Mayor Johnson called the Closed Session meeting to order at 5:00 p.m. ROLL CALL PRESENT: Council Member Hickman, Council Member Magee, Council Member Tisdale, Mayor Pro Tern Manos and Mayor Johnson Also present: City Manager Yates, City Attorney Leibold, and City Clerk Bloom. CITY COUNCIL CLOSED SESSION CONFERENCE WITH LEGAL COUNSEL -- ANTICIPATED LITIGATION Initiation of litigation pursuant to paragraph (4) of subdivision (d) of Section 54956.9: (1 potential case) CONFERENCE WITH REAL PROPERTY NEGOTIATOR (Gov't Code Section 54956.8) Property: APN #370 - 120 -045 Agency negotiator: City Manager Yates Negotiating parties: City of Lake Elsinore and Richard Kane & Darlene Ryan Under negotiation: Price and terms of payment City Attorney Leibold announced that the City Council would be meeting in Closed Session to discuss the two items identified on the Closed Session Agenda relating to Anticipated Litigation and Real Property negotiations. Mayor Johnson reconvened the regular City Council meeting at 7:00 p.m. PLEDGE OF ALLEGIANCE Rick Morsch led the Pledge of Allegiance. ROLL CALL PRESENT: Council Member Hickman, Council Member Magee, Council Member Tisdale, Mayor Pro Tern Manos, and Mayor Johnson Also present: City Manager Yates, City Attorney Leibold, City Clerk Bloom, Administrative Services Director Simpson, Community Development Director Taylor, Planning Manager MacHott, Public Works Director Damasse, Police Chief Hollingsworth, and Deputy City Clerk Giron. CLOSED SESSION REPORT City Attorney Leibold announced that the City Council met in Closed Session to discuss all items identified on the Closed Session Agenda and that there was no reportable action taken. PRESENTATIONS / CEREMONIALS Certificate of Recognition presented to Rick Morsch Business of the Quarter Mayor Johnson presented a certificate of recognition to Rick Morsch for his serving on the City's Planning Commission for 4 years. Mayor Johnson presented the Business of the Quarter Award to La Unica and the Topeti Family for their many years of business. PUBLIC COMMENTS — None CONSENT CALENDAR 1) ID# 14 -198 Warrant List Dated June 26 2014 It is recommended that the City Council of the City of Lake Elsinore receive and file the Warrant List dated June 26, 2014 City of Lake Elsinore Page 2 City Council Meeting Minutes July 8, 2014 2) ID# 14 -199 City Investment Report for May 2014 Staff recommends that the City Council receive and file the City Investment Report for May 2014. 3) ID# 14 -200 Approval of CDBG Joint Recipient Cooperative Agreement for Fiscal Years 2015 -2016 2016 -2017 and 2017 -2018 1. Adopt Resolution No. 2014 -_; A Resolution of the City Council of the City of Lake Elsinore Authorizing Participation in the County of Riverside's Urban County Program for Fiscal Years 2015 -2016, 2016 -2017, and 2017 -2018. 2. Authorize the Mayor to execute the Joint Recipient Cooperation Agreement with the County of Riverside allowing the City to participate in the Urban County Community Development Block Grant and the HOME program. 4) ID# 14 -201 Approval of Professional Service Contract with Carole Donahoe to Provide Specialized Planning Services for Fiscal Year 2014 -2015 1. Approve a Professional Services Contract with Carole Donahoe for the provision of specialized planning services to the City of Lake Elsinore during Fiscal Year 2014 -2015, subject to any minor modifications as approved by the City Attorney. 2. authorize the City Manager to execute the Professional Services Contract with Carole Donahoe. 5) ID# 14 -202 Residential Design Review No. 2014 -04 - A Request by Ryland Homes for Approval of Building Designs for 64 Single- Family Detached Residential Units Including a Model Home Complex and Related Improvements for a Housing Project Located Within the Summerly Development of the East Lake Specific Plan 1. Adopt Resolution No. 2014 -_, A Resolution the City Council of the City of Lake Elsinore Adopting Findings that Residential Design Review No. 2014 -04 is Consistent with the Western Riverside County Multiple Species Habitat Conservation Plan (MSHCP). 2. Adopt Resolution No. 2014 -_ confirming special taxes and assessments for Fiscal Year 2014 -15 for the Community Facilities Districts. 2. Adopt Resolution No. 2014 -_ special taxes and assessments for Fiscal Year 2014 -15 for AD 93 -1 Cottonwood Hills. Motion by Council Member Tisdale, second by Council Member Hickman, to approve all items identified on the Consent Calendar passed by unanimous vote as follows: AYES: Council Member Tisdale, Council Member Hickman, Council Member Magee, Mayor Pro Tern Manos and Mayor Johnson NOES: None ABSENT: None ABSTAIN: None PUBLIC HEARING(S) 8) ID# 14 -205 Public Hearing on the Citywide Landscaping and Street Lighting District and the Landscaping & Street Lighting Maintenance District No. 1 for Fiscal Year 2014 -15 1. Open the public hearing and take testimony related to the Citywide Landscaping & Street Lighting District ( "Citywide LLMD ") and Landscaping & Street Lighting Maintenance District No. 1 ( "LLMD No. 1 ") annual assessments. 