MAIN STREET LAKE ELSINORE, CA 92530 TUESDAY, MAY 6, 2014 CALL TO ORDER Chairman Blake called the Nuisance Abatement Hearing to order at 5:00 p.m. PLEDGE OF ALLEGIANCE Chairman Blake led The Pledge of Allegiance. ROLL CALL PRESENT: Chairman Blake Board Member Thomas Community Development Director Taylor Also present: Code Enforcement Supervisor Lopez, Code Enforcement Officer Hernandez and Community Development Tech Teyler. PUBLIC COMMENTS None. CONSENT CALENDAR 1. NONE PUBLIC HEARINGS 2. 821 ORIOLE COURT APN 379 - 174 -043 LAKE ELSINORE CA Chairman Blake asked Code Enforcement Supervisor Lopez to give his report of the case. Code Enforcement Supervisor Lopez stated Code Enforcement has had a case on this property for over eight years and the property has always been vacant. He stated the property owner is listed as The Panacea Corporation out of Carson City, Nevada and every notification sent has come back undeliverable. He gave PAGE 2 — NUISANCE ABATEMENT MINUTES — MAY 6, 2014 an overview of the case and his efforts to effectively clear the violations at the property. Code Enforcement Supervisor Lopez recommended the Board declare the property a public nuisance to allow it to be referred over to receivership. Chairman Blake asked Mr. Hector Rosales to the podium. Mr. Hector Rosales introduced himself. He indicated he was in an agreement with The Panacea Corporation to purchase the home. He explained there was a tax lien on the property had recently been lifted and in a couple of days they would start escrow. He stated as soon as escrow closed, he would be cleaning up the property bringing it up to code. Community Development Director Taylor asked how long would it take for escrow to close. Mr. Rosales stated thirty to forty -five days. He commented the loan had gone through. Chairman Thomas asked if paperwork regarding escrow could be submitted to the City. Mr. Rosales stated yes. Community Development Director Taylor asked about permits, etc. from the City to bring property to Code. He recommended Mr. Rosales speak with the Building Official Belvin. He discussed the damages at the property. Chairman Blake asked what his intentions were with the property. Mr. Rosales stated he was buying the house as his first home purchase as a residence. Community Development Director Taylor inquired as to fencing around the premises to prevent trespassers. Mr. Rosales indicated there was and he recently repaired the fence. Chairman Blake closed the Public Hearing at 5:10. Nuisance Abatement Board discussed the case. Community Development Director Taylor recommended they declare the property a nuisance with the prospect owner to submit escrow documentation PAGE 3 — NUISANCE ABATEMENT MINUTES — MAY 6, 2014 and continue the item to the July 1, 2014 hearing. He stated if the property had not completed escrow to submit the property for receivership. MOVED BY COMMUNITY DEVELOPMENT DIRECTOR TAYLOR, SECONDED BY CHAIRMAN BLAKE AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE THE PROPERTY LOCATED AT 821 ORIOLE COURT, APN 379 -174- 043, LAKE ELSINORE, CA, A PUBLIC NUISANCE AND CONTINUE THE CASE TO THE JULY 1, 2014 NUISANCE ABATEMENT HEARING. 3. 500 N. SPRING ST. , APN 377 - 242 -012 LAKE ELSINORE CA Code Enforcement Officer Hernandez indicated the case was initiated March 6, 2013. He stated it was a vacant lot across the street from a gas station used by City, County and contractor employees. He gave his overview of the case. He recommended this property be declared a public nuisance. Chairman Blake asked where this vacant lot was located. Code Enforcement Officer Hernandez explained the vacant lot was on the corner of Flint and Spring Street. Chairman Blake asked for any comments on the matter. The Nuisance Abatement Board commented on the case. MOVED BY COMMUNITY DEVELOPMENT DIRECTOR TAYLOR, SECONDED BY BOARD MEMBER THOMAS AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE THE PROPERTY LOCATED AT 500 NORTH SPRING STREET, APN 377 - 242 -012, LAKE ELSINORE, CA, A PUBLIC NUISANCE. 4. 305 W. SUMNER AVE. APN 374 - 072 -047 LAKE ELSINORE CA Code Enforcement Officer Hernandez requested that the Nuisance Abatement Board move this case to the next Nuisance Hearing on June 3, 2014. He indicated he had been in contact with the property owner's realtor and they were attempting to sell the property. Chairman Blake asked if there was any discussion with the realtor about them rectifying any of the issues before it was sold or were they going to sell it as is condition. PAGE 4 — NUISANCE ABATEMENT MINUTES — MAY 6, 2014 Code Enforcement Officer Hernandez indicated the realtor stated they were going to attempt to clean up the property, do some repairs and sell as is. MOVED BY COMMUNITY DEVELOPMENT DIRECTOR TAYLOR, SECONDED BY CHAIRMAN BLAKE AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO CONTINUE THE PROPERTY LOCATED AT 305 WEST SUMNER AVENUE, APN 374 - 072 -047, LAKE ELSINORE, CA TO THE NEXT NUISANCE ABATEMENT HEARING ON JUNE 3, 2014 5. Code Enforcement Comments: Code Enforcement Supervisor Lopez gave an overview of the past nuisance abatement properties. Code Enforcement Officer Hernandez called 411 North Main property owner Schietzelt to the podium for discussion. Property Owner Schietzelt discussed with the Board the violations and the improvements he had made. 6. Nuisance Abatement Board Comments: Community Development Director Taylor inquired about the Ambassador Hotel. Nuisance Abatement Board discussed the June 3, 2014 Nuisance Abatement Hearing. ADJOURNMENT Chairman Blake adjourned the meeting at 5:34 p.m. to the next regularly scheduled meeting to be held on June 3, 2014 at 5:00 p.m. at Lake Elsinore Cultural Center, 183 N.
