I PROPOSED ORDER OF PROCEEDINGS FOR PUBLIC HEARING March 27, 2012 Mayor names the next agenda item: "Agenda Item No.'_, Public Hearing for Approving the Annexation of Territory and the Levy of Assessments for Lake Elsinore Landscape and Street Lighting District No. 1 as Annexation Area No. 22 (La Laguna). The public hearing is hereby officially opened at o'clock p. m. " 2. City Manager makes the following remarks: "Mr. Riley has come forward to present the item. After the staff presentation, the Council will receive comments and questions and any oral protests from any interested persons. When all comments have been received, the Mayor will close the public hearing. First, City Clerk, please announce the notice." 3. City Clerk: "Notice of the public hearing has been published in accordance with the Landscape and Lighting Act of 1972 and proof of such publication is on file in the City Clerk's office." 4. Staff Presentation. 5. Mayor requests testimony from the public: "It is time to take testimony from the public." (a) "Is there anyone wishing to speak in favor of the district annexation ?" (b) "Is there anyone wishing to speak against the district annexation ?" (c) "/s there anyone wishing to speak at all ?" 6. Mayor brings it back to the City Council for City Council discussion 7. The Mayor makes the following remarks: "Before I formally close the hearing, are there any other property owners subject to the proposed assessments who wish to file written protests? If so, they must be filed with the City Clerk at this time. For the purpose of a majority protest, only written protests are to be considered." [Pause to see if there are any protests.] The public hearing is hereby closed. 8. The Mayor then announces: "At this time, I hereby direct the City Clerk to tabulate the ballots and announce if a majority protest has been made upon the question of approving the annexation of territory and the levy of assessments. " [Pause for tabulation of the ballots.] 9. The City Clerk tabulates the ballots and announces whether a majority protest exists. 10. If no majority protest exists, the Mayor then asks: "Do I have a motion to adopt the resolution approving the levy of assessments for Lake Elsinore LLMD No. 1 as Annexation Area No. 22 (La Laguna) ?" 11.