2. Close the public hearing. 3. Adopt Resolution No. 2014 -_ confirming a diagram, assessment, and providing for annual assessment levy after formation of a district for Fiscal Year 2014 -15 for the Citywide LLMD. 4. Adopt Resolution No. 2014 -_ confirming a diagram, assessment, and providing for annual assessment levy after formation of a district for Fiscal Year 2014 -15 for the LLMD No.1. City of Lake Elsinore Page 5 City Council Meeting Minutes July 8, 2014 Mayor Johnson opened the Public Hearing at 7:09 p.m. Administrative Services Director Simpson introduced Shane Spicer, Director with Webb & Associates. Mr. Spicer announced that the annual Engineers Reports for both LLMD assessment districts were withdrawn and reviewed as there was a short -fall in those accounts. He stated that Albert A. Webb & Associates has recalculated those assessments and hereby presents new Engineer reports. Mayor Johnson called for public comment; no comments received therefore closed the Public Hearing at 7:16 p.m. Mayor Pro Tern Manos asked why the costs increased? Director Simpson explained that there was a miscalculation in last year's Engineer's Report as the costs were actually doubled therefore the City was subsidizing the assessments. Motion by Mayor Pro Tern Manos, seconded by Counci Member Hickman to adopt Resolution No. 2014 -054, passed by unanimous vote as follows: AYES: Mayor Pro Tern Manos, Council Member Hickman, Council Member Magee, Council Member Tisdale and Mayor Johnson NOES: None ABSENT: None ABSTAIN: None Motion by Mayor Pro Tern Manos, seconded by Council Member Tisdale to adopt Resoluiton No. 2014 -055, passed by unanimous vote as follows: AYES: Mayor Pro Tern Manos, Council Member Tisdale, Council Member Magee, Council Member Hickman and Mayor Johnson NOES: None ABSENT: None ABSTAIN: None APPEAL(S) - None BUSINESS ITEM(S) - None PUBLIC COMMENTS Pat Kilroy, resident, spoke regarding a grant awarded to City's Lake, Parks & Recreation division. Ms. Miller, resident, spoke regarding the CEQA requirements in the East Lake Specific Plan. Kristain Crawford spoke regarding his proposed business of Pedestrian Auxiliary Support Services. Chris Hyland, resident, commended City Manager Yates for his services. City of Lake Elsinore Page 6 City Council Meeting Minutes July 8, 2014 CITY MANAGER COMMENTS City Manager Yates commented that the City held a wonderful 4th of July celebration which he enjoyed with this family. CITY ATTORNEY COMMENTS City Attorney Leibold congratulated La Unica for their recognition and wished Commissioner Morsch well. CITY COUNCIL COMMENTS Council Member Hickman thanked Commissioner Morsch for his years of service on the Planning Commission; he gave kudos to La Unica restaurant; he stated that the Fireworks were very enjoyable; he announced the Movies in the Park, Free Family Swim Night at Lakeside High School; and the Recreation Expo at the Community Center. He announced the passing of school board member Jeannine Martineau. Council Member Magee reported the Service Day at Lakeside High for the Pathway Project in which over 75 people had participated resulting in 12 mentors completing the training; he asked if the service center could be moved to the Cultural Center once school started. Council Member Magee asked to revisit the Seaport Boat Launch facility uses; and asked if the Cultural Center could be made available to the public for meeting rooms. Council Member Tisdale thanked staff for their hard work; congratulated Commissioner Morsch for his services; he commented on the issues in Murrieta which was tearing the community apart in that it is a sad situation where people are being used as pawns. He suggested that residents write to the Governor. Mayor Pro Tern Manos congratulated La Unica; thanked Commissioner Morsch for his services; offered that he attended the June 27th Conference of Realtors at which the City was getting a lot of attention; he announced that he attended the Town Hall meeting regarding the Murrieta immigration issues and asked the public to use their energies and anger in the right direction. Mayor Johnson stated it was an honor to finally recognize La Unica and wished them continued success; she announced the new businesses of United Gastro Int. and Yogartland; she thanked the Parks & Recreation Department for a great holiday weekend with no complaints; she thanked Commissioner Morsch for his service. City of Lake Elsinore Page 7 City Council Meeting Minutes July 8, 2014 ADJOURNMENT Mayor Johnson adjourned the meeting in memorial of two local residents who passed away, Bret Snyder and Judith Ann Palombo.
