HomeMy WebLinkAboutCC Reso No 1964-1135 CompleteRESOLUTION NO. 1135 RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF ELSINORE, ASCERTAINING AND DETERMINING THE PREVAILING RATE OF WAGES TO BE PAID FOR THE PUBLIC WORK CONSISTING OF THE CONSTRUCTION OF A MINERAL WATER DISTRIBUTION SYSTEM AND THE CONSTRUCTION AND REPLACEMENT OF A DOMESTIC WATER DIS- TRIBUTION SYSTEM LOCATED IN THE CITY OF ELSINORE, CALIFORNIA. THE MAYOR AND CITY COUNCIL OF THE CITY OF ELSINORE DO RESOLVE AS FOLLOWS: WHEREAS, the Mayor and the City Council of the City of Elsinore are about to call for bids for the public work consisting of the construction of a mineral water distribution system and the construction and replacement of a domestic water distribution system located in the City of Elsinore, California; and WHEREAS, pursuant to the provisions of the Labor Code of the State of California, it is necessary that the Mayor and City Council of the City of Elsinore ascertain and determine the general prevailing rate of wages on public works, and the provisions of said Code make it mandatory upon the awarding body of any public works contract where the said body subsequently called for bids for any public improvement to ascertain and determine the general prevailing rate of per diem wages in the locality in which the work is to be performed, for each craft or type of workman or mechanic needed to execute the contract, and also the general prevailing rate for legal holidays and over -time for each craft or type of workman or mechanic; NOW, THEREFORE, the Mayor and the City Council of the City of Elsinore, California, have ascertained and have hereby determined that the general prevailing rate of per diem wages in the locality in which the said work described is to be performed in the construction of a mineral water distribution system and the construc- tion and replacement of a domestic water distribution system located in the City of Elsinore, California, for each craft or type of workman or mechanic needed to execute the contract and also the general prevailing rate for legal holidays and over -time work for each craft or type of workman or mechanic to be as follows: PREVAILING WAGE RATE CRAFT OR TYPE Carpenter Millwright Table Power Saw Operator Structural Ironworker Laborer - General or Construc. Apprentices may be employed in conformity with Section 777.5 of the California Labor Code. Overtime rates of pay for Saturdays, Sundays and New Year's Day, Memorial Day, Independence Day, Labor Day, Armistice Day, Thanksgiving Day and Christmas Day, and rates of pay for reporting for work and for working fewer hours than a regular day's work and for shift work vary according to existing labor agreements governing working conditions for the craft or type of workman involved. Said agreements are hereby recognized and in- corporated herein as though fully set forth, and the rates and .conditions established therein are hereby found and determined to be the general prevailing rate of wages for legal holidays and overtime work. It shall be mandatory upon the contractor to whom the contract is awarded, and upon any subcontractor under him, to pay not less than the said specified rates to all laborers, workmen and mechanics employed by him in the execution of the contract.
