HomeMy WebLinkAboutCity Council Vacancy Agenda Item No. 10City Council Vacancy Agenda Item # 10 Meeting Procedures Mayor Pro Tem: Introduce Agenda item and call upon the City Manager to present the staff report. City Manager: Presents staff report and summarizes procedures Mayor Pro Tem: Invites Public Comments. Mayor Pro Tem: Invites each of the 4 applicants to make a 3- minute statement. The order will be determined by random selection. Mayor Pro Tem: Invites City Council discussion. Council Members may ask questions of the candidates. Upon the conclusion of the Council's questions, the Mayor Pro Tem will then call upon the City Clerk to conduct the nomination process. City Clerk: Call for nominations. Nominations do not require a second although "seconding comments" are permitted. Upon a Council Member nominating an applicant, the City Clerk will call for any further nominations. The City Clerk will close the nomination process when no additional nominations are made. City Clerk: Roll -call vote. Each City Council Member will announce his or her first choice candidate. The candidate that receives 3 affirmative votes shall be appointed to fill the vacancy and the nomination /appointment process will be is closed without any further action. An abstention does not qualify as an affirmative vote. City Clerk: Re -open nominations. If no candidate receives 3 affirmative votes, the City Clerk will invite a motion to reopen nominations. City Council: Any Council Member may make a motion to reopen nominations. This motion requires a second and a majority vote. City Clerk: Call for nominations — Round Two. Previously nominated candidates may be nominated again in subsequent rounds. Nominations do not require a second although "seconding comments" are permitted. Upon a Council Member nominating an applicant, the City Clerk will call for any further nominations. The City Clerk will close the nomination process when no additional nominations are made. City Clerk: Roll -call vote — Round Two. If new nominations are made, the City Clerk will conduct a roll call vote. Each City Council Member will announce his or her first choice candidate. The candidate that receives 3 affirmative votes shall be appointed to fill the vacancy and the nomination /appointment process will be is closed without any further action. An abstention does not qualify as an affirmative vote. City Council Deadlock: If no nominee receives 3 affirmative votes, the City Council can repeat the process to re -open nominations and vote again. If a majority of the City Council does not vote to re -open the nominations and the City Council is deadlocked, then the item must be continued to a special meeting with direction to the City Clerk to prepare the necessary documentation to call a special election in the event an appointment is not made. Special Meeting: Applicable law requires that the City Council fill the vacancy by appointment or call a special election within 60 days of the vacancy. The City Council must continue the item to a special meeting to be conducted on or before Monday, September 25th, (expiration of 60 days) to re- conduct the nomination process and /or call for a special election and direct staff to prepare all of the required documentation relating to the special election in the event an appointment is not made.
