A few years ago, my partner and I decided to build a first -class medical building in this area. At
the time, we had the option of building on sites in Corona, Temecula, or Lake Elsinore.
Fortunately, Lake Elsinore is a business - friendly city and approved the project.
Since the project began, however, we have been denied rights to modification several times.
First of all, because we had concerns that people would gather at the gazebo after - hours, we
tried to eliminate it, but were denied this request. Next, at one point, we were over - budget
and hoped to get rid of the glass band around the building, but the request was denied.
Further, we attempted to alter the building usage for one of the suites and were once again
denied. Finally, we requested an addition of one or two small windows in an area that is not
weight- bearing, but the suggested requirements by the city made it cost - prohibitive.
The current obstacle impeding the completion of the project concerns the construction of the
mortar and pestle on top of the building which had originally been approved on a smaller scale
with a foam material. We formed a template in the original size, but it was out of proportion; it
was too small in comparison to the rest of the building. The other problem was that the foam
needed to be glued to the structure. We consulted the structural engineer and he suggested we
build a frame model. Although the mortar and pestle is only a projection and is not weight
bearing, framing will make the structure sturdier.
We approached the city with several new mortar and pestle designs, which were slightly larger
than the original one and composed of a frame rather than of foam. Over the course of a
month, each of our proposed designs was rejected. We then submitted five entirely new
designs — which ranged from 72 to 120 inches high — and asked that the city choose one, alter
one, or make new suggestions. After a month and a half, on September 4`" we received
approval for a 108 inch design, followed by an email request to draw it up to scale. We
assumed that the city had taken that month and a half to research city codes and requirements
and check with the planning director before approving the final mortar and pestle design.
Based on that approval, we proceeded to build the structure at a cost of $13,600.
The height of the mortar and pestle from east side of the building is only 35 feet 4 inches and
from the middle of the building the height is 36 feet 4 inches
We were at the final stage of construction when the city halted further progress. We were not
given the opportunity to trim the rough surface and smooth the stucco to give the mortar and
pestle more appeal. When designing this building, we tried to make it different from the
surrounding structures in style, material, and composition (at a greater cost to us), so this
projection is an important part of the building. Demolishing the mortar and pestle would
increase the financial burden, alter the character of the project, and further delay construction.
Therefore, because we are two months behind in construction time already and far over
budget, we request that you consider granting this variance.
in conclusion, please keep in mind that the construction of this building will bring over twenty
new high - paying jobs to the city of Lake Elsinore.

RE: Mortar and Pestle Feature on Medical Building on Lakeshore Drive (APN 378-

Dear Mr. Mashayekan:
As I promised at our meeting yesterday, I spoke with Acting Community Development
Director Warren Morelion regarding your proposal regarding the mortar and pestle
feature on the roof of your new pharmacy. You are proposing that the City of Lake
Elsinore allow you to reduce the feature's height and width and to complete the
surfacing and painting of both the mortar and pestle and the building so that we can see
what mortar and pestle looks like in the context of the completed and painted building.
Warren and I have significant doubts that the mortar and pestle feature that you have
constructed can be trimmed and finished in a manner that will make it acceptable or that
it will not exceed the City's Municipal Code's maximum allowable height of 35 feet.
Furthermore, both the mortar and pestle feature and the monument sign were
constructed without permits. We are willing to work with you, but your failure to obtain
the appropriate building permits has directly led to the situation we are in now.
Bill Belvin, the City Building Office, Warren and I reviewed the building plans that were
submitted to the City and approved when you applied for a building permit. Mr.Belvin
advised me that:
Based upon the approved building plans, the architectural feature at 16800
Lakeshore Dr. was approved to be built with cementitous coated foam and not to
exceed over all building height of 35 feet. The feature exceeds the 35 feet and
was not built with cementitous coated foam, the contractor built it with wood
frame and stucco (not per approved plans) and no inspections. A Stop work
notice was issued for the feature and Monument sign that was also constructed
without permits or approvals. The following is a list of corrections that will need to
be submitted to the Building Division for approvals.
1. Submit a revised plan showing framing, attachments to roof, lath and
stucco, flashing for plan check.

2. Planning approval.
3. Need Engineering from Structural Engineer showing the roof will hold the
load of new feature.
4. Show dimensions of feature not exceeding 35 feet in height.
5. Submit plans, obtain building permits and get planning approval for
monument sign.
6. The following must be done within the next 10 days or a stop work will be
issued for the whole project.
The City expects that you will comply with these requirements in a timely manner.
However, we are willing to let you demonstrate to us that the mortar and pestle feature
can be modified to meet City standards and aesthetics. However, PRIOR TO
COMPLETING, the mortar and pestle feature, I will need an original signed letter from
you acknowledging that you will comply with the above requirements within the next 10
days, that you acknowledge that you are completing the feature at your own risk and
expense, and that you will remove or redesign the mortar and pestle feature at your own
cost should the City determine that the completed feature is still unacceptable. The
letter will need to include a scale drawing of the building and feature, with dimensions,
that you show what the feature will look like when completed.
Upon receipt of your letter, we will advise whether you can proceed. If you have any
questions, please contact either myself or Warren Morelion, Acting Community
Development Director.
