Conveyance Purposes. SECTION 2. That in accordance with State Planning and Zoning law and the City of Lake Elsinore the following findings for the approval of Tentative Parcel Map No. 36632 for Finance and Conveyance Purposes have been made as follows: 1. The proposed subdivision, together with the provisions for its design and improvement, is consistent with the General Plan. The proposed subdivision is compatible with the objectives, policies, general land uses and programs specified in the General Plan (Government Code Section 66473.5). The project is proposed to allow for financing and conveyance purposes only. No development will be permitted as a result of approval of this map. Any future development of the site must be preceded by the final approval process of a Tentative Tract Map for subdivision purposes. 2. Subject to the attached conditions of approval, the proposed project will not result in any significant environmental impact. No development will be permitted with the approval of Tentative Parcel Map No. 36632. The project has been adequately conditioned by all applicable departments and agencies and will not therefore result in any significant environmental impacts SECTION 3. Based upon all of the evidence presented, the above findings, and the conditions of approval imposed up the project, the City Council hereby approves Tentative Parcel Map. No. 36632 for Finance and Conveyance Purposes. City Council Resolution No. 2014 -072 Page 3 of 3 SECTION 4. This Resolution shall take effect from and after the date of its passage and adoption.
